Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped, and pedestrian friendly. LOCATION: The subject site is located south of SW Tigard Street at. 9740 SW Tigard Street; WCTM 2S102BA, Tax Lot 00501. The portion of land on the southern, undeveloped side of the subject property must be purchased by the City. SECTION III. BACKGROUND INFORMATION Site History A search of the City records indicates three land-use cases associated with this parcel. Temporary Use Permit (11-86) to hold a Christmas bizarre, SDR 21-86 to run a mail order and general retail business from the home and SDR 90-0011 to convert an existing single- family dwelling into a commercial use, construct a 1,000 square foot storage shed, and allow placement of a manufactured home on the site to replace the residence. No other records were found. Vicinity Information: The subject site is located on the south-side of SW Tigard Street. The site is bordered to the south, east and west by property zoned I-P. Site Information and Proposal Description: The property is currently developed for Industrial uses. The City of Tigard is requesting to amend Site Development Review (SDR) SDR 21-86 and SDR 90-0011NAR 90-0016 to remove Conditions of approval 7 and 2, respectively, both requiring the dedication of floodplain/floodway. This application is considered to be a major modification to an approved SDR amending conditions. The previously required dedications cannot be built ero . because of topography. The trail has been designed on the apposite side of Fanno Creek and therefore, the initial dedication requirements are unnecessary. SECTION IV. SUMMARY OF APPLICABLE REVIEW CRITERIA A. Specific SDR Approval Criteria 18.360 SECTION V. APPLICABLE DEVELOPMENT CODE STANDARDS Because the site is already developed, and no development is proposed, the proposal contains no elements related to the following Code Chapters which are also listed under Section 18.360.090.A.1: 18.350 (Planned Development), 18.390 (Impact Study), 18.530 (Industrial Zoning District), 18.705 (Access Egress and Circulation), 18.715 Density Computations), 18.730 (Exceptions to Development Code Standards)), 18.745 Landscaping and Screening), 18.755 (Mixed Solid Waste and Recyclable Storage), 8.765 (Off-Street arking and loading requirements), 18.790 (Tree Removal), 18.795 C(Visual Clearance), 18.797 (Water Resources Overlay District), 18.798 (Wireless ommunication Facilities), 18.810 (Street and Utility Improvement Standards), A. SPECIFIC SITE DEVELOPMENT REVIEW APPROVAL STANDARDS Section 18.360.090(A)(2) through 18.360.090(A)(15) provides additional Site Development Review approval standards not necessarily covered by the provisions of the previously listed sections. These additional standards are addressed immediately below with the following exceptions: The proposal contains no elements related to the provisions of the following because there is no development in relationship to the physical environment. Therefore, these sections are found to be inapplicable as approval standards. NOTICE OF TYPE II DECISION SDR2000-00007/SNYDER AMENDMENT PAGE 2 OF 4 • 18.360.090.2 (Relationship to the Natural and Physical Environment) 18.360.090.3 (Exterior Elevations); 18.360.090.4 (Buffering, screening and compatibility between adjoining uses); 18.360.090.5 (Privacy and Noise: Multi-family or Group Living Uses); 18.360.090.6 (Private Outdoor Areas: Multi-family Use); 18.360.090.7 (Shared Outdoor Recreation Areas: Multi- family Use); 18.360.090.9 (Demarcation of Spaces); 18.360.090.10 (Crime prevention and safety); 18.360.090.11 (Public transit); 18.360.090.12 (Landscaping); 18.360.090.13 (Drainage); and 18.360.090.14 (Provision for the disabled). Where landfill and/or development is allowed within and adjacent to the 100-year floodplain, the City shall require consideration of the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle plan. - The arcel of land associated with this application does fall within the 100-year floodplain. As conditioned in prior land-use cases, the portion of the property which falls within the zero foot rise floodway portion of the floodplain was to be dedicated as greenway/open space to the City according to the code at the time. Today's code requires consideration of dedication relative to rush proportionality tests. The parcel itself is located on both sides of Fanno Creek. The portion of the property located between the creek and Tigard Street was developed with industrial use. The portion located on the opposite side of the creek is undeveloped. File maps identify the land subject to the dedication as located on the developed or northerly side of the creek. • In 1998, the City completed the first ever preliminary engineering trail alignment design study covering this and certain other sections of Fanno Creek. With regard to the subject property, the study found the available streamside land located on the developed side of the creek was too narrow and too steep to provide a suitable location for a standard width, paved trail. Because it is flatter and wider and connects with proposed up and down-stream trail segments, the study found the streamfront land located on the opposite side of the creek was more suitable to accommodate a recreational trail designed to City standards. Accordingly, the study recommended the trail at this reach of the creek be located on the southern or undeveloped, side of the creek. In November of 1999, the southern 0.79 acres of the subject property was partitioned. A sale to the City of Tigard is pending. In the