This building will re lace a residence that was used for storage previously and then demolished in February of 2002 (BUP2000-00049 . The new building will be in the same location as the original building and will be approximately 295 square feet smaller. The construction area is in a small grove of g pp y q s go eo trees. The new building,which was identified in the 2003 Summerlake Park Mater Plan,will be used for winter storage of park equipment. It will be a pole building with four roll up doors and 2 access doors. No trees will be removed for construction of the building. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Conditional Use application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The prior use approved for this site is Community Recreation. The use is not proposed to change. 2. A 10% increase in dwelling unit density; The site is not developed with a residential use;therefore,this criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The proposed building is within the interior of the ppark, away from access points and parking areas. There are no changes proposed to the accessway or parking areas, and off-site traffic will not be affected by the construction of the storage building. This standard is met. An increase in the floor area proposed for non-residential use by more than 10%where previously specified; The request is to reconstruct a storage building to replace a larger residence previously used for storage. The area will decrease by 295 square feet. The proposed building is 1,800 square feet; whereas the previous building was 2,095 square feet. Therefore, this standard is met. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; Summerlake Park is approximately 26 acres. The proposed 1,800 square-foot building will replace a previously existing building with a larger footprint. The open space area of Summerlake Park will not be reduced by more than 10%; therefore this criterion is met. 6. A reduction of specified setback requirements by more than 20%; The applicant is not asking for a reduction of setbacks. This standard is not applicable. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions;. The new storage building is proposed within the same location as a previously existing residence. As noted in #5 above, the park is made up of almost 26 acres of land. The construction of an 1,800 square-foot building will not eliminate landscaping or recreational facilities by more than 10%. 8. A 10% increase in the approved density; The proposed modification request does not involve residential development; therefore,no increase to density is involved in the request. Tigard Municipal Code 9.06—Trees on City Property Section 9.06.050 requires that trees on City property be protected by following the guidelines within the Tree Manual. These requirements shall provide for the proper protection of tree roots, trunk(s) (or stem(s)), branches, and foliage within a tree's critical root zone for any tree on City property during any type of construction activity or project (excavation, demolition or any other type of disturbance). Because Summerlake Park is a City property, the requirements of the Tigard Municipal Code (TMC) Chapter 9.06 (Trees on City Property) apply. This code section addresses the protection, removal, and planting of trees on City property. The applicant's proposal does not include removal or planting of trees, therefore only protection of existing trees is relevant. As noted within the City Arborist's comments, the applicant has not provided a tree plan or shown how the requirements of TMC 9.06 are satisfied. A condition of approval has been imposed to ensure the trees are protected. Conclusion This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws and the condition of approval below: Summerlake Park Storage Building(MMD2009-00034) Page 2 of 3 • THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING CONDITION AND LIMITATIONS. Only those trees whose critical root zones are in close proximity to the construction, staging, and stockpiling areas of the project will need to be included on the tree protection plan. If you have any questions or concerns regarding my comments please contact me anytime. 9.06.050 Tree Protection (1) Care of Trees on City Property. The City shall follow the Tree Manual in caring for and protecting trees on City property. (2) These requirements shall provide for the proper protection of tree roots, trunk(s) (or stem(s)), branches, and foliage within a tree's critical root zone for any tree on City property during any type of construction activity or project(excavation, demolition or any other type of disturbance); Section 020 of the Tree Manual defines the Critical Root Zone as follows: Critical Root Zone (CRZ). A circular region measured outward from a tree trunk representing the essential area of roots that must be maintained and protected for the tree's survival. The CRZ is determined by whichever is greater: a. The outer edge of the dripline; b. Measuring a radius outward from the tree equal to one foot for every caliper inch less than four (4) inches when measured at six inches above the ground; c. Measuring a radius outward from the tree equal to one foot for every inch at DBH when the caliper inches are greater than four (4) inches when measured at six inches above the ground. Note: The proposed project in Summerlake Park will take place within the critical root zone of the City's trees and must therefore adhere to the applicable provisions of the Tree Manual. Tree Manual 070 Tree Protection The tree protection provisions in this section apply to the protection of trees on City property. 