Adequate opportunity for recycling has been provided and the area where the franchise collects separated recyclable materials is at central locations accessible to the franchisee's hauling equipment; 5. OPERATIONAL STANDARDS At all times, the applicant and the compactor shall remain in compliance with the following requirements: • Compliance with any applicable federal, state, and local health, safety and environmental regulations including, but not limited to OAR 437 -02 -242 and the City's Solid Waste Management Codes (Chapter 11.04): • The compactor and surrounding area will be kept clean at all times; • The compactor will undergo regular preventive maintenance and adequate emergency maintenance shall be available; • The compactor and operation of the compactor shall remain in compliance with all representations made in the application for and the permit issued for the operation; and • There will be no operation of the compactor between the hours of 9:00 PM and 7:00 AM. SAFETY No stationary compactor or the other container for multi - family residential, commercial or industrial use shall exceed the safe loading design limit or operation of the collection vehicles provided by the franchisee serving the area. SIGN Each container shall be clearly labeled with the name, address, and telephone number of the permittee, and the name of the contact person. HEALTH Compactors containing putrescible waste shall be emptied at least weekly. REIMBURSEMENT FOR FINES Permittees shall reimburse the franchisee for any fines incurred by the franchisee for weight or environmental violations, or any other violation caused by the ownership, operation, or use of the compactor. The compactor are has adequate space for straight on access for our trucks to access the compactors. The compactors will sit parallel to the north side of the building, with access facing to the west and east. This placement will be acceptable to ensure our access of the compactors. The enclosure added to the drawing received 8/31/13 shows gates on both the east and west side of the enclosure. Both gates are 25'4" wide with full swing gates. These gates will work for us to access each compactor. Please make sure there are cane bolts and holes for the gates to be held in the open and closed positions. In answer to your questions: 2 1. The client will be dropping off the $100 Compactor Permit fee later today. 2. The difference between the two drawings is actually just in how the opening is dimensioned. The drawing we sent Pride showed 25'4' from centerline of gate post to centerline of gate post. The gate posts were 4" square, resulting in a clear width of 25' -0 ". Because Pride stated that the 25' -0" clear was the important dimension, we updated our drawing so that 25' -0" Clear was the dimension most evident to the contractor, in order to eliminate confusion. See attached e-mail from Kristin at Pride noting the 25' -0" clear required dimension. 3. The enclosure is 7' -0" tall minimum, with a 6' -0" solid portion with a 1' -0" minimum gap underneath. The area the compactors will be placed in is a former recessed truck dock area, and there is considerable variation in grades. The 1' -0" minimum clear at "closed" position allows assurance that the gate will clear any "high spots" as it opens. We've elected to continue the same "bottom" height all the way around for easy of construction and consistency. This will result in a maximum gap of about 2' -0" at the lowest grade. In response I have three comments: 1. I do not show payment of the $100 filing fee for a Solid Waste Compactor Permit. Please submit the required amount. 2. Please revise Sheet A8.8 to reflect the enclosure dimensions approved by Pride Disposal Company in their letter of September 6, 2013. More specifically, Pride approved a gate width of 25' 4 ", which is wider than the 25' shown on Sheet A8.8. 3. I have questions about the design of the trash enclosure. Is there a reason for the minimum 1' gap along the bottom of the fence and gate? Also, how tall will the gap be at its highest point? I'm trying to establish the overall height of the enclosure at its highest point. Please feel free to give me a call about this one. 3
