Staff has completed a preliminary review of the submittal materials and has determined that the following additional information is necessary before the application can be deemed complete: 1. Site Plan. The site plan does not show many important characteristics and dimensions needed for staff's review: a. The dimensions of the building footprints and square footages for each building. Remember that the storage limitation is 50% of the total square footage. Show how this is being (or will be) met. b. The dimensions of the parking stalls. You may be required to provide a handicap accessible space, contact Daryl Jones, Commercial Plans Examiner for more information. It is strongly recommended that you consult with Mr. Jones early in this process to assess the feasibility of converting the single family structure. Building code requirements are much different for commercial office structures and may require substantial modifications to the building, which in turn could impact the site layout. c. The dimensions of the access driveway, especially as it passes through the building. How are the driveways going to be designated and protected from encroaching storage material? How will access to the site be controlled? In other words, will the doors be open all day during business hours, or will they be closed? d. Walkway requirements. I believe there is an existing connection between the house and garage on the site. If so, show it and if not, you will need to propose one. Clearly show areas of pavement and concrete versus areas of landscaping. The buffer standards also require a mix of horizontal and vertical shrubbery. Please indicate the species, size and spacing of proposed plant materials. f. The requirements for paving a parking area also apply to areas within 100 feet of residentially used property. This will ultimately require the entire parking area be paved. This additional impervious area will not impact your request for a fee in lieu of water quality treatment. 2. Lighting Plan. Information pertaining to lighting needs to be identified on the plans. This may be shown on the site plan, on the building elevations, or on a separate plan altogether. Lighting needs to be adequate to discourage crime, but shall not cause glare onto adjacent properties. 3. Impact Study. You will need to submit a statement that speaks to the impacts the development will have on the public systems, refer to TDC 18.390.040 (B)(2)(e). 4. Narrative The narrative needs to address the approval criteria for Site Development Reviews (TDC 18.360.090) as well as the criteria for your requested variance to reduce the landscape buffer. The criteria for variances are found in TDC 18.370.010 (C)(2). Respond to each variance criterion separately. Also, it is not clear how you came to the required 4 parking spaces. An office use requires 2.7 per 1,000 gross square feet. Based on the office and shop areas totaling 3,475 square feet, approximately 10 parking spaces would be needed. Please clarify your methodology. 5. Construction Cost Estimate. Please include a preliminary estimate to the cost of the proposed improvements. 6. Lot Line Adjustment Application. The information for the lot line adjustment appears adequate; however, the placement of the new lot line may violate building and fire codes. Unless the detached garage structure has been fire rated, a minimum of 3 feet clearance from all portions of the structure, including overhangs, is required. This is independent of the underlying zone setback standards (which would otherwise permit a zero lot line setback). You may want to revise your proposal to provide this clearance, which may either be shown on a new lot line adjustment plan, or reflected in a narrative that would then cause a condition to be imposed to adjust the line for the final lot line adjustment map. As an alternative, you may request the building department inspect the structure to determine its fire rating (although this may require partial demolition to inspect the structural members). This application will demonstrate that the proposed Site Plan Review/Conversion, Variance and Lot Line Adjustment each comply with the standards and purposes of the applicable policies and regulations of the Tigard Municipal Code. No residential development or structural construction is associated with this development application. Other than the lot line adjustment, 2465 SW Hall Blvd. will not be altered or affected by this application. However, the applicant will cease to use 12465 SW Hall Blvd. as a commercial office upon the city's approval of Applicant's SDR Application. Existing Conditions: Topography: The subject properties have a variety of slopes. The high portion of the site is in the vicinity of the new property line and the residence located on the Hall property. The Hall property slopes from north to south, to Hall Boulevard, at a slope of approximately 8%. The portion of new commercial property located behind the wood frame shop on 8725 SW Commercial slopes from southeast to northwest at a slope of approximately 6.5%. The balance of the commercial street property has 2 difference grades. The portion of the land surrounding the wood frame shop is at sidewalk grade level. The portion of the land located southeast of the wood frame shop, the portion that surrounds the office, is primarily level; however, the main entrance to the office is approximately 