discussion relating to the City of Tigard purchasing the .79 acres, the owners requested that the conditions requiring dedication on the opposite side of the creek be removed. FINDING: The City is purchasing the property on the opposite side of the creek to provide for the trail. Therefore, the previous conditions required are unnecessary. CONDITION: The portion of land on the southern, undeveloped side of the subject property must be purchased by the City. SECTION VI. OTHER STAFF COMMENTS No comments were received. SECTION VII. AGENCY COMMENTS • Unified Sewerage Agency has no objections to amending the conditions of approval. Development along the sensitive area will be governed by the requirements of R&O 00-7 or its replacement. US Army Corps of Engineers indicated that any impacts to Fanno Creek or its adjacent wetlands will require Department of the Army authorization. Temporary Use Permit (11-86) to hold a Christmas bizarre, SDR 21-86 to run a mail order and general retail business from the home and SDR 90-0011 to convert an existing single- family dwelling into a commercial use, construct a 1,000 square foot storage shed, and allow placement of a manufactured home on the site to replace the residence. No other records were found. Vicinity Information: The subject site is located on the south-side of SW Tigard Street. The site is bordered to the south, east and west by property zoned I-P. Site Information and Proposal Description: The ro ert is currently developed for Industrial uses. The City of Tigard is requesting to amend SiteyDevelopment Review (SDR) SDR 21-86 and SDR 90-0011NAR 90-0016 to remove Conditions of approval 7 and 2, respectively, both requiring the dedication of floodplain/floodway. This application is considered to be a major modification to an approved SDR amending conditions. The previously required dedications cannot be built because of topography. The trail has been designed on theapposite side of Fanno Creek and therefore, the initial dedication requirements are unnecessary. SECTION IV. SUMMARY OF APPLICABLE REVIEW CRITERIA A. Where landfill and/or development is allowed within and adjacent to the 100-year floodplain, the City shall require consideration of the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle plan. The parcel of land associated with this application does fall within the 100-year floodplain. As conditioned in prior land-use cases, the portion of the property which falls within the zero foot rise floodway portion of the floodplain was to be dedicated as greenway/open space to the City according to the code at the time. Today's code requires consideration of dedication relative to rush proportionality tests. The parcel itself is located on both sides of Fanno Creek. The portion of the property located between the creek and Tigard Street was developed with industrial use. The portion located on the opposite side of the creek is undeveloped. File maps identify the land subject to the dedication as located on the developed or northerly side of the creek. In 1998, the City completed the first ever preliminary engineering trail alignment design study covering this and certain other sections of Fanno Creek. With regard to the subject property, the study found the available streamside land located on the developed side of the creek was too narrow and too steep to provide a suitable location for a standard width, paved trail. Because it is flatter and wider and connects with proposed up and down-stream trail segments, the study found the streamfront land located on the opposite side of the creek was more suitable to accommodate a recreational trail designed to City standards. Accordingly, the study recommended the trail at this reach of the creek be located on the southern or undeveloped, side of the creek. In November of 1999, the southern 0.79 acres of the subject property was partitioned. A sale to the City of Tigard is pending. In the discussion relating to the City of Tigard purchasing the .79 acres, the owners requested that the conditions requiring dedication on the opposite side of the creek be removed. FINDING: The City is purchasing the property on the opposite side of the creek to provide for the trail. Therefore, the previous conditions required are unnecessary. CONDITION: The portion of land on the southern, undeveloped side of the subject property must be purchased by the City. • SECTION VI. OTHER STAFF COMMENTS No comments were received. SECTION VII. AGENCY COMMENTS Unified Sewerage Agency has no objections to amending the conditions of approval. Development along the sensitive area will be governed by the requirements of R&O 00-7 or its replacement. US Army Corps of Engineers indicated that any impacts to Fanno Creek or its adjacent wetlands will require Department of the Army authorization. The development in question was approved under SDR 21-86 and SDR 90-11. SDR SDR 21-86 condition #7 and SDR 90-11 condition #2 are identical and read as follows: "The area within the 100 year floodway shall be dedicated as greenway/ open space to the City. . . . " The subject 100-year floodway area is depicted on site maps as bordering the rear of the property. According the staff reports, the intent of this requirement was to assure that the floodway would remain in open space, agriculture, or similar use, and that the city would have the right to construct a pedestrian/bicycle path within the floodway area. Floodway is defined in the Tigard Community Development Code (18.120-7.71.c) "as the normal stream or drainage channel and that adjoining area of the natural floodplain needed to convey the waters, including the zero-foot rise floodway area defined by the U.S. Corps of Engineers Flood Insurance Study, February 1984. Floodways must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation." Floodplain is defined in 18.120-7.71.b. as "the zone along a watercourse enclosed by the outer limits of land which is subject to inundation in its natural or lower revised contours by the base flood." The justification for requesting the removal of this dedication condition is as follows: (1) the city no longer rountinely requires the dedication of floodplain property in conjunction with development. Since the application of this condition to the development of the subject site in 1987 and 1991, the community development code have been changed. Per 18.390.040.B.2.e, in situations where the Community Development Code requires the dedication of real property interests, a demonstration that the real property dedication requirement is roughly proportional to the projects impacts of the development is required. No such demonstration was provided in the two staff reports dealing with the subject property. Therefore, this condition as it stands is not consistent with current land use law and community development code requirements. (2) Current stream protection regulations prohibit the installation of pathways within the floodway 18.775.070). The reference to floodway was in error. The correct reference should have been 100-year floodplain. (3) The property (TL 2S1 2BA 501) which is the subject of the two SDR decisions is located on both sides of Fanno Creek. The portion of the property located between the creek and Tigard Street is developed as an industrial park. The portion located on the opposite side of the creek is undeveloped. File maps identify the land subject to dedication as located on the developed or easterly side of the creek (see attached). The Tirgard Area Ped/Bike Path Map (1983) and Tigard Park Plan (1988) each identify a continuous trail extending the length of Fanno Creek as it passes through Tigard. However, neither plan defines the specific location of the trial or includes any technical information regarding its feasiblity. In 1998, the city completed the first ever preliminary engineering trail alingment design study covering this and certain other sections of Fanno Creek. With regard to the subject property, the study found that the available stream-side land located on the developed side of the creek was too narrow and too steep to provide a suitable location for a standard width, paved trail. Because it is flatter and wider and connects with proposed up- and down-stream trail segments, the study found that the streamfront land located on the opposite side of the creek was suitable to accommodate a recreational trail designed to city standards. Accordingly, the study recommended the trail at this reach of the creek be located on the easterly or undeveloped, side of the creek. Following the completion of the design study, a land use application for the installation of the Fanno Creek trail (CPA 1999-000001, SLR 1999-00003) along this and certain other creek locations was submitted and approved by the City. The application was based on the results of the design study and reflected the decision to place the trail on the easterly portion of the subject property. • Therefore, the third rationale for removing the dedication condition is that the floodway or floodplain in question does not meet design specifications and is no longer needed in order to complete a continuous trail along Fanno Creek. Listed below are the approval criteria for Major Modifications to Approvel Plans or Existing Development: / Tre,-PLIY CAF) (87( 7 3 i 1. An increase in dwelling unit density, or lot coverage for residential development; 2. A change in the ratio or number of different types of dwelling units; 3. A change that requires additional on-site parking in accordance with Chapter 18.765; 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; 5. An increase in the height of the building(s) by more than 20%; 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected; 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; 10.A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. 11.A modification to the conditions imposed at the time of site development review approval which are not the subject of B1 through 10 above of this subsection. Among these, only criteria # 11 applies to this proposal. Condition #9, a reduction in the area reserved for open space or landscaping, does not apply, because land proposed for dedication to the city is not included in the calculation of land scaping or open space. DATE: Dec. 2, 1999 SUBJECT: Pre-Ap request Subject: SDR 87-31, SDR 90-11 Request: Staff initiated consideration of a Major Modification to Approved Plans in order to remove a floodway dedication requirement. Location: Tax lot 2S1 2BA 501 Landowners: Donald and Susan Snyder 12937 Water Gap Road Williams, OR 97544 Applicant: The City of Tigard Applicable Criteria: 18.360.050 Background The city has negotiated a deal with a Mr. and Mrs. Snyder for the acquisition of the southern portion of a property they own that straddles Fanno Creek near Grant Avenue (see map). The opposite or northern portion of the property has been developed as Creekside Industrial Park. As indicated in the attached final orders, the Snyders were twice (in 1987 and 1991) required to dedicated floodway to the city as a condition of development approval. Both