The business would consist of a production nanobrewery that would occupy approximately 400 square feet of an existing, detached garage and would allow one outside employee to visit the property. No external changes are proposed as part of the application. COMPREHENSIVE PLAN DESIGNATION: Low-Density Residential. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.742.040-060 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions of approval. The findings and conclusions on which the decision is based are discussed in Section V. Customers, clients, and employees may not park in the public right of way. All parking shall be accommodated on-site. 2. No more than one commercially licensed vehicle of not more than three-quarters ton capacity may be parked outside of the accessory structure or screened yard and parking area at any time, and may not be parked in the public right of way. The applicant shall obtain and annually renew a City of Tigard business license and any and all State and Federal approvals,permits,and licenses. SECTION III. BACKGROUND INFORMATION & PROJECT DESCRIPTION The project site is located at 9795 SW Murdock Street, a flag lot at the intersection of 98th Avenue and Murdock Street. The property is 17,286 square feet in size and contains a single-family home built in 1936 and a detached garage of unknown age. The site is surrounded by single family homes on three sides and a vacant lot on the fourth. The two structures are connected by an approximately 3,000 square foot parking pad, connected to Murdock Street by an approximately 80 foot long private driveway. The house is generally not visible from the public street due to a six foot tall wooden fence around the perimeter of the property. The owner of the property presently brews beer in his home for noncommercial purposes, with a nonresident friend, as allowed by Oregon homebrew rules and statutes. This application for a Type II Home Occupation would permit the same owner and non-resident partner to brew the same beer for commercial purposes through Red Ox Brewing (provided all state and federal approvals are granted). All brewing activities will be contained in a 20'by 20' section of the garage. Cooling water will be captured for reuse or disposed of in the yard area. Garbage and spent grain will be disposed of as part of normal household garbage and recycling pickup. No retail operations are proposed, with the owners relying upon website traffic and distribution to off-site taprooms,restaurants, and other venues to sell their product. SECTION IV. PUBLIC COMMENTS RECEIVED The city mailed notice to property owners within 500 feet of the subject site, providing them an opportunity to comment. The city received seven written responses,which are summarized-below: Robert Odell of 14850 SW 100th Street submitted a letter stating opposition for the proposal. The basis for the opposition were concerns about (1) the impacts of three existing home occupations, including an auto repair business on Saltier between 98th and 1001; (2) enforcement of the limit on employees;and(3) traffic impacts. Carol Glenn of 9870 SW Inez wrote a letter of opposition to the proposal. No reason was given. Glenn and Peggy Case or 9845 SW Murdock street wrote a letter with three comments pertaining to odors,parking,and screening. Carol Endicott of 9585 SW Murdock Street wrote a letter supporting the proposal, stating one additional car in the neighborhood would not impact traffic. Duane Pond of 9885 SW Pembrook Street submitted a neutral letter with a list of 9 questions/concerns that the city should consider and communicate to the neighborhood. Don Ramaeker of 9655 SW Murdock submitted a letter opposing the proposal. The basis for the opposition was proximity to two public schools and impacts on property values. HOP2013-00039 RED OX BREWING HOME OCCUPATION PERMIT PAGE 2 OF 8 Nora Lowery submitted an email after the close of the public comment period. The email expressed opposition to the proposal due to parking impacts related to private parties at the applicant's home, traffic impacts,proximity to public schools,and unspecified environmental impacts. As stated above,opposition to the project was on the following issues: 1. Inappropriateness of a business within a residential zone; 2. Environmental impacts,principally odors; 3. Tripp Generation; 4. Parking Impacts; 5. Hours of operation;and 6. Screening of materials,goods,and equipment. Because Chapter 18.742 of the Tigard Development Code allows home-occupations to be conducted within certain parameters, a general opposition to a business operation within a residential zone is not sufficient grounds for denial of a project. Staff has examined the remainder of the issues in Section V below, and found the project to be in compliance with relevant approval criteria and standards. Conditions of approval set forth in Section II above are being imposed as part of the decision to ensure the operation remains in compliance. SECTION V. APPLICABLE REVIEW CRITERIA& FINDINGS As set forth in Table 18.510.1 of the Tigard Development Code, home occupations are an allowed land use in all residential zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home Occupations). Relevant standards and approval criteria are addressed below. 18.742.040 General Approval Criteria A. General criteria.All home occupations except those that have proven nonconforming. status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 1. Home occupations may be undertaken only by the principal occupant(s) of a residential property." The proposed Home Occupation is being undertaken by one of the property owners (Matthew Shelby),who is a principal occupant of the property. This standard is met. "2.There shall be no more than three deliveries per week to the residence by suppliers." The application states that they do not anticipate needing more than three deliveries per week. This standard is met. "3. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards." The application states no offensive noise, vibration, smoke, dust, or odors are anticipated based on previous experience with brewing on the site. All proposed activities will take place within the detached garage which will mitigate the potential for other nuisances such as noise, smoke, dust, heat, and glare. No deliveries or customer visits will occur between 10pm and 8am. The immediate neighbors to the west, Glenn and Peggy Case of 9845 SW Murdock Street, submitted a letter on September 19 in which they complained about unpleasant odors periodically from the brewing,and also a nuisance caused by flies. The applicant has responded to the letter by stating he has discussed the issue with Peggy Case to identify the particular stage of brewing they may find offensive in order to identify mitigation measures suitable to both parties. The applicant also states the association of flies with the odor suggests the smell is of the spent grain being transferred to the recycling bins. The applicant has also identified mitigation measures such as transferring the spent grain to the yard waste recycling bin within the interior of the project site, in-lieu of the current practice of transferring the waste in the detached garage which sits near the property line. Should these mitigation measures not be sufficient, the permit is subject to revocation for offensive activities not compatible with a residential neighborhood (TDC 18.742.070.A.2.c). This standard is HOP2013-00039 RED OX BREWING HOME OCCUPATION PERMIT PAGE 3 OF 8 met. "4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire,health and housing codes." The application states that the business will be conducted within a 400 square foot section of the existing detached garage on the project site. Waste generated by the business will be disposed of as part of normal household garbage and recycling. Washington County Assessor's records show this property containing 1,762 square feet of living space. Plans provided by the applicant show the detached garage to be approximately 600 square feet in size,with 400 square feet devoted to Red Ox Brewing, or 16% of the total combined square footage of the residence and detached garage. This standard is met. "5. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.144 of this title." No changes to the use classification of the dwelling are proposed, and none are required by the Tigard Building Official at this time. However, any and all structural, mechanical, electrical, or plumbing modifications or additions should be reviewed and approved through the Tigard Building Division, where applicable. A condition of approval has been added in Section II of this report to ensure compliance with this standard. As conditioned,this standard is met. "6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates." There are no other Home Occupations approved or requested for this site, therefore, this standard is not applicable. "7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use." The applicant does not propose spray painting or spray finishing operations. On September 25, 2013, Tualatin Valley Fire and Rescue provided written comments stating they had no objections to the proposal. The comments did state the applicant was required to report any and all hazardous material to the Oregon State Fire Marshall's Office pursuant to the Oregon Community Right to Know Act. A condition of approval has been added in Section II of this decision to ensure compliance with this requirement, and any other requirements of Tualatin Valley Fire&Rescue. As conditioned, this standard is met. "8. No home occupation shall require any on or off-street parking other than that normally required for a residence." The project will not require any additional parking than is already provided for this single-family detached residential land use. Table 18.765.2 of the Tigard Development Code requires a minimum of one off-street parking space per single-family attached home, no maximum is established. The project site is a flag lot with substantial parking on site. The three bay detached-garage will continue to have one stall available for use by a motor vehicle. In addition, there is an approximately 3,000 square foot parking pad accessed by an 80 foot long private driveway that will remain available for use by the occupants or any employees and visitors. Multiple letters were received from nearby property owners expressing concern for the availability of on- HOP2013-00039 RED OX BREWING HOME OCCUPATION PERMIT PAGE 4 OF 8 street parking and its loss as a result of the proposed home occupation. A condition of approval has been attached that prohibits the use of the public right of way by employees and visitors to Red Ox Brewing to avoid a loss of on-street parking available to other residents in the vicinity. As conditioned, this standard is met. "9.The following uses are not allowed as home occupations: a.Auto-body repair and painting. b. Ongoing mechanical repair conducted outside of an entirely enclosed building. c.Junk and salvage operations. d. Storage and/or sale of fireworks." The proposed Home Occupation does not involve any of the above land uses. This criterion is met. "10. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area." As stated in the application, the beer brewed on-site will be self-distributed by the application. No information was included about the vehicle that will be used to deliver the product. A condition of approval is being added to ensure compliance with this standard. As conditioned, this standard is met. 18.742.050 Type I and Type II Home Occupations Defined A. Type I and II home occupations defined. Home occupations shall be administered as either Type I or Type II uses.A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040,home occupations shall observe the following additional standards: 2. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises. Therefore the following is allowed for Type II home occupations: "a. One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window;" The application does not propose a sign. This standard does not apply. "b. No more than one outside volunteer or employee who is not a principal resident of the premises;" The application states that one employee will be present, primarily on weekends. There is no evidence suggesting that more than one employee may be present at any time, as was expressed in one comment letter. This standard is met. "c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking;" The application states the brewery operations will be primarily restricted to weekends, as both the homeowner and the outside employee have primary day jobs outside of the home occupation. Anticipated operating hours will be 8am to 4pm. As discussed above, there is ample on-site parking and a condition of approval has been added that requires all employees, customers, and business vehicles to park on-site and not in the public right of way, and not between the hours of 10pm and 8am. With one employee only visiting on weekends, no more than three deliveries of materials per week, and no more than six customers a day allowed by code, excessive traffic will not be generated. Moreover, the applicant has requested approval of a production brewery, and will not be selling beer for consumption on- site. As such the number of expected visits by potential customers is low. A condition of approval has been added that prohibits retail sales to ensure compliance with this standard. This standard is met. HOP2013-00039 RED OX BREWING HOME OCCUPATION PERMIT PAGE 5 OF 8 "d. Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback." The applicant has not proposed any outdoor storage of materials. Waste associated with the home occupation will be disposed of with normal household garbage and recycling. This standard does not apply. 18.742.060 Permit Procedures for Type I and Type II Home Occupations B. Type II home occupation permit. A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As discussed above and below in this report, the application is consistent with the standards of this chapter, or will be consistent with conditions of approval. This criterion is met. 2. Will be subordinate to the residential use of the property; and As discussed above, the home occupation will be subordinate to the residential use of the property. The home occupation will be primarily conducted on weekends, and will only occupy 400 square feet of the detached garage, or approximately 16% of the total square footage of all structures on the property. This criterion is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. As discussed above and below, and as conditioned in Section II of this report, the home occupation shall not be detrimental nor disruptive in terms of appearance or operation. This criterion is met. C. Conditions of approval. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; As discussed above, condition of approval has been added that prohibits customers, clients, and employees from parking in the public right of way,in compliance with this provision. 13. Limiting the type and number of vehicles or equipment to be parked or stored on the site; and As discussed above, a condition of approval limits the type, number, and location of commercial vehicles to be parked and stored on the property, in compliance with this provision. 14. Any other limitations which the Director considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.745.040 and 18.742.050. As discussed above, conditions of approval have been added to ensure any improvements to the detached garage or property are in compliance with all building division requirements; that no retail operations occur in order to limit traffic and noise impacts to neighboring residents; and that all operations comply with state and federal requirements for brewing. FINDING: As discussed in the analysis above, the proposal meets, or can meet with conditions of approval, all standards and approval criteria pertaining to Type II Home Occupations. OTHER STAFF COMMENTS The Tigard Police Department, Building Division, and Development Engineering Division had no objections to the proposal. SECTION VII. AGENCY COMMENTS Clean Water Services had no concerns or objections to the application. On September 25, 2013, Tualatin Valley Fire and Rescue provided written comments stating they had no objections to the proposal. The comments did state the applicant was required to report any and all hazardous material to the Oregon State Fire Marshall's Office pursuant to the Oregon Community Right to Know Act. A condition of approval has been added in Section II of this decision to ensure compliance with this requirement,and any other requirements of Tualatin Valley Fire&Rescue. SECTION VIII. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the Notice of Decision was mailed. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. He already throws several large parties each year. He has a huge white tent set up for these parties and there is very limited parking available. Our streets have no space for parked cars and thus cars parked here force bikers and pedestrians into the street, and most cars have to take turns to go down the street. This is a residential area with a grade school and a middle school less than a block away. A brewery that invites traffic would have a very negative impact on our neighborhood. I don't even know about the environmental impact of such a business. There are already enough things that eat away at our home values we don't need to allow this. Please do not allow this. As a production facility, I will not have a retail-facing storefront. Rather, my business partner and I plan to self-distribute the beer we produce to bars and restaurants in the area. The ultimate goal is to grow out of my garage and into a space that allows for direct sales in the Tigard area— preferably in the downtown area. Red Ox Brewing got its start when my friend Adam brought a keg of beer he had made to a Fourth-of- July party I hosted. The beer was a hit and we got to talking. He liked to make beer, but lived in a basement apartment. I wanted to brew and had the space to do it. Since then, we've been brewing and sharing our creations with friends and family. Last summer we began the licensing process with the goal of selling the beer we've been giving away. We received our federal approval this spring and are now embarking on state and local approval. Following the City of Tigard's approval—hopefully—we will begin the licensing process with OLCC. The Brewery Our brewery consists of three 55-gallon stainless steel drums. We are using propane burners to heat the water needed to produce the beer. Our only byproducts are water,yeast and spent grain. We ferment our beer in 55 gallon, food-grade, plastic drums. Once ready, we keg our beer onsite. Everything needed to follow the process from grain to glass fits inside a 20x20 section of my detached garage. Since we both have day jobs, we brew on weekends. We typically work from 8 a.m. -4 p.m. City Code Our proposal aligns well with city code 18.742.040. I am the principal resident. We do not anticipate more than three deliveries per week and our brewing does not produce excessive noise, odor, parking, etc...We capture our cooling water for future use. Any excess goes towards watering my nearly half-acre lot. I'm not proposing any major changes to the garage structure. Here are several possible questions or concerns that I would think should be considered before approval. 1) What specifically is a"Nanobrewery"?Volume per ninth? Kegs? Bottles?Etc,etc. 2) At this location, will it only be/stay a Nanobrewery? As a production facility, I will not have a retail-facing storefront. Rather, my business partner and I plan to self-distribute the beer we produce to bars and restaurants in the area. The ultimate goal is to grow out of my garage and into a space that allows for direct sales in the Tigard area — preferably in the downtown area. Red Ox Brewing got its start when my friend Adam brought a keg of beer he had made to a Fourth-of- July party I hosted.The beer was a hit and we got to talking. He liked to make beer, but lived in a basement apartment. I wanted to brew and had the space to do it. Since then, we've been brewing and sharing our creations with friends and family. Last summer we began the licensing process with the goal of selling the beer we've been giving away. We received our federal approval this spring and are now embarking on state and local approval. Following the City of Tigard's approval—hopefully—we will begin the licensing process with OLCC. The Brewery Our brewery consists of three 55-gallon stainless steel drums.We are using propane burners to heat the water needed to produce the beer. Our only byproducts are water, yeast and spent grain. We ferment our beer in 55 gallon,food-grade, plastic drums. Once ready, we keg our beer onsite. Everything needed to follow the process from grain to glass fits inside a 20x20 section of my detached garage. Since we both have day jobs, we brew on weekends. We typically work from 8 a.m. -4 p.m. City Code Our proposal aligns well with city code 18.742.040. I am the principal resident. We do not anticipate more than three deliveries per week and our brewing does not produce excessive noise, odor, parking, etc...We capture our cooling water for future use. Any excess goes towards watering my nearly half-acre lot. I'm not proposing any major changes to the garage structure. In fact, with the garage door closed, no one would ever know a brewery existed on the property. With rare exception, we don't expect customers to come by the property. Our storefront is our website. Since Adam is joining me in this project, and he does not live at my house, we are working through the Type II review. Since moving into the home, we have welcomed two daughters into our lives and built a solid foundation in Tigard. We have every intention of staying in Tigard —and in our house— until our children are grown. One of the many things we love about our house is the large, private lot. Another is the large detached garage. About a year and a half ago, my friend Adam Amato brought a keg of beer he made to a Fourth of July party I hosted. It was well received and it got us talking. He'd been brewing in his basement apartment for some time. I had a detached garage I wasn't taking full advantage of. And so began Red Ox Brewing. Since then, Adam and I have been home brewing in my garage and sharing our creations with friends and family. About a year ago, we began the process of licensing our brewery so we could actually sell the beer we make. Our brewery operation has been approved at the federal level and now we're seeking local approval. Proposal: Two of the things we love about our house —the lot and the garage — make our residence a good place to start a small production brewery. We're proposing a 55 gallon brewing setup capable of yielding about 1.5 barrels at a time. We would market our beer primarily to local establishments in Tigard and the surrounding area. We would not be open to the general public and would not have regular deliveries. Our website would serve as our storefront. Basically, our operation would consist of two friends sitting in a detached garage watching water boil. F yvea s All of the required equipment fits into 2131ef my garage. The garage, and any beer, is secured when not in use. Cooling water is captured for future use; with any excess going straight to watering my nearly half acre yard. Our by-products, (grain, hops and yeast) are