4' above the sidewalk grade. Surrounding Land Uses: The subject site is located at the southeast perimeter of the City of Tigard's CBD. Immediately across Hall Blvd. to the southeast is a Light Industrial zone. The subject properties are surrounded by mixed uses, including single family 2 of 7 residential, multi-family residential, light industrial, retail uses, and a public transportation"Tri-Met" Terminal. Existing Buildings: 8725 SW Commercial Street has 2 existing buildings. A 1250 square foot two-story, wood-framed residential structure, and a 2225 square foot wood frame shop. 12465 SW Hall Blvd. has 2 existing structures, a 1250 square foot two- story, wood-framed residential structure, and a 240 square foot garage. Transportation: 8725 SW Commercial Street is and will continue to be accessed from Commercial Street. 12465 SW Hall Blvd. is and will continue to be accessed from Hall Blvd. The Applicant's employees will utilize the area NE of the wood frame shop as a parking lot for fleet storage of business vehicles. To access the back lot, Applicant's employees will travel through the existing shop (the shop has roll-up doors on both the street side and the side opposite the street) and then perform a 180 degree turn to permit the trucks to exit the subject property onto Commercial in a forward motion. The dimensions of the parking lot NE of the wood frame shop is sufficient to allow the types of trucks used in Applicant's business activities sufficient turning radius to complete a 180 degree turn in the back lot. This turn is required to satisfy the City's requirement that traffic not back onto Commercial Street following the City's approval of Applicant's Site Development Application. See Site Plan turning plan. Compliance with City of Tigard Municiple Code: Procedures: Applicant seeks a Site Development Review pursuant to Chapter 18.360.030(A) Major Modifications. Major modifications of an approval plan where existing developments, as defined in Section 18.360.060, shall be processed as a Type II procedure, as governed by Section 18.390.030, using approval criteria contained in Section 18.360.050. Commercial Zoning Districts: The central business district (CBD) is designed to provide a concentrated central business district, centered on the city's historic downtown, including a mix of civic, retail and office uses. Applicant's use is a permitted use within the zone. The CBD allows general retail uses, including sales-oriented, repair-oriented, and personal services. Clear Vision Area: The provisions of Chapter 18.795 apply to all developments including the construction of new structures, the remodeling of existing structures and to a change of use which increases the on-site parking or loading requirements or which changes the access requirements. However, pursuant to Section 18.795.030, "visual clearance areas" are not required within the CBD zoning district. Because applicant's property is within the CBD zoning district, the provisions of Chapter 18.795 are inapplicable to applicant's site development review plan. 3 of 7 Access: 8725 SW Commercial Street meets the applicable access/egress requirements of Chapter 18.705, which requires one driveway with a minimum access width of 30', with a minimum pavement and curb width of 24'. See Table 18.705.3 as noted on Exhibit blank, there is an existing driveway that exceeds these minimum standards. The wood frame shop has roll-up doors on both the Commercial St. side and the side of the building opposite Commercial street. This feature will allow fleet, staff, and customer vehicles to pass trough the shop/garage and parking in the rear of the lot. One lane is dedicated for ingress, (See Site Plan, # 8.), and one lane is dedicated for egress (See Site Plan, # 9.). The largest vehicle accessing the rear lot will be the fleet trucks, which range from 16' to 20' long. With approval of the Variance requesting approval of the proposed Landscape/Screening Plan, the existing rear yard will provide adequate turn-around area for any expected vehicle to maneuver. See Site Plan, # 10. Walkway Requirements: The provisions of Chapter 18.705 shall apply to all development including the construction of new structures, the remodeling of existing structures (citation omitted), and to a change of use which increases the on-site parking or loading requirements or which changes the access requirements. Pursuant to Section 18.705.030 (F)(1), walkways shall extend from the ground floor entrances or from the ground floor landing of stairs, ramps, or elevators of all commercial, institutional, and industrial uses, to the streets which provide the required access and egress. Required walkways shall be paved with hard surfaced materials such as concrete, asphalt, stone, brick, etc. Walkways may be required to be lighted and/or signed as needed for safety purposes. Section 18.705.030(F)(4). Existing on site at 8725 SW Commercial St. is a City of Tigard sidewalk on grade with the wood frame shop. Each of the above noted requirements is satisfied by this existing condition which runs the length of the frontage of Applicant's property along Commercial Street. Recycling: Applicant is complying with the standards of Chapter 18.755 by incorporating into the Site Plan adequate space for location of a recycling container as noted on the Site Plan. See Site Plan, # 6. Parking: Applicant's proposed site development plan complies with Chapter 18.765.040 by providing the minimum required four parking stalls as noted on the Site Plan. Applicant's proposed site development plan also complies with Section 18.765.050 by providing the minimum required one bicycle parking rack in the location noted on the Site Plan. See Site Plan, # 7. Applicant proposes use of tandem parking which is permitted pursuant to 18.765.040(B)(6), to provide two covered stalls on site. See Site Plan, # 4. Applicant proposes that the other two additional parking stalls will be in the back parking lot. See Site Plan, # 5. 4 of 7 Loading Area Requirements: Applicant is not required to provide a loading area pursuant to Section 18.765.080 because applicants commercial buildings are less than 10,000 square feet. Tree Plan Requirement: A tree plan for the planting, removal and protection of trees prepared by a certified arborist shall be provided for any lot, parcel or combination of lots or parcels for which a development application for a subdivision, partition, site development review, planned development or conditional use is filed. Protection is preferred over removal where possible. See 18.790.030(A). The tree plan shall include the following: 1. Identification of the location, size and species of all existing trees including trees designated as significant by the city; 2. Identification of a program to save existing trees or mitigate tree removal over 12 inches in caliper. Mitigation must follow the replacement guidelines of Section 18.790.060D, in accordance with the following standards and shall be exclusive of trees required by other development code provisions for landscaping, streets and parking lots: Language Omitted; The survey prepared for the Lot Line Adjustment depicts all on-site trees of a caliper of 6" or greater. Nevertheless, the applicant is not proposing to remove any trees in either the Site Development Review Application or the Lot Line Adjustment Application. No trees will be affected by any on-site construction because no on-site construction will be associated with this application. No trees have been removed within the year prior to this application. Subsequent tree removal: Trees removed within the period of one year prior to a development application listed above will be inventoried as part of the tree plan above and will be replaced according to Section 18.790.060D. Sensitive Area Pre-Screening Site Assessment: City of Tigard Staff performed a Sensitive Area Pre-Screening Site Assessment, which concluded that "Sensitive areas do not appear to exist on site within 200" of the site." See attached Assessment. Storm Water Improvements: City of Tigard surface water management is governed by Unified Sewerage Agency (Resolution and Order No. 00-7) which requires the construction of on-site water quality facilities where the net increase of impervious area is greater than 1,000 square feet. The 5 of 7 resolution contains a provision that would allow an applicant to pay a fee in-lieu of constructing an on-site facility provided specific criteria are met. Applicant's net increase of impervious area exceeds the threshold 1,000 square feet by 750 square feet. Accordingly, Applicant retained the professional expertise of Civil Engineering firm Alpha Engineering for the purpose of ascertaining the viability and design of an on-site water quality facility for compliance. Alpha Engineering, in its professional opinion, concluded that the difficult physical restraints and extremely high costs associated with the on-site facility design and construction make the Applicant's situation a good candidate for the City's consideration for a fee in-lieu of constructing a on-site facility. See attached letter from Jody Bienerth,P.E. Landscaping/Screening: The provisions of Chapter 18.745 shall apply to all development including the construction of new structures, remodeling of existing structures where the landscaping is non-conforming (citation omitted), and to a change of use which results in the need for increased on-site parking or loading requirements or which changes the access requirements. Buffering and screening is required to reduce the impacts on adjacent uses which are of a different type in accordance with the matrices in this chapter (Tables 18.745.1 and 18.745.2). The owner of each proposed development is responsible for the installation and effective maintenance of buffering and screening. A buffer area may only be occupied by utilities, screening, sidewalks and bikeways, and landscaping. See Section 18.745.050(B)(2). Screening of parking and loading areas is required. See Section 18.745.050(E)(1)(a). The general purpose of Section 18.745.050, which is "that these requirements shall provide for privacy and protection and reduce or eliminate the adverse impacts of visual or noise pollution at a development site, without unduly interfering with the view from neighbors properties or jeopardizing the safety of pedestrians and vehicles." Currently a 5' high cyclone style fence with vinyl slats separates the subject property from the adjacent use to the northwest, an apartment complex. See Site Plan, # 2. In addition, the grade of the subject property is approximately 3.5' higher than the grade of the apartment complex. Currently the fence extends from the subject property's northeast boundary line to a point approximately even with the wood frame shop. Applicant proposes to extend the fence line to a point approximately equal to the front corner (northwest corner) of the wood frame shop. See Site Plan, # 3. In addition, applicant proposes to install shrubbery as required by Table 18.745.2, plus additional density of shrubbery as noted on the Site plan. See Site Plan, # 1. The difference in grade between 8725 and adjacent use, the vinyl slatted fence screening 8725 from the adjacent use (the top of the fence is approximately 8-8.5' above the apartment complex grade), and the proposed dense shrubbery combine for a significant screen and buffer that satisfy the general purpose of the Chapter 18.745. Accordingly, Applicant seeks a variance to the buffer width standard of 15" in order to allow applicant to reduce the buffer along the northwestern boundary to 8' between the fence and its proposed parking stalls. 6 of 7 Lot Line Adjustment: Statement of Purpose: 8725 SW Commercial Street is approximately .2 acres (surveyed at 8,562 square feet) with Commercial Street Access. 12645 SW Hall Blvd. is approximately .39 acres (surveyed at 16,628 square feet) with Hall Blvd. Access. The size of the required clear vision area depends upon the abutting street's functional classification and any existing obstructions within the clear vision area. ❑ WATER RESOURCES OVERLAY DISTRICT (Refer to Code Section 18.797.030) The WATER RESOURCES (WR) OVERLAY DISTRICT implements the policies of the Tigard Comprehensive Plan and is intended to resolve confli s between development and conservation of significant wetlands, streams and riparian corridors identified in the City of Tigard Local Wetlands Inventory. Specifically, this chapter allows reasonable economic use of property while establishing clear and objective standards to: pr• ect significant wetlands and streams; limit development in designated riparian corridors; maintain and enhance water quality; maximize flood storage capacity; preserve native plant cover; mini 'ize streambank erosion; maintain and enhance fish and wildlife habitats; and conserve scenic, recreational and educational values of water resource areas. The applicant will be required to submit a proposed storm drainage plan for the site, and may be required to prepare a sub-basin drainage analysis to ensure that the proposed system v ill accommodate runoff from upstream properties when fully developed. 1) Any areas that will be converted from gravel to paving must be accounted for. The applicant's engineer will need to evalgate the effective net increase in impervious area to determine if onsite detention is needed. If the net increase is over 5,000 sf, then onsite detention is needed. 2) If the applicant proposes to discharge storm water into the ROW of Hall Boulevard, they will need to obtain approval from ODOT. This will include extensive review from ODOT's Hydraulics Section in Salem. Storm Water Quality: The City has agreed to eriforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency 1(USA) (Resolution and Order No. 00-7) which requires the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from newly created impervious surfaces. The resolution contains a rovision that would allow an applicant to pay a fee in-lieu of constructing an on-site facility provided Specific criteria are met. The City will use discretion in determining whether or not the fee in-lieu will b offered. If the fee is allowed, it will be based upon the amount of new impervious surfaces creat d ; for every 2,640 square feet, or portion thereof, the fee shall be $210. The applicant must show on their plan how delivery vehicles will enter the site and unload equipment, stock, etc. The City Engineer will not approve any plan that would require vehicles to park in Commercial or Hall while unloading, back in from Commercial or Hall, or back out onto Commercial or Hall ITY OF TIGARD Pro-Application Conference Notes Page 4 016 Mooring Department Section RAFFIC IMPACT FEES In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIE) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance. In limited circumstances, payment of the TIF may be allowed to be deferred until the issuance of an occupancy permit. Deferral of the payment until occupancy is permissible only when the TIF is greater than $5,000.00. Pay TIF for change in use. ERMITS Public Facility Improvement (PFI) Permit: Any work within a public riht-of-way in the City of Tigard requires a PFI permit from the Engineering Department. A PFI permit, application is available at the Planning/Engineering counter in City Hall. For more extensive work 1 such as street widening improvements, main utility line extensions or subdivision infrastructure, plans prepared by a registered professional engineer must be submitted for review and approval. The Engineering Department fee structure for this permit is considered a cost recovery system. A deposit is collected with the application, and the City will track its costs throughout the life of the permit, and will either refurhd any remaining portion of the deposit, or invoice the Permittee in cases where City costs exceed the deposit amount. The Permittee will also be required to post a performance bond, or other such suitable security. Where professional engineered plans are required, the Permittee mu t execute a Developer/Engineer Agreement, which will obligate the design engineer to perform the primary inspection of the public improvement construction work. This permit is issued for all single and multi-family buildings. It covers all work necessary for ibuilding construction, including sub-trades (excludes grading, etc.). This permit can not be issued in a subdivision until the public improvements are substantially complete and a mylr copy of the recorded plat has been returned by the applicant to the City. For a land partition,�the applicant must obtain an Engineering Permit, if required, and return a mylar copy of the recorded plat to the City prior to issuance of this permit. Other Permits. There are other special permits, such as mechanical, electrical and plumbing that may also be required. Contact the Development Services Counter for more information. GRADING PLAN REQUIREMENTS F R SUBDIVISIONS All subdivision projects sh II require a proposed grading plan prepared by the design engineer. The engineer will also be required to indicate which lots have natural slopes between 10% and 20%, as well as lots that have natural slopes in excess of 20%. This information will be necessary in determining if special gradi g inspections will be required when the lots develop. The purpose of the meeting is to allow the prospective developer to share with you what they are planning to do. This is your opportunity to become informed of their proposed development and to let them know what issues or concerns you have in regard to their proposal. What Happens After The Neighborhood Meeting? After the neighborhood meeting, the prospective developer finalizes their submittal package (often taking into account citizen concerns) and submits an application to the City. Sometimes it takes a while before the developer's application is ready to submit, so there could be several months between the neighborhood meeting and the submittal of an application. Once an application is submitted to he City, Staff reviews it for completeness. Once an application has been deemed complete, the formal application review begins. It takes approximately 6-8 weeks from the time the application is accepted for a decision to be made. Many types of applications require a public hearing at which citizens are given the opportunity to provide comments or concerns. For all types of applications, property owners within 500 feet of the subject parcels receive notice of the public hearing (if applicable), notice of the decision, and are given the opportunity to appeal the decision. What If The Proposal Presented At The Neighborhood Meeting Is Not What Is Actually Submitted? Applicants are not required to submit exactly what was presented at the neighborhood meeting if it generally follows the type of development proposed. This provides for the opportunity to address the neighborhood issues and address other changes necessitated by the development or staff. If the project is entirely different, a new neighborhood meeting would be required. In any case, notice of decision is sent to property owners within 500 feet of the proposed development allowing them the opportunity to appeal. How Do I Know What Issues Are Valid? A decision is reviewed based on compliance with the Tigard Development Code. Review the development code to familiarize yourself with what is permitted and what may not be permitted. A copy of the development code is available for viewing at the Tigard City Library or a copy may be purchased at the Community Development Services counter. You may also contact City Planning staff and ask what the standards are for a specific issue. Be prepared, however, that you may not LIKE all the standards, but at least you know what they are. September 17, 2002 City of Tigard Community Development 13125 SW Hall Blvd. Tigard, OR 97223 RE: Water Quality Facility Dear Whom it may concern: The purpose of this letter is to address the feasibility of constructing a water quality facility on the existing site on Tax Lot(s)600 and 800 of Tax Map 2S 102AB. City of Tigard code requires an on-site treatment facility to be constructed if the net increase in impervious area exceeds 1,000 sf. The proposed improvements to the site,which are required by City Code,will create an additional 1750 sf of asphalt paving in the back of the site. The existing topography,which will not be changed,has elevations in the NW and SW corners that are approximately equivalent,and are the low points for the site. Storm runoff from the project currently flows directly into Commercial St. where it is picked up by a catch basin 250' to the NW. If a water quality facility were to be constructed on site, it would be impossible to drain into Commercial St. as is the current pattern. In order to be able to provide drainage,the existing storm system in Commercial St. would need to be extended to the site at a cost of approximately $10-15,000. In addition to the unavailability of existing drainage, the site itself poses several complications. A water quality facility would need to be constructed in the NW corner at the low point. The existing structures are only 3' away from the western property line; therefore,there is not adequate space between the structure and the property line to construct a pipe to convey the storm water out to Commercial St. Also,due to the small size of the site,a water quality facility would potentially preclude development by interfering with space necessary to achieve a vehicle turn- around.