1. Tree Protection Methods. The City shall follow the Tree Manual in caring for and protecting trees on City property. a. The protection of an individual tree's critical root zone shall be determined by the method listed below unless otherwise approved by the Public Works Director or designee: Trunk Diameter Method—one foot of radial distance for every inch of tree diameter (DBH, 4 '/z feet above the ground on the uphill side) under 30 inches DBH. For trees over 30 inches DBH allow 11/2 feet per one inch of DBH. b. All tree protection devices shall be located on the Tree Protection Plan. Details and specifications are required as to how the trees will be protected on site; c. Tree protection devices shall be installed to protect the root zones of trees located on adjoining properties if any type of construction activity will be disturbing the critical root zone unless otherwise approved by the Public Works Director of designee. d. A construction sequence shall be provided and shall include: (1) installation and removal of tree protection devices; (2) clearing,grading, or installation of erosion control measures; (3) other activities that may be required to implement the tree protection measures; (4) Include in the notes of the final set of plans: "Equipment, vehicles, machinery, dumping or storage, or other construction activities, burial, burning, or other disposal of construction materials shall not be located inside any tree protection device.'; f. All tree protection devices shall be: (1) Visible; (2) Well-anchored; (3) Approved in the field by the Public Works Director or designee prior to clearing,grading, or the beginning of construction; (4) Remain in place and maintained until the project has shown compliance with development requirements from the City's Planning Department. g. The location of stockpile and staging areas for construction shall be identified on the Tree Protection Plan; h. All tree protection guidelines shall be included in the final Tree Protection Plan's notes or drawings; Tree protection requirements a-h in Section 070 of the Tree Manual have not been met. Please consider requiring the applicant to submit a tree protection plan by a certified arborist in accordance with the specifications of the Tree Manual. 090 Replacement Trees This section applies to the replacement of trees and trees planted as mitigation as required by Tigard Municipal Code, Chapter 9.06 1. Existing non-hazardous trees removed by development projects or other construction activities shall be replaced with types of trees approved by the Public Works Director or designee according to the tree plan requirement below; 2. Tree Plan Required. A tree plan for the removal,planting, and protection of trees six inches at DBH or greater prepared by an International Society of Arboriculture Certified Arborist shall be provided for any development on City property. Widening of existing public streets will be exempted from tree mitigation requirements. Construction of new streets and extension of existing streets as shown in the Transportation System Plan maps are likewise exempted from tree mitigation requirements. The original building rltNGI ° dwelling converted to use as storage for park use until it was demolished. Since the iVEEFUNG demolition of the building the area has been used as open storage and is presently bare dirt with a mulch cover. The new building is needed for winter storage of park equipment from Cook Park and other park facilities. This storage facility was identified for replacement in the Summerlake Park Master Plan completed in 2003. Up until now there has not been money in the Parks budget to replace the building. The storage building will be a pole building made of wood and metal siding with a metal roof. It will have 4 roll up doors for equipment and 2 walk-in access doors. We will not be removing any trees. The new storage building will be in the same location as the original building. The original building square footage was 2095 sq. ft. and the new storage building will be 1800 sq. ft. or 295sq. ft. smaller. The height of the original building was 24 ft. and the height of the new storage building roof will be 18 feet. The storage building will contain one 12 x 30 locked storage room located on a cement pad to allow dry storage and work on equipment. There will be a 100amp 220volt electrical circuit for light and plugs. One propane heater with a 500 gallon propane tank located outside away from the building is proposed for heat. There are presently at least 4 outside parking spots located adjacent to this building. There are no personnel associated with this new storage structure, no new personnel are budgeted for this facility and presently there are only 2 personnel that work out of the existing building. This facility is not open to the public. 