MMD2000 - 00023 REMBOLD PROPERTIES - TIGARD TRIANGLE October 2, 2000 CITY OF TIGARD Loy Rusch MCM Architects OREGON 1022 SW Salmon St., Suite 350 Portland, OR 97205 Dear Mr. Rusch: This letter is in response to your request for Minor Modification (MMD2000-00023) approval to construct a small one-story receiving shed in the paved service yard at the north end (rear) of the building. It is our understanding that you wish to construct this structure to provide a secured location in which to receive merchandise before moving the products to locations within the store. The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal will add an approximately 600 square foot receiving shed which will house materials that have been delivered to the site and not moved onto the floor yet. Because the shed will not result in an increase in sales area, no additional trips will be generated and no additional on-site parking would be necessary. In any event, the site has adequate parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the building is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. No change in the height of the building is proposed, therefore, this standard is not applicable. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. The location is in the rear where trucks will deliver materials to the store. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification will not generate additional vehicle trips. Therefore, this criterion does not apply. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal will only add an additional 600 square feet to the site. Therefore, this standard does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The modification will not affect landscaping or open space, therefore, this standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The additional receiving shed will not affect project amenities. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The modification will not impact any of the conditions of approval. In addition, the proposed structure design is in conformance with the Tigard Triangle Design Standards because it will be constructed of similar materials as the remainder of the building and is in alignment with the east face of the Poppy Box garden buildings. THIS REQUEST HAS BEEN APPROVED. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DIVISION. The job superintendent, Gary Lundervold has probably already called you to set up your review. However, I wanted to give you an overview of the outstanding issues in advance of your visit to make your effort easier and allow you to request any clarifications of me prior to the final review. We are hoping you can visit the site in the next day or so in order to obtain the sign-off and move the TCO forward. When I spoke to you last week at City Hall, I mentioned that the stair from in front of the Poppybox store up to 72nd was proving to be more complex than expected given the problems we encountered with the stability of the rock and keystone walls along the eastern boundary of the project. Our solution to the problem has been to change the stair from a poured in place concrete stair requiring extensive excavation to a steel stair that can be lifted in to place with minimal excavation required. This stair is taking longer to build than we had hoped. We anticipate it being in place prior to the end of November prior to requesting the Final Certificate of Occupancy. In the interim, we can provide a letter from the Owner, General Contractor and Fabricator, if necessary to provide proof that the stair is in process. I have reviewed the original approval drawings for our Site Development Review to identify any other items that might be a part of your review. I do not find anything else that has not been addressed at this time. One item, not covered as art condition of completion that I want to mention in case it is a question is the security fencing along 72nd. Currently a 4'6" green steel fence extends along a portion of 72`d to discourage people from walking on to the site from the east where the steep drop off could be a problem. Our plan, as shown on the approved Construction Documents is to add fencing to protect the entire length of 72" except where the new stair extends. This fencing is due to arrive via special delivery today and be installed on Wednesday and Thursday. Again, I don't believe this was a condition of approval, but I wanted to let you know what is happening with it in case the question arose. Compliance With Other Zoning Regulations: Building Setback: The proposed receiving shed will align with the approved location for the east face of the PoppyBox Gardens building, placing its east face 28'-1" from the SW 72nd Avenue right- of-way. Building Height: The receiving shed will be ± 13'-6"high,measured to the ridge. Maximum allowable height by zoning is 45', and 24'by the CC&R's for the overall development. Exterior Materials: The receiving shed has the same exterior wall material as on the approved PoppyBox Gardens building;plywood siding with vertical battens. The roof is composition shingles. Parking: The approved parking layout is not affected by the receiving shed.
