You have requested to install antennae on an existing structure. These antennae and supporting equipment will be 44 feet tall, which is 19.5' above the reference building height, and 15 feet above the building ridgeline. Chapter 18.798 (Wireless Communication Facilities) of the Tigard Development Code specifies that collocation of antenna(s) on existing non-tower structure in commercial and industrial zones is an outright permitted use provided: Installing an antenna(s) on an existing structure other than a tower, such as a building, water tank, sign, light fixture or utility pole, is permitted outright so long as the additional antenna(s) is no more than 20 feet higher than the existing structure, no more than three providers are collocating on the structure, and the color of the antenna(s) blends with the existing structure or surroundings; Per your plans, there will be a single provider, the 20 foot height threshold is not exceeded, and the color of the antennae will be painted to match the building color. As such, the proposed use is an outright permitted use. However, since modifications to the previously approved site development will be necessary, a modification of that prior approval is also required. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed wireless communication facility is not required to provide any parking, pursuant to the parking demand table in TDC 18.765. Therefore, no additional on-site parking is needed. No existing parking will be removed either. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the structure is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The building height will not be increased by this proposal. The antennae are required to not exceed 20 feet above the existing building height, which has been met as previously demonstrated. The antennae support are considered appurtenances to the building (similar to chimneys) and are not subject to the building height calculation. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. There are no proposed changes to the site apart from the two small chases on the side of the existing building. Access and parking are unaffected by this proposal. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed use is expected to generate approximately 1 round trip per month. This is significantly below the 100 trip per day threshold. Therefore, this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. This expansion consists of two (2) 25 square foot chases, for a total expansion of 50 square feet, below the 5,000 square foot limitation. The equipment will be housed indoors within existing square footage. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There is no common open space required for this type of development, therefore this standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. There are no specific amenities provided by the existing development. The amount of landscaping will be reduced by 50 square feet but not below the 15% minimum required in the C-G zone. The site is 21,526 square feet in size. The landscaping comprises roughly 3510 square feet (16.3%). Therefore this criterion is met. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The site was developed through Site Development Review, case number SDR2000-00009. Staff has Minor Modification Request (MMD 2002-00016) Page 2 of 3 not identified any conditions that will be impacted by the present proposal. A copy of those conditions have been attached to this letter. It is the applicant and owner's responsibility to ensure that these conditions are not impacted during construction, and if any impacts occur, that repairs be made to return the site into conformance. We are installing communications facilities in the area, including towers with antennas installed on them. We lease small amounts of land or rooftop space,from many different landlords around the state in order to build,use, and maintain our network. Your property is one of many in your general area that may meet our objectives. We are interested in studying your property to determine if our communications facility would be feasible if located on your property. The tests we perform include radio frequency tests,environmental assessments,zoning feasibility, and construction feasibility studies. The top elevation of the antennas and mounting structures will not be more than 20 feet above the existing structure, measured from one half the distance between the gutter line and roof peak. Two canister-style mounting poles (14" diameter)will be attached directly to the west end of the building. The new wireless antennas will be concealed within 19" diameter canisters approximately 6' long at the top of each mounting pole. The canisters will be concealed from the roofline to ground level by a chase to be constructed to match color and design of the existing building. Accessory equipment and coaxial cable will be located within the existing building and will not be visible from the building exterior. A request for a use determination was made to the Director of Development Services on May 6, 2002 to ensure that the proposed development met the intent of the development code regarding the attachment of antennas to existing non-tower structures. The Director of Development Services confirmed that the proposed development meets those requirements. The proposed modification meets the criteria for a minor modification, and is a modification of SDR 2000-00009. NARRATIVE ADDRESSING CRITERIA AND RELEVANT STANDARDS: The criteria and relevant standards applicable to the proposed development include parts of Section 18.360, in particular the criteria detailed in 18.360.050 (B). No change in the type and location of existing access ways and parking areas is proposed. Off-site traffic will not be impacted by the proposed development.
