MMD2002-00022 VOIDED MMD2002- 00022 CASH AND CARRY STORE • e AV CITY OF TIGARD August 30, 2002 OREGON Fernando Gallarzo 600 Citadel Drive Commerce, CA 90040 RE: Smart & Final, Cash and Carry store, 11745 SW Pacific Highway Dear Mr. Gallarzo: As you are aware, during our review of your minor modification request, it was found that your proposed use will generate greater than 100 additional vehicle trips per day than the previous furniture store use. This exceeds the limits allowed for a minor modification as prescribed by the criterion found in TDC 18.360.050 (B)(7). Therefore, a major modification is required to change the use as you have proposed. A major modification is processed identically as a new Site Development Review, which requires a preapplication conference, neighborhood meeting, and application. Typical review times for an SDR are 4-6 weeks, after the application has been deemed complete. Due to the fact that the site is currently developed, and the building itself will not be extensively modified (aside from interior tenant improvements, and incidental minor exterior facade changes), planning and building staff have agreed that tenant improvements may occur prior to final land use approval. However, authorization to proceed with tenant improvements is subject to receiving necessary building permits and the applicant must provide indemnity and hold the City harmless in the event that any loss should occur as a result of proceeding with construction prior to receiving final land use approval. No final occupancy will be approved without successfully obtaining land use approval and satisfying the conditions of approval. While the city does not anticipate any major issues with regard to your application, the city cannot guarantee or predict approval of the application. In addition to reviewing the various criteria for changes since revisions to the code were made from the time of the original approval, there is a public comment and appeal process that could raise unanticipated issues. In order to permit Cash & Carry to proceed with applications for building permits, the City will need a letter indemnifying the City and holding the City of Tigard harmless in the event that any loss is incurred by the applicant and owners of Cash and Carry as a result of proceeding with construction prior to receiving final land use approval. As we have discussed, you will need to schedule a preapplication conference, and hold a neighborhood meeting prior to submitting your application for Site Development Review.
