SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 9285 SW Greenburg Road; south of SW Hall Boulevard and west of SW
Greenburg Road. The site, located within Washington Square Regional Center,is approximately 1 acre
and contains one commercial building and associated parking lot. The entire site has 30 parking spaces.
Proposal Description:
The proposed application is to modify the existing building to improve the appearance of the building
facade. The proposal includes extending the building parapet two feet above the existing parapet,
which is currently at 13 feet 9 inches. A section above the main entry, approximately 33 feet long,will
increase by 2 feet and 9 inches; for a total height of 16 feet 6 inches. The building height does not
increase by more than 20 percent. The material used on the building will not be corrugated metal or any
other materials prohibited in TDC 18.630.060 Washington Square Regional Center Building Design
Standards.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
The proposed change in use requires a Minor Modification to approved plans or existing
development. Section 18.360.060.0 states that a minor modification shall be approved,
approved with conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: Upon review of the proposal's plans and narrative, staff fords that the proposal
complies with all applicable requirements of this title. This includes but is not
limited to building height, setbacks, and parking requirements. Specifically, for
this proposal TDC 18.630.060 Washington Square Regional Center Building
Design Standards are the main concern. The applicant states within the
application materials that corrugated metal or any other materials that are
prohibited will not be used. In addition, in accordance with TDC 18.360.050
Site Development Review, the building height will not increase by more than 20
percent. This criterion is met.
2. The modification is not a major modification.
FINDING: Staff fords that the changes listed in TDC18.360.050.B.1-11 are either satisfied
or do not apply. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: The proposal is a minor modification of existing site development and is in
compliance with the applicable requirements of this title.

Project Scope: The project is an extension of an existing parapet of an existing retail store to
improve the appearance of the facade and allow signage on the face of the building that fronts
Greenburg Rd. The extension will be two feet above the existing parapet except for thirty feet
centered over the existing main entry on the East facade which will be two feet nine inches
above the existing parapet. The parapet will be faced with interlocking metal siding material at
the areas of the new extension.
Section 18.600 Community Plan Area Standards requires review of proposed projects
under certain conditions. The building location places the building within an area reviewed by
the Washington Square Regional Center Design Standards.
Section 18630.030 specifically addresses additions, expansions and enlargements for the
applicability of standards. The proposed project does not change the square footage of the
building and the proposed alterations do not extend beyond the existing footprint. The review
standard does not apply to the proposed project.
Section 18630.060 addresses design standards for new buildings and renovation projects.
A.1. Ground Floor Windows: The existing facade facing Greenburg Rd. has an existing
storefront covering more than 50%. This area will not be altered with this proposal.
A.2. Building Facades: The proposed alteration will change a straight roof parapet with
articulation at the area devoted to signage. The increased height is more proportional to
the overall mass of the building and the new metal siding material will provide a material
change at the main facade and a portion of the adjacent facade visible from Greenburg
Rd. There will be a presentation of four different materials in this area meeting the design
standard.
A.3. Weather Protection: There is an existing continuous awning extending five feet over
the two pedestrian entries. This will be replaced with a new awning..
A.4. Building Materials: The new material in the area of change will be high quality
interlocking metal siding material. The standard is met.