18.330.030 Approval Standards and Conditions of Approval 18.330.020 2. The Director shall determine that a major modification(s)has resulted if one or more of the changes listed below have been proposed: a. A change in land use; There is no change in land use. The property is a City Park. b. An 10%increase in dwelling unit density; There is no increase in dwellings or density. There are no dwellings on the property. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; No access ways or parking areas are affected. No off-site parking is affected. All driveways and parking areas will remain the same. Additional parking will be provided inside the storage building. d. An increase in the floor area proposed for non-residential use by more than 10%where previously specified; There is a slight decrease in floor area from the previous building. The floor area of the buildings in the Park is over 4000 sq ft. and the paved floor area of the new building will be 360 sq.feet (12ft. x 30 ft.). e. A reduction of more than 10%of the area reserved for common open space and/or usable open space; The park area is 26 acres, the new building will be 1800 sq.ft. There is less than 10%decrease in common area. f. A reduction of specified setback requirements by more than 20%; There are no setbacks requested of affected. The 20 trees in the grove immediately adjacent to the proposed new building have been assessed to be in fair to good condition. The one exception is Tree #13 which is a dead Pacific Dogwood. The proposed location is surrounded by mature Douglas Firs that are located very near the new building location. Normally it would not be feasible to place such a structure as proposed. However, the building is being sited on the footprint of an old house that has been demolished. The foundation and footings of the old house should have prevented development of significant roots within the perimeter of the house. Therefore, impact to root zones will be minimal. Placing a new structure in this location is feasible providing the following tree protection measures are implemented: 1. Tree protection fencing will need to be installed as shown on the attached "Appendix 1—Tree Protection Plan". The fence needs to be a minimum 6'tall chain link fence or a minimum 6' tall "No Climb" woven wire fence. Fencing shall be supported by 8'studded tee steel fence posts at a maximum spacing of 10'on center or closer as required to support the fence. 2. Additional tree protection measures that apply to this site are included in the attached Appendix 2 which is a check list. It is my understanding that excavation work for the new building will be minimized. The interior floor of the building is to be compacted gravel. New driveways and walks to the proposed building will be of gravel and placed on existing grades. The general construction method will be to install building framing from the inside of the perimeter of the structure with a small crane starting from the north and end finishing at the south end so that access to exterior walls with equipment from outside the building will not be necessary. The electrical service will be buried underground within an old existing driveway to the old house formerly occupying the proposed building location. No other buried utilities are proposed for the site. There will be no drywells or soakage trenches. It will be necessary to have an International Society of Arboriculture Certified Arborist on site to supervise excavation work. I. Before Construction: App. Non-App. Xi ❑ a. Identify and number the trees to be protected, verify by mapping and/or tagging and note their size in D.B.H. (Diameter at Breast Height), variety, health and structural conditions, review plans. X7 ❑ b. Check with local government agencies for tree protection ordinances. XI ❑ c. Remove any low limbs that may be in the way of construction equipment, and prune as needed to adhere NAA standards. XI ❑ d. Leave a protective covering on the soil, i.e., existing groundcover or mulch. 2 ❑ e. Notify all other contractors that these trees are to be saved and protected. ffi ❑ f. Install a temporary 6' high metal no-climb fence to protect the trees and their root systems. Install tree protection sign on fence. Posts located 10' on center as a general rule. For every inch in diameter of the trunk (D.B.H.) allow up to 1 foot of radius from the trunk as the protected area. (Example: 24" D.B.H. = 24' radius of protected root system.) Ideally, we need to protect more than the drip zone. The drip zone into the trunk is the support roots that hold the tree up. The roots from that drip zone out provide nutrition, water and oxygen. Try to avoid loss of more than 30% of root on any one side. This allows some encroachment within the drip line. This should be determined on a case by case site conditions reviewed. (SEE ENCLOSED SITE PLAN) X ❑ g. Identify any insect or disease problems that may require treatment. a ❑ h. Engineer and design proposed