SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request, subject to the Conditions of Approval listed below. The findings and
conclusions on which the decision is based are noted in Section IV.
CONDITIONS OF APPROVAL
PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION,
THE FOLLOWING CONDITIONS SHALL BE SATISFIED
1. Prior to the city's signing of a DMV Land Use Compatibility Statement, the applicant shall remove
the unpermitted freestanding sign advertising"Martin's Auto Detailing" within the Pacific Highway
right of way,and call for an inspection by the Planning Division to verify its removal.
2. The applicant and/or owner shall obtain all necessary building permits for the freestanding
bathroom facility situated along the eastern facade.

THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject parcel is located at 11564 SW Pacific Highway. The project site is approximately 2.03 acres
in size and is composed of two tax lots and multiple structures that share a common access and parking
area. The structures and parking are concentrated on an upper portion of the two lots, with a lower
portion of the lot containing a gravel parking lot previously used as an impound yard by a towing
company. The front portion of the property contains a sales-oriented retail land use (Portland
Hydroponics) along the frontage of Pacific Highway, while the applicant operates a motor vehicle
service and repair business in a separate structure approximately 3,400 square feet and containing two
service bays the rear (Martin's Auto Detailing). Surrounding the project site are a variety of general
commercial land uses to the north, west, and east. Red Rock Creek and its associated vegetated
corridor abut the project site to the south..
Proposal Description:
The applicant has proposed adding motor vehicle sales to his auto-detailing business. Auto detailing
would continue to be performed in the northern service bay and in a covered portion of the existing
parking area. The southern service bay would be converted to a showroom for vehicles for sale. No
changes to the structure or site are proposed as part of the application.
A detached but unpermitted bathroom that serves the applicant's business is being included within the
project description in order to legalize the structure. For details regarding the structure, please see
Section IV below.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B
contains the following criteria for approval of a request for Minor Modification:
1. The proposed development is in compliance with all applicable requirements of this title;
The project would result in expand Martin's Auto Detailing from a single primary use to two primary
uses. Both the existing use (Motor Vehicle Servicing/Repair) and the additional use (Motor Vehicle
Sales/Rental) are permitted land uses within this zone. No modifications to the structure or site are
proposed. Minimum required parking remains the same for both land uses, and as such no additional
spaces are required.
During permit review, staff observed two land use violations on the site. These violations included an
unpermitted freestanding sign advertising"Martin's Auto Detailing"within the Pacific Highway right of
way, and a new freestanding structure housing a bathroom facility. Pursuant to 18.780.070.K, signs are
prohibited within the public right of way, unless legally erected by or for a government agency. The
second observed violation is an approximately 60 square foot detached bathroom that was constructed
without permit. Aerial photographs indicate the bathroom structure was built in the latter half of 2012.
There is no reason to believe the applicant cannot remove the sign or obtain building permits for the
detached bathroom, as the sign is cheaply made and the bathroom meets all development standards

contained within Table 18.520.2, and as a result conditions are being applied to ensure these violations
are addressed.
2. The modification is not a major modification.
The application does not exceed any of the thresholds for a major modification, or contain activities or
impacts that would trigger a major modification, as set forth in 18.360.050.B of the Tigard
Development Code. The project does not include a residential component, does not affect off-site
traffic, and does not increase floor area by more than 5,000 square feet. There will be no increase in
the required minimum parking. This criterion is met.
FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a site
development have been met or can be met through conditions of approval.

The City has reviewed your application of September 9, 2013 to establish a new business of
unknown scope at 11564 SW Pacific Highway. Unfortunately we have found it incomplete
and require additional information (listed below). If you would like to discuss these

1. Please revise the applicant's statement to more clearly define what type of business
activities you are proposing on the site. The narrative provided suggests auto sales,
but it's unclear and uncertain. Please expand and provide more details.
2. Please provide a detailed site plan for the entirety of the property, and not just a
floorplan. This is to include all paved circulation and parking areas, and a list of all
businesses presently on site including the square footage of building space dedicated to
each business.
This information is necessary to demonstrate compliance with the requirements of the Tigard
Community Development Code. If these changes are not made, we cannot find your
application consistent with approval criteria for a minor modification, and will be required to
deny your proposal.

Applicant Statement
I am currently renting two units plus some space to park cars and use for customer parking. One
of the units I am renting I will be using to detail cars.We will be using Martin's Auto Detailing to detail
the cars before we sell them.The second unit we have is a showroom to display the vehicles that are
ready for sale. Next to the showroom we have an office.
Outside we have two disabled parking spaces.We also have a built restroom for customers. In
front of the building we have parking spaces for customers.We have a gated entry that will lead to the
cars ready for sale. Both entries to the building and car lot are fenced and have locked gates to keep the
cars secured and protected. We also have two canopies set up for washing the vehicles.

BARGAIN AND SALE DEED
KNOW ALL MEN BY THESE PRESENTS,that Mark Lawrence and Mark Lawrence,
Trustee of the Mark E.Lawrence Revocable Trust,hereinafter called Grantor,for the consideration
herein stated,does hereby grant,bargain,sell and convey unto Greenland Group,LLC,hereinafter
called Grantee and unto Grantee's heirs,successors and assigns all of that certain real property with
the tenements,hereditaments and appurtenants thereunto belonging or in anywise appertaining,
situated in the County of Washington,State of Oregon,described as follows to wit:
See attached Exhibit A,incorporated herein by this reference.
Together with the portion of property accreting to said Exhibit A pursuant to the State of
Oregon,Department of Transportation Abandonment Agreement No.664;grantor further assigns
to grantee all of grantor's rights to grantor's leases and tenant agreements related to said property,
all rights to accrued and unpaid rent,and all other claims,including choses in action,including any
claims of trespass,related to the property being transferred.
To have and to hold the same and to the said Grantee and Grantee's heirs,successor and
assigns forever.
The true and actual consideration paid for this transfer stated in terms of dollars,is:"transfer
of a membership interest in Greenland Group,LLC to the undersigned;this transfer of property is
the initial capital contribution of the undersigned to Greenland Group,LLC for their membership
interest therein.
