Dear Mr. Young:
This letter is in response to your request for Minor Modification (MMD2000-00016) approval to
increase the height of a recently approved Wireless Communication Monopole in the City Tigard.
The City approved Sprint's application for a Site Development Review (SDR1999-00012) to
construct a 60-foot high monopole to provide wireless communication service to the Washington
Square Mall and surrounding vicinity. SDS Wireless is seeking approval to increase the height by
15 feet for a total of 75 feet.
This property is designated as general commercial within the C-G zoning district. The use of
the site is listed as a permitted use for this zoning district. The Tigard Community Development
Code, Site Development Review Section, states; "if the requested modification meets any of the
major modification criteria, that the request shall be reviewed as a new Site Development Review
application."
Section 18.360.050.B. states that the Director shall determine that a major modification(s) has
resulted if one (1) or more of the changes listed below have been proposed:
1. An increase in dwelling unit density or lot coverage for residential development.
Sprint's proposed use does not involve a residential development; therefore, this
standard does not apply.
2. A change in the ratio or number of different types of dwelling units. Sprint's
proposed use does not involve a residential development; therefore, this standard does
not apply.
3. A change that requires additional on-site parking in accordance with Chapter
18.765. The site is a Wireless Communication Tower. The only parking required is for
one service vehicle. The minor modification is for a height adjustment. Therefore, this
criterion does not apply.
4. A change in the type of commercial or industrial structures as defined by the
Uniform Building Code. No commercial or industrial structures are associated with this
application. Therefore, this standard does not apply.
5. An increase in the height of the building(s) by more than 20 percent. There are no
buildings associated with this application. Therefore, this criterion does not apply.
6. A change in the type and location of accessways and parking areas where off-site
traffic would be affected. This request will not require a change in accessways or
parking areas where off-site traffic would be affected. Therefore, this criterion does not
apply.

7. An increase in vehicular traffic to and from the site and the increase can be
expected to exceed 100 vehicles per day. No change in traffic to and from the site can
be expected. The proposed modification will be used to increase the height of the
monopole. Therefore, this standard does not apply.
8. An increase in the floor areas proposed for a non-residential use by more than ten
percent excluding expansions under 5,000 square feet. This request is for a height
modification not square footage. Therefore, this criterion does not apply.
9. A reduction in the area reserved for common open space and/or usable open
space that reduces the open space area below the minimum required by the code
or reduces the open space areas by more than ten percent. There is no area
reserved for common open space, therefore, the criteria does not apply to the proposal.
10. A reduction of project amenities (recreational facilities, screening; and/or,
landscaping provisions) below the minimum established by the code or by more
than ten percent where specified in the site plan. The increase in the height of the
approved monopole will not result in modifications to project amenities.
11. A modification to the conditions imposed at the time of Site Development Review
approval that is not the subject of criteria (B). 1 through 10 above. The proposal to
increase the height of the monopole by 15 feet would not result in a modification to the
conditions imposed at time of Site Development review approval.
This request is determined to be a minor modification to an existing site. The Director's designee
has determined that the proposed minor modification of this existing site will continue to promote
the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding
properties provided that, development which occurs after this decision complies with all applicable
local, state, and federal laws.

On behalf of Sprint PCS, we are submitting the following Minor Modification Application to
increase the height of a recently approved wireless communication monopole in the City of
Tigard. The City of Tigard approved Sprint's application for a Site Development Review
(SDR1999-00012) to construct a 60-foot high monopole to provide wireless communication
service the Washington Square Mall and surrounding vicinity.
Upon further review, Sprint's Radio Frequency (RF) engineers realized that the proposed 60-foot
monopole would not allow their system to function properly, and an additional 15-feet is
necessary to meet their coverage objectives.
Please find enclosed the following application materials for a Minor Modification Type I
Application.

Section 18.360.505 - (B) MINOR MODIFICATION CODE CRITERIA
1. An increase in dwelling unit density or lot coverage for residential development.
Sprint's proposed use does not involve a residential development, therefore, this standard does
not apply.
2. A change in the ratio or number of different types of dwelling units.
Sprint's proposed use does not involve a residential development, therefore, this standard does
not apply.
3. A change that requires additional on-site parking in accordance with Chapter 18.765.
The proposed use does not require any parking, or any additional on-site parking. Sprint's
proposed use is an unmanned facility. A Sprint technician would visit the site approximately
once per month for maintenance purposes only. Washington Square Mall has sufficient parking
on-site, and Sprint's proposed use would not remove any parking spaces.
4. A change in the type of commercial or industrial structures as defined by the Uniform
Building Code.
Sprint's proposed use does include any commercial or industrial structure, therefore, this criteria
is not applicable. Sprint proposes to increase the height of the recently approved monopole tower
by 15-feet. There would be no change to the existing commercial structures of Washington
Square Mall.
5. An increase in the height of the building(s) by more than 20 percent.
No increase in the height of any existing building is proposed. Sprint's proposed use does not
include any building or structure. Only the height of the proposed monopole tower would be
increased by 15 additional feet for a total height of 75 feet. In the C-G zone, towers for multiple
carriers are permitted up to a height of 125 feet and towers for a single carrier are permitted up to
a height of 100 feet (Section 18.798.050 B.4).
6. A change in the type and location of accessways and parking areas where off-site traffic
would be affected.
The proposed use would not require a change in accessways or parking areas where off-site
traffic would be affected.
7. An increase in vehicular traffic to and from the site and the increase can be expected to
exceed 100 vehicles per day.
The proposed use would have no impact on vehicular traffic to and from the site. Sprint's
proposed use is an unmanned facility. A Sprint technician would visit the site approximately
once per month for maintenance purposes only.

PPR WASHINGTON SQUARE LLC
THIS LIMITED LIABILITY COMPANY AGREEMENT (this
"Agreement"), is made and entered into as of February 8th, 1999, by Pacific Premier Retail
Trust, a Maryland real estate investment trust (the "Member").
The Member desires to form a limited liability company pursuant to the laws of
the State of Delaware_ Accordingly, the Member agrees as follows:
1. l;orm_ation. The Member has formed a limited liability company (the "Company")
pursuant to the provisions of the Delaware Limited Liability Company Act (the "Act") and
subject to the terms,provisions and conditions set forth in this Agreement.
2. Filing. In connection with the formation of the Company, James H. Kinney, an
authorized person (the "Organizer"), has caused a Certificate of Formation that complies with
the requirements of the Act to be properly filed with the Delaware Secretary of State_ The
Member hereby ratifies and confirms the filing of the Company's Certificate of Formation and
agrees to hold harmless the Organizer from any liability incurred in connection with such filing.
3. Name. The name of the Company shall be"PPR Washington Square LLC."
4. Purpose. The purpose of the Company is to engage in any lawful activity for which a
limited liability company may be organized under the Act.
5. Management. The Company shall be member-managed. All decisions to be made on
behalf of the Company, and all actions to be taken on behalf of the Company, shall be made or
taken solely by the Member. The Member shall have the sole and exclusive authority and right to
approve, execute and deliver documents (including property acquisition and loan documents) on
behalf of the Company. The Company shall not have any officers or"managers" (as defined in
the Act). No member meetings shall be required.
6. Events Giving Rise to Djuolutiog. The Company shall dissolve upon the first to occur
of the following, and upon no other event or occurrence:
A. the election by the Member to dissolve the Company; and
B. the entry of a decree of judicial dissolution under the Act.

10. Governing Law: Jurisdiction. This Agreement and the nghts of the parties hereunder