structures and construction to avoid root loss. Bridge type foundations can save major roots. ❑ i. Design landscape islands and planting areas large enough to accommodate trees at maturity. X ❑ j. Plant the right tree in the right place. Provide insect and disease control, fertilization and pruning as needed or adhere to long-term protection plan if provided. XI ❑ c. Avoid direct irrigation spraying onto the trunk. The amount of irrigation needed to keep new plantings alive can often be enough to kill mature trees. X ❑ d. Do not cover existing root systems with more than 2" of soil. The more soil you add, the greater the chances of damaging the root system. X ❑ e. Provide irrigation and/or drainage to emulate pre-construction conditions. NOTE: This tree protection plan identifies construction protection measures to prevent unwarranted tree loss. The identified measures limit the amount of earth disturbance surrounding the trees, and limit the removal of the tree's root systems. Due to the variation of every project, it is unlikely all of the above identified measures can be practicably applied to each individual tree; nor is it likely each measure is necessary to retain each tree. The 20 trees in the grove immediately adjacent to the proposed new building have been assessed to be in fair to good condition. The one exception is Tree #13 which is a dead Pacific Dogwood. The proposed location is surrounded by mature Douglas Firs that are located very near the new building location. Normally it would not be feasible to place such a structure as proposed. However, the building is being sited on the footprint of an old house that has been demolished. The foundation and footings of the old house should have prevented development of significant roots within the perimeter of the house. Therefore, impact to root zones will be minimal. Placing a new structure in this location is feasible providing the following tree protection measures are implemented: 1. Tree protection fencing will need to be installed as shown on the attached "Appendix 1 —Tree Protection Plan ". The fence needs to be a minimum 6' tall chain link fence or a minimum 6' tall "No Climb" woven wire fence. Fencing shall be supported by 8' studded tee steel fence posts at a maximum spacing of 8' on center. 2. Access roadways through the existing grove will need to be covered with wood chips or hog fuel and maintained at a minimum depth of 12 inches. A geo- textile fabric needs to be installed on the ground beneath the chip layer. The temporary construction roadways shall exist from the edge on the existing paved driveway to the site to the edge of the proposed new building. Details are shown in the attached "Appendix 1 —Tree Protection Plan ". 3. Additional tree protection measures that apply to this site are included in the attached Appendix 2 which is a check list. It is my understanding that excavation work for the new building will be minimized. The interior floor of the building is to be compacted gravel. It will be necessary to have an International Society of Arboriculture Certified Arborist on site to supervise excavation work. Before Construction: App. Non -App. Xi ❑ a. Identify and number the trees to be protected, verify by mapping and /or tagging and note their size in D.B.H. (Diameter at Breast Height), variety, health and structural conditions, review plans. ❑ b. Check with local government agencies for tree protection ordinances. X ❑ c. Remove any low limbs that may be in the way of construction equipment, and prune as needed to adhere NAA standards. XI ❑ d. Leave a protective covering on the soil, i.e., existing groundcover or mulch. X ❑ e. Notify all other contractors that these trees are to be saved and protected. 1ffi ❑ f. Install a temporary 6' high metal no -climb fence to protect the trees and their root systems. Install tree protection sign on fence. Posts located 10' on center as a general rule. Ideally, we need to protect more than the drip zone. The drip zone into the trunk is the support roots that hold the tree up. The roots from that drip zone out provide nutrition, water and oxygen. Try to avoid loss of more than 30% of root on any one side. This allows some encroachment within the drip line. This should be determined on a case by case site conditions reviewed. (SEE ENCLOSED SITE PLAN) X) ❑ g. Identify any insect or disease problems that may require treatment. ❑ h. Engineer and design proposed structures and construction to avoid root loss. Bridge type foundations can save major roots. ❑ i. Design landscape islands and planting areas large enough to accommodate trees at maturity. ❑ j. Plant the right tree in the right place. Avoid future conflicts with buildings and utilities. X ❑ k. Have an experienced Arborist review landscape plan to assure the right tree is planted in the right place and proposed changes don't kill retained mature trees. X ❑ I. Protect the trees from excessive heat, i.e., equipment, paving and /or burning. M ❑ g. Avoid trenching through the root systems, boring under them or hand digging can save roots. ❑ h. Contact the ISA Certified Arborist familiar with the site prior to and