This will allow for a new eating and drinking establishment to occupy a vacant floor space within the shopping center. The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations,are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above requested Adjustment to the minimum parking requirements. The findings and conclusions on which the decision is based are noted in Section V of this Decision. SECTION III. BACKGROUND INFORMATION VAR2013-00008 PACIFIC TERRACE PARKING ADJUSTMENT Page 1 Site Information: The subject property is located north of SW Pacific Highway, east of SW 71" Avenue and west of 69`h Avenue. The 2.03 acre site is currently developed with four commercial buildings, a total of 34,877 square feet, with mixed use occupancies, and site improvements including landscaping and a parking lot containing 106 parking spaces. The property is zoned Commercial General (C-G) as are properties to the south, east and west;properties to the north are zoned Low Density Residential (R- 4.5) and Medium Density Residential (R-12). Site History In a search of city historical records, the construction of the shopping center occurred prior to 1987; however, exact year is unknown. The property was annexed into the city (ANNEX2344; Res. 87- 23) in February 1987. A minor modification (MMD2004-00008) was approved to allow a change of use from indoor entertainment to retail and another (MMD2013-00019) to accommodate a daycare in a space previously used for personal services. No other land use cases were found. Proposal Description: The applicant is requesting approval for an Adjustment to the minimum parking requirement from 117 spaces to 105 spaces (an 11% reduction). There will be no additional paving as the site currently accommodates 106 spaces. PUBLIC COMMENTS Staff mailed a notice of pending land use application to property owners within 500 feet of the subject site and to the Interested Parties list maintained by the city. Staff received a telephone inquiry from one property owner requesting clarification. The city received no written comments. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS A. ADJUSTMENT TO PARKING REQUIREMENTS Section 18.370.020.C.7.a states that by means of a Type II procedure, as governed by Section 18.390.040, the Director may authorize up to a 20% reduction in the total minimum vehicle parking spaces required in Section 18.765.070.H when an applicant for a development permit can demonstrate in a parking study prepared by a traffic consultant or in parking data from comparable sites that: 1. Use of transit,demand management programs, and/or special characteristics of the customer client employee and resident population will reduce expected vehicle use and parking space demand for this development, as compared to standards Institute of Transportation Engineers (ITE) vehicle trip generation rates and minimum city parking requirements, and; 2. A reduction in parking will not have adverse impact on adjacent uses. The applicant submitted a parking analysis, prepared by Susan Wright of Kittelson & Associates, Inc, dated July 8, 2013. Parking demand was observed on a typical weekday and weekend day (Saturday) and the peak periods of demand were IPM-4PM on a weekday and 11AM-2PM on Saturday. The table below illiterates the parking demand and utilization during peak hours. The table below demonstrates the parking demand and utilization. The report concludes that based on the parking counts, the shopping center has unique characteristics that result in significantly lower parking needs compared to typical parking rates generated by similar uses. In addition, several TriMet bus lines (Lines 12, 64 and 94) run within the vicinity along SW Pacific Highway and SW 74th Avenue. These lines provide both local and regional services to the Pacific Terrace shopping center. In accordance with TDC 18.765.070 and based on existing uses, the shopping center is required to provide 117 spaces. The 11 percent adjustment reduces the required spaces to 105 and currently 106 spaces exist. The table below summaries the Pacific Terrace shopping center parking calculation and adjustment request. B. IMPACT STUDY Section 18.390.040.B.2.e states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. VAR2013-00008 PACIFIC TERRACE PARKING ADJUSTMENT Page 3 The proposed parking adjustment will not impact parks, the sanitary sewer, water or drainage system, or transportation system. The adjustment will not result in construction of additional parking facilities or paving therefore, there will be no impact to the storm drainage system. The surrounding areas to the south, east, and west are similar commercial uses. The adjustment will not impact public facilities or services. This criterion is met. SECTION VI. OTHER STAFF COMMENTS The City of Tigard Building Department and Development Engineer provided no comments. SECTION VII. The following addresses the adjustment criteria in the Tigard Community Development Code: 18.370.020 C 7 (a) Reduction from minimum parking requirements. These stops are served by Trimet Route 12 (a frequent service route) that provides access to the Tigard Transit Center (for connections to WES and other bus routes), the Barbur Transit Center, and to downtown for access to other bus routes and light rail lines. Additional bus routes 94 and 64 can be accessed by walking to 74th Avenue and Pacific Highway. (2) A reduction in parking will not have an adverse impact on adjacent uses. • Response: The reduction in parking will not have an adverse impact on adjacent uses as there is ample parking to accommodate the existing shopping center tenants, Vine Gogh Artist Bar& Studio, and future tenants without parking spillover to adjacent properties. As noted on page 6 of the July 8, 2010 Parking Study, the existing weekday peak parking demand of the existing tenants was found to be significantly less than the code requirement for the occupied space. This indicates that the existing tenants generate a lower parking demand compared to the parking code. This is characteristic of a smaller shopping center without a large anchor tenant and is unlikely to change over time. In addition, the Vine Gogh Artist Bar and Studio's parking demand will occur in the evening, when the majority of the shopping center tenants have very little parking demand. Even so, the low parking demand rate of the existing tenants does provide adequate parking for Vine Gogh for day or evening operating hours. The existing weekday peak parking demand was found to be approximately 48 spaces and occur in the early afternoon at approximately 1:00 to 2:00 p.m. and remain steady until approximately 4:00 p.m. at which point it tapers down throughout the evening. Exhibit 1 shows the approximate parking demand