OREGON 21500 Haggerty Road, Suite 100 Northville, MI 48167 RE: Approval for Minor Modification to Tigard Marketplace Renovations (MMD2001-00015) Dear Mr. Potterf: This Letter is in response to your request for Minor Modification approval to modify your approved plans for the Tigard Marketplace Renovations (SDR2000-00005), to be constructed at 13400-13580 S.W. Pacific Highway, WCTM 2S102CC, Tax lots 1O@0, 5t) and KFI-. Your proposal is to reduce the height to the tower elements associated with the Haggen's Grocery store approved during Site Development Review. The property is zoned C-G, General Commercial. The use of the site is listed as a permitted use for this zoning district. The Tigard Community Development Code, Site Development Review Section, states "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.360.050.B states that the Director shall determine that a major modification(s) has resulted if one (1)or more of the changes listed below have been proposed: 1. An increase in dwelling unit density of lot coverage for residential development. The proposal does not involved residential property. Therefore, this standard does not apply. 2. A change is the ration or number of different types of dwelling units. This proposal does not involve residential property. Therefore, this standard does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal does not involve any additional parking. Therefore, this standard does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniformed Building Code. No change is the structural occupancy type of the existing building is proposed. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 percent. The proposal requests a reduction of the approved height not an increase. Therefore, the standard does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The modification does not involve a change in type or location of accessways or parking area. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The modification does not involve an increase in vehicular traffic. Therefore, the standard does not apply. 8. An increase in the floor areas proposed for non-residential use by more than ten percent excluding expansions under 5000 square feet. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The modification does not involve a reduction in open space. Therefore, the standard does not apply. 10. A reduction of project amenities (recreational facilities, screening, and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The modification does not involve a reduction of project amenities. Therefore, the standard does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. Based on the preceding analysis, staff finds the proposed modification is a minor modification because of the applicability of the above criteria. 18.360.060.0 A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the finding that: 1. The proposed development is in compliance with all applicable requirements of this title. The following analysis assesses compliance with all applicable code criteria: 18.730.020(A) - EXCEPTIONS TO BUILDING HEIGHT LIMITATIONS states that projections such as chimneys, spires, domes, elevator shaft housing, towers excluding TV dish receivers, aerials, flag poles, and other similar objects not used for human occupancy, are not subject to the building height limitations of this title. Applicant has submitted revised plans for the tower elements to Tigard Marketplace. Applicant requests a modification to decrease the west/south elevation end tower to 34'6", decrease the west elevation @ retail building to approx. 23' and increase west elevation (small tower)to 23'6". Based on above reference standard, Staff finds that the proposed modification will comply with all applicable requirements of the Tigard Development Code. THIS REQUEST HAS BEEN APPROVED. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. This request is determined to be a minor modification to an existing site with approval through the Site Development Review (SDR2000-00005)and is therefore, approved. The height of ~ the east elevation is 26 feet, 6 inches (26'-6"). As the maximum building height requirement is 45 feet and the highest point of the structures on the site (the towers), measured from the average height of the highest gable of a pitched or hipped roof in accordance with the definition for building height under Chapter 18,120, do not exceed 45 feet, this standard is met. FINDING: The applicant's plans indicate that all minimum setback standards will be met, the lot width exceeds the minimum 50-foot width, no building or structure exceeds the minimum building height, the minimum landscape coverage of 15% is met, and the l proposed site coverage does not exceed the maximum of 85% site coverage allowed. Therefore, this standard is met. B. SPECIFIC DEVELOPMENT STANDARDS: CHAPTER 18.700 Site Development Review Approval Standards: Chapter 18.360 is applicable to all new developments and major modifications of existing developments.