during any activity within the drip zone or tree protection fencing for consultation. III. After Construction: X ❑ a. Carefully landscape the area under the tree, being careful of the roots and structure. Use plantings that will live under the same conditions as that of the tree. tX ❑ b. Provide insect and disease control, fertilization and pruning as needed or adhere to long -term protection plan if provided. X ❑ c. Avoid direct irrigation spraying onto the trunk. The amount of irrigation needed to keep new plantings alive can often be enough to kill mature trees. X ❑ d. Do not cover existing root systems with more than 2" of soil. The more soil you add, the greater the chances of damaging the root system. X ❑ e. Provide irrigation and /or drainage to emulate pre- construction conditions. NOTE: This tree protection plan identifies construction protection measures to prevent unwarranted tree loss. The identified measures limit the amount of earth disturbance surrounding the trees, and limit the removal of the tree's root systems. Due to the variation of every project, it is unlikely all of the above identified measures can be practicably applied to each individual tree; nor is it likely each measure is necessary to retain each tree. This building will re lace a residence that was used for storage previously and ry then demolished in February of 2002 (BUP2000- 00049). The new building will be in the same location as the original building and will be approximately 295 square feet smaller. The construction area is in a small grove of trees. The new building, which was identified in the 2003 Summerlake Park Mater Plan, will be used for winter storage of park equipment. It will be a pole building with four roll up doors and 2 access doors. No trees will be removed for construction of the building. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Conditional Use application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The prior use approved for this site is Community Recreation. The use is not proposed to change. 2. A 10% increase in dwelling unit density; The site is not developed with a residential use; therefore, this criterion is not applicable. 3. A change in the type and /or location of access ways and parking areas where off -site traffic would be affected; The proposed building is within the interior of the park, away from access points and parking areas. There are no changes proposed to the accessway or parking areas, and off -site traffic will not be affected by the construction of the storage building. This standard is met. An increase in the floor area proposed for non - residential use by more than 10% where previously specified; The request is to reconstruct a storage building to replace a larger residence previously used for storage. The area will decrease by 295 square feet. The proposed building is 1,800 square feet; whereas the previous building was 2,095 square feet. Therefore, this standard is met. 5. A reduction of more than 10% of the area reserved for common open space and /or usable open space; Summerlake Park is approximately 26 acres. The proposed 1,800 square -foot building will replace a previously existing building with a larger footprint. The open space area of Summerlake Park will not be reduced by more than 10 %; therefore this criterion is met. 6. A reduction of specified setback requirements by more than 20 %; The applicant is not asking for a reduction of setbacks. This standard is not applicable. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions;. The new storage building is proposed within the same location as a previously existing residence. As noted in #5 above, the park is made up of almost 26 acres of land. The construction of an 1,800 square -foot building will not eliminate landscaping or recreational facilities by more than 10 %. 8. A 10% increase in the approved density; The proposed modification request does not involve residential development; therefore, no increase to density is involved in the request. Tigard Municipal Code 9.06 — Trees on City Property Section 9.06.050 requires that trees on City property be protected by following the guidelines within the Tree Manual. These requirements shall provide for the proper protection of tree roots, trunk(s) (or stem(s)), branches, and foliage within a tree's critical root zone for any tree on City property during any type of construction activity or project (excavation, demolition or any other type of disturbance). Because Summerlake Park is a City property, the requirements of the Tigard Municipal Code (TMC) Chapter 9.06 (Trees on City Property) apply. This code section addresses the protection, removal, and planting of trees on City property. The applicant's proposal does not include removal or planting of trees, therefore only protection of existing trees is relevant. As noted within the City Arborist's comments, the applicant has not provided a tree plan or shown how the requirements of TMC 9.06 are satisfied. A condition of approval has been imposed to ensure the trees are protected. Conclusion This request is determined to be a minor modification to an existing site.