disposed of through curbside yard debris. Nobody's quitting their day job for this project just yet. However, if we are successful, we would expand into a commercial location in Tigard. Questions we would like answers to: From my research, it appears that a small production brewery is possible under Tigard city code governing home occupations, but I'd like to confirm that. In addition, since Adam does not live at the residence, I believe approval requires a Type II review. We're more than willing to engage our neighbors in that discussion — actually we already have. There are perks to having neighbors who brew good beer. Conclusion: In reality, we are not seeking to do much more than we are right now. It's the act of selling our beer that's requiring us to apply for the license. I love my neighborhood and am as interested as any of my neighbors in maintaining its quiet charm. Permitted under City authority prior to 1983 and have since been in continuous operation. B. Governing regulations.Nonconforming home occupations will be regulated as a nonconforming situation, per the following: 1. A nonconforming situation is further governed by Chapter 18.760,Nonconforming Situations.Such use may continue until the use is expanded or altered so as to increase the level of noncompliance with this title; 2. The burden of proving a home occupation's nonconforming status rests with the property owner or tenant. C. Violations.Home occupations without City or County approval which cannot prove nonconforming status shall be considered in violation of this chapter and shall cease until the appropriate approvals have been granted. 18.742.040 General Approval Criteria and Standards A. General criteria.All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 1. Home occupations may be undertaken only by the principal occupant(s)of a residential property. 2. There shall be no more than three deliveries per week to the residence by suppliers. 3. There shall be no offensive noise,vibration,smoke,dust,odors,heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725,Environmental Performance Standards. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet.Otherwise,the home occupation and associated storage of materials and products shall not occupy more than 25%of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet.The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building,fire, health and housing codes. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit.Any accessory building that is used must meet State Building Code requirements. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates. Home Occupations 18.742-2 Code Update:10/09 1 . 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants,and/or surrounding properties.Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c. Junk and salvage operations; d. Storage and/or sale of fireworks. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight(GVW)may be parked outside of a structure or screened area. (Ord. 09-13) 18.742.050 Type 1 and Type II Home Occupations Defined A. Type I and I I home occupations defined.Home occupations shall be administered as either Type I or Type II uses. A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 1. Type I home occupations. The following characteristics of a Type I home occupation shall be prohibited: a. Outside volunteers or employees to be engaged in the business activity other than the persons principally residing on the premises; b. Exterior signs which identifies the property as a business location; c. Clients or customers to visit the premises for any reason; d. Exterior storage of materials. 2. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises.Therefore the following is allowed for Type 11 home occupations: a. One non-illuminated sign,not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; b. Type I home occupation permit.A Type I home occupation permit will be processed by means of a Type I procedure,as governed by Section 18.390.030,after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.1. Type II home occupation permit.A Type II home occupation permit will be processed by means of a Type II procedure,as governed by Section 18.390.040,after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and 2. Will be subordinate to the residential use of the property;and 3. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to,the following: 1. Further limiting the hours,days,place and manner of operation; 2. Requiring site and building design features which minimize environmental impacts such as noise, vibration, air pollution, glare,odor and dust; 3. Requiring additional building setbacks, and increased lot area, depth or width; 4. I had an over-the-fence conversation with Peggy about this last week. I'll try to address the identified issues below: As far as parking goes,we don't anticipate many customers coming to the brewery. If they did,our large driveway would provide ample off street parking. I don't see replacement of the fence as an issue as any brewery-associated materials are stored inside my garage. In addition, if the fence were replaced with chain-link I would build a wood fence on my side of the property line.(That has more to do with the view from my front window than any Red Ox Brewing need.) I need to work with Peggy to help me narrow the source of the smell she doesn't like. I tried to tease it out of her last week, but she couldn't describe it. I think it may be the yard debris bins that are wheeled close to the property line when we are adding the spent grain and yeast. If that's the case, it should be an easy fix. We can simply wheel the spent grain over to where the yard debris bins normally are, instead of wheeling the bins over the the garage. I told Peggy I'd let her know the next time we planned to brew so she could help us identify any smell she didn't like. I'll let you know how that turns out.