Land Use Approval- Extension Request
Mr. Fischer:
In your letter of December 22,2014,Jemma Co. LLC,as the owner and the applicant,requests a
one-year extension for the approval of Jemma Co. LLC Minor Modification (MMD2013-00034).
Tigard Development Code Section 18.360.030.D includes the following criteria for extensions:
The Director shall, upon written request by the applicant and payment of the required fee,
grant an extension of the approval period not to exceed one year; provided that:
The applicant submitted a written request on December 23,2014,and paid the $343 application fee.
The effective approval date for MMD2013-00034 was on September 5,2014 and is valid for an
eighteen month period through March 5,2015. The requested extension would be for one year, or
until March 5,2016. Provided the following standards are met,the approval may be granted.
1.No Changes are made on the original site development review plan as approved by the
Director,
The applicant states that no changes have been made to the plans that were approved for
MMD2013-00034. Therefore,the request is consistent with this criterion.
2.The applicant can show intent of initiating construction on the site within the one year
extension period;and
The applicant states that the plans were produced,a meeting was held with subcontractors,and a
supervising contractor was considered. The plan evolved into a tenant-specific solution;however,
this tenant arrangement was unsuccessful. The applicant is requesting the extension to allow for the
tenant plan to resolve itself. If it does not,then the applicant will proceed with the plan regardless.
The applicant's statement shows intent and satisfies the criterion.
3. There have been no changes to the applicable Comprehensive Plan policies and
ordinance provisions on which the approval was based.

To determine consistency with this criterion, the standards addressed in the findings for the
approval must be compared to any changes in the applicable provisions adopted by the City since
the September3,2013 application date for MMD2013-00034.The Tigard Development Code (TDC)
implements the City's Comprehensive Plan. No Comprehensive Plan goals are directly applicable to
the decision.The approval was based on the following chapters of the TDC:
18.520 Commercial Zoning Districts
18.630 Washington Square Regional Center Plan
Staff reviewed the period between September 3,2013 and January 7,2015 and found that there were
no substantive amendments to the applicable code sections during that period. Based on this review,
staff concurs with the applicant and finds that no substantive,applicable changes have occurred to
the Tigard Development Code on which the approval was based.
Therefore,the request is consistent with this criterion.
Conclusion
The Applicant has submitted a written request and paid the application fee. The criteria for
extensions have been met as indicated in the findings,above. Therefore, the Applicant is granted an
extension for MMD2013-00034 not to exceed one year,or until March 5,2016.

explanation,Jemma hired Tiland Schmidt Architects to produce a plan. It was produced.
Jemma met with subcontractors and has a contractor in mind to supervise the work. In the
beginning, the plan evolved into a tenant-specific solution. However, this tenant arrangement
did not did not work out.
We are asking for more time to allow for the tenant plan to resolve itself. If it does not, we
intend to proceed with the plan regardless.
Jemma has the funds to finance the work.

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 9285 SW Greenburg Road; south of SW Hall Boulevard and west of SW
Greenburg Road. The site,located within Washington Square Regional Center,is approximately 1 acre
and contains one commercial building and associated parking lot. The entire site has 30 parking spaces.
Proposal Description:
The proposed application is to modify the existing building to improve the appearance of the building
facade. The proposal includes extending the building parapet two feet above the existing parapet,
which is currently at 13 feet 9 inches. A section above the main entry, approximately 33 feet long,will
increase by 2 feet and 9 inches; for a total height of 16 feet 6 inches. The building height does not
increase by more than 20 percent.The material used on the building will not be corrugated metal or any
other materials prohibited in TDC 18.630.060 Washington Square Regional Center Building Design
Standards.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW
The proposed change in use requires a Minor Modification to approved plans or existing
development. Section 18.360.060.0 states that a minor modification shall be approved,
approved with conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: Upon review of the proposal's plans and narrative, staff finds that the proposal
complies with all applicable requirements of this title. This includes but is not
limited to building height, setbacks, and parking requirements. Specifically, for
this proposal TDC 18.630.060 Washington Square Regional Center Building
Design Standards are the main concern. The applicant states within the
application materials that corrugated metal or any other materials that are
prohibited will not be used. In addition, in accordance with TDC 18.360.050
Site Development Review, the building height will not increase by more than 20
percent.This criterion is met.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC18.360.050.B.1-11 are either satisfied
or do not apply. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: The proposal is a minor modification of existing site development and is in
compliance with the applicable requirements of this title.

Final Decision:
A Minor Modification is a Type I procedure. As such, the Director's decision is final on the date it is
mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not
