MMD2009 -00018 SKATE PARK RESTROOMS NOTICE OF TYPE I DECISION MINOR MODIFICATION (MMD) 2009-00018 TIGARD SKATE PARK RESTROOMS 120 DAYS = 8-28-2009 SECTION I. APPLICATION SUMMARY FILE NAME: Skate Park Restrooms CASE NO.: Minor Modification(MMD) MMD2009-00018 PROPOSAL: The applicant proposes to build a restroom facility adjacent to the Tigard IT Office Building. The two restrooms will be on the east side of the IT Building and will be approximately 140 sq.ft. in size. The restrooms will primarily serve the users of the adjacent Griffith Skate Park 140 sq. ft. of landscaping consisting of minor shrubs and bark dust will be removed.No other changes are proposed. The CBD zoning district is designed to provide a concentrated central business district, centered on the City's historic downtown, including a mix of civic,retail and office uses. Single-family attached housing, at a maximum density of 12 units/net acre, equivalent of the R-12 zoning district, and multi-family housing at a minimum density of 32 units/acre equivalent to the R-40 zoning district, are permitted outright. A wide range of uses, including but not limited to adult entertainment, utilities, facilities with drive-up windows, medical centers, major event entertainment and gasoline stations, are permitted. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520 and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2009-00018 Tigard IT Building Restroom Decision 050409 Page 1 of 4 CONDITION OF APPROVAL PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION, THE FOLLOWING CONDITION SHALL BE SATISFIED 1. Applicant shall request final inspection by the Planning Division prior to requesting final inspection for occupancy from the Building Division. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 8720 SW Burnham Street, WCTM 2S102DA-00200, at the corner of Burnham Street and Hall Boulevard. The parcel consists of the City of Tigard Information Technology Building and its associated parking lot. It is adjacent to a parcel where the Griffith Skate Park was constructed. The subject parcel is classified as Public Support Facility which is allowed outright in the CBD zone. Proposal Description: The proposal is to construct a 140 sq. ft. restroom facility immediately adjacent to the east side of the IT Building. The facility is intended to enhance the use of the Gnffith Skate Park on the adjoining parcel. There is no proposed or required change to parking. Approximately 140 sq. ft. of landscaping consisting of minor ornamental shrubs and bark dust will be removed. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No additional on-site parking is required. Therefore,this criterion does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures. Therefore, this criterion does not apply. Therefore,this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off-site traffic would be affected. Therefore,this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; There will be no increase in vehicular traffic to and from the site. Therefore, this criterion does not apply. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The proposed increase in floor area is less than 10% of the 3,100 sq. ft. main building. Therefore,this criterion is satisfied. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. Therefore,this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. The proposal does not reduce the roject amenities by more than 10% or reduce project amenities below the minimum established by this code. Therefore,this criterion is satisfied. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of B 1 through 10 above of this subsection. The proposal does not modify conditions imposed at the time of side development review approval which are not the subject of B1 through 10 above of this subsection. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a site development have been met. The restroom is intended to primarily serve the adjacent skate park south of the existing office building, on a separate parcel (2S 10 2DA tax lot 400). Both parcels are owned by the City of Tigard. The addition of the restrooms is not anticipated to result in an increase in users, but rather is a necessary amenity to improve the existing park facility. The restroom facility is proposed to be located directly adjacent to the City office building, along the east façade. The footprint of the addition is approximately 9'-7"x14'-3". The new restroom is sited where there is existing landscaping and paved area. Based on an aerial photo, the site has approximately 5,750 SF of existing landscaping. Approximately 140 SF of existing landscaping consisting of mainly grass and bark dust will be removed to accommodate the new restrooms. No parking or existing building area will be removed. D Access to the restrooms will be from the south,façade of the restroom addition. The proposed restroom addition is approximately ;1.611-SF in size and consists of two bathrooms. The existing on-site building houses City administration and is approximately 3,100 SF in size. Therefore, after the addition, the total building area will be 3,240 SF. The following table lists development standards specific to development in the CBD zone, and what is proposed with the new restroom facility. Though approximately 140 SF of existing landscaping will be removed to accommodate the new restrooms, the site still meets the minimum landscape requirement of 15%, with approximately 19% landscaping. 18.765.070 MINIMUM AND MAXIMUM OFF-STREET PARKING REQUIREMENTS It is assumed that the City classifies this facility as a "Public Support Facility," Response: The existing parking lot includes 31 parking spaces. Community Recreation uses require a minimum of 2.0 stalls per 1,000 SF, and a maximum allowance of 2.5/1,000 (zone A). Given that the site is within one half-mile of high-frequency transit services, we assume that it is located within Zone A. Based on the square footage of the new restroom (140 SF), for a total of 3,240 SF, 6 parking stalls are required. The existing parking stalls satisfy the minimum requirement, and no new parking is proposed to be added. TYPE I MINOR MODIFICATION The following section addresses code sections applicable to the proposed new restroom facility. 18.360.030 APPROVAL PROCESS A. New developments and major modifications. Site development review for a new development or major modification of an approved plan or existing development, as defined in Section 18.360.030A, shall be processed by means of a Type II procedure, as governed by Section 18.390.040, using approval criteria contained in Section 18.360.090. Response: The proposed restroom facility addition is not classified as a major modification, and therefore is not subject to a Type II procedure. See response to Section 18.360.050(B) below. This criterion does not apply. B. Minor modifications. Minor modifications of an approved plan or existing developments, as defined in Section 18.360.060, shall be processed as a Type I procedure, as governed by Section 18.390.030, using approval criteria contained in Section 18.360.060. A change in the type and location of accessways and parking areas where off-site traffic would be affected; Response: The restrooms will be accessed via the existing driveway along SW Burnham Street by car, or the existing pedestrian path connecting to the adjacent park. Therefore, no change in the location or type of accessway is proposed. This standard does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; Response: The addition of the restrooms is not anticipated to result in an increase in users, but rather is a necessary amenity to improve the existing skate park facility. Currently, there is a temporary bathroom for park users. This standard is met. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; Response: The existing City office building is approximately 3,100 SF. The addition of approximately 140 SF of restroom area results in a 5% increase in floor area, and is under 5,000 SF. This standard does not apply. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; Response: There is no minimum open space requirement in the CBD zone.