times, the site was improved in accordance with the approval, but the dedication condition was not fulfilled. • The city wishes to construct .thway along a section of Fanno C .c that includes the Snyder property. According to the completed pathway design study, the preferred location of the trail runs through the southern or undeveloped portion of the Snyder property. Due to topographic and stream protection constrains, the land located along the northern side of the creek within the limits of the proposed trail project is far less suitable for trail development. As part of the agreement to sell the southern portion of their property, the Snyders have asked the city to remove the previous dedication conditions. They are concerned these conditions could interfere with the future sale of the industrial park portion of the property. WHEREAS, the applicants requested a Site Development Review approval to allow 'a mail order and general retail business on a 2.43 acre site which is zoned I-P (Industrial Park) and a Variance to allow a gravel driveway with a 15 to 20 foot width where pavement and a 24 foot width is required; and WHEREAS, the Director of Community Development approved said application .fQr the Site Development Review subject to 15 conditions but denied the Variance request; and WHEREAS, the Director' s decision was appealed to the Tigard City Council; and WHEREAS, the Tigard City Council heard the appeal request at its regular meeting on February 9, 1986, and voted to approve the applicants' request subject to modified conditions . NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1 : The proposal satisfies the criteria necessary to approve a Site Development Review. Section 2: The applicant has objected to conditions of approval : 1) requiring half-street improvements along their Tigard Street frontage on the premise that no other property owners are required to do so; 2) the greenway dedication requirement; 3) the denial of the variance request; and requested a refund of the appeal fee. Section 3 : The Council voted unani ly to approve the application with old • conditions of approval 1-5, 10-12, 14 and 15 unchan1ed; that a non-remonstrance agreemen e required on condition No. 6; that conditions No. 7 and 8 be deleted; and that condition No. 13 be altered so that parking and driveway areas shall be paved upon expansion of the existing commercial building. The changes are contained in the conditions set forth below. Section 4: The Council did not approve a refund of the appeal fee. Section 5: The Council, therefore ORDERS that the above-referenced request be, and the same hereby is, APPROVED subject to the following conditions: 1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ESTABLISHMENT OF THE NEW BUSINESS. 2. Approval shall be obtained for the change of occupancy from the Building Inspection Division and the Tualatin Rural Fire Protection District. RESOLUTION NO. 87-3./... Page 1 Flood Plain The rear portion of the property is within the 100 year flood plain of Fanno Creek which is designated for open space in the Comprehensive Plan. Typically, the dedication of this flood plain area is required as a condition of development. Hbwever, since the property can obviously be developed more intensively in the future, including portions of the flood plain, only a partial dedication is necessary at this time. The floodway is a narrower section within the flood plain which is closest to the channel . No development or landform alteration is permitted in this area and therefore dedication of the floodway will not preclude future development options for the property. Additional flood plain dedication may be required later in conjunction with future development. 3 . Storage of Material Several nonoperating vehicles as well as building and other materials are presently being stored in the rear of the property. Such storage . is not permitted in the I—P zone and the vehicles and material should be removed. 4. Landscaping The existing landscaping meets Code requirements with the exception of screening from residential uses that lie immediately northeast and on the opposite side of Fanno Creek . An amended landscaping plan should be provided which establishes some visual buffering in these two directions. 5. Parking Between the residence and proposed 'business, four parking spaces are required. Room for four vehicles is provided between Tigard Street and the rear building. 6. Variance for Driveway Width and Pavement The Code requires that two—way driveways have width of 24 feet. The existing Tigard Street entrance is approximately 20 to 22 feet in width and the driveway to the rear of the building is about 15 feet wide. Because of the extremely low amount of anticipated traffic, the existing driveway width will be sufficient. Also, the required parking area is provided in front with supplemental parking spaces being served by the 15 foot rear driveway . Commercial and industrial development, regardless of scale, are required to provide pavement for all parking, loading, and driveway areas. The Tigard Planning Commission has reviewed the above application at a public hearing on January 8, 1991. The Commission has based ito decision on tho facto, findings, and conclusions noted below. A. FINDING OF FACT 1 . Background This site was annexed into the City in August, 1971 (Boundary Commission file no. 296) . In December, 1986 a Temporary Use application was approved allowing the operation of a Christmas bazaar on the property. Later in December, 1986 a site development review application (SDR 21-86) was conditionally approved by the Director allowing the operation of a mail order business from the single-family dwelling located at 9744 SW Tigard Street (please refer to Exhibit ?•) . This decision was appealed by the applicant who objected to conditions of approval that required half-street improvements along Tigard Street, paved driveways, and the dedication of greenway along Fanno Creek. The City Council ruled in favor of the applicant with respect to the half-street improvements . Council also allowed the applicant to defer paving the driveway until further expansion of the 'industrial commercial' use. Dedication of additional right-of-way and execution of a nonremonstrance agreement were required in lieu of the improvements. Council ruled in favor of staff's recommendation for dedication of greenway along Fanno Creek in the 100-year floodplain. The mail order business apparently was established, but these conditions have not been satisfied. The subject application was ap?roved by the Planning Director with conditions. The applicant appealed this decision because of the requirements for dedication of the floodway area on the property (Condition 2 . ) , paving of the parking and driveway areas identified in Condition 8., and the provision of half street improvements along the Tigard Street frontage (Conditions 11, 12, and 13) . The applicant also requested that the hearing before the Commission be postponed until January, 1991 . 2 . Vicinity Information Properties to the east and west are also zoned I-P. Tigard Street and railroad tracks lie to the north. Parcels to the north of the railroad tracks are zoned P.-4 .5 (Residential . 4 .5 • units/acre) . Fanno Creek runs along the southern property line and just south of the creek is another residential district zoned R- 4 .5. FINAL ORDER - SNYDER - SDR 90-0011/VAR 90-0016 PAGE 1 • • permitted uues and City standards are maintained to the greatest extent possible while permitting some economic use of the land. Existing physical and natural systems will not be adversely affected. A hardship exists in that if this portion of the site were required to be paved at this time, the paving would have to be removed when the site is redeveloped. The variance requested is the minimum variance which would alleviate the hardship. The Commission finds that the variance is not justified for the deletion of the paving for the portion of they driveway and parking spaces that will serve the fish wholesale business. This is an industrial use that will generate traffic which warrants the provision of a paved surface in accordance with Code requirements. Variance to Reduce the Pavement Width of the Driveway The applicants request a variance to allow a 30 foot long portion of the approximately 300 foot long driveway to be approximately 20 feet wide where 24 feet is normally required. The remainder of the driveway satisfies the access width requirement . Code Section the , standards f variance to access 18.100. 15e contains tub upprv':A• .,.uiuv. .. C: a .... ..... standards . They are as follows: 1 . It is not possible to share access; 2 . There are no other alternative access points on the street in question or from another street ; 3 . The access separation requirements cannot be met; 4 . The request is the minimum variance required to provide adequate access; 5. The approved access or access approved with conditions will result in a safe access; and 6. The visual clearance requirements of Chapter 18. 102 will be met . The proposal satisfies these standards because it is not possible to share access with a neighboring properry at this time. Criteria number 2 and 3 do not apply because the variance request is not for the point of access from Tigard Street . The request is the minimum variance required ro provide adequate access. The applicant intends to install a divider or island between the parking area for the tropical fish business and the driveway so that vehicles will have to back far enough out of the adjacent parking spaces to be able to see down the driveway before entering it . The island must be a minimum of' 3 feet wide and must contain landscaping no greater than 3 feet in height . Adequate visual clearance will be provided and the driveway will be safe. C. DECISION The Planning Commission approves SDR 90-0011/VAR 90-0016 subject to the following conditions: THE FOLLOWING CONDITIONS SHALL BE MET PRIOR TO OBTAINING BUILDING PERMITS FOR THE PLACEMENT OF THE MANUFACTURED HOME AND CONSTRUCTION OF THE STORAGE BUILDING. 1 . Additional right-of-way shall be dedicated to the Public along FINAL ORDER - SNYDER - SDR 90-0011/VAR 90-0016 PAGE 8 the SW Tigi:r.d Street frontage to increase the right-of-way to 50 feet from the railroad right-of-way along the north side of the right-of-way. The description shall be tied to the existing right-of-way centerline. Tho dedication document shall be on City forms. Instructions are available from the Engineering Department . A monumontod boundary survey showing all m«.w title lines, prepared by a registered professional, land surveyor, shall be submitted to the City for review and approval prior to recording. In the alternative, the applicant shall dedicate an open space easement which will allow the City to construct a pedestrian path through the floodway area in the future. Said easement shall be approved t.-y the City Attorney. In addition, the floodplain boundary shall be marked with stakes to assure that no buildings or other structures are located within the floodplain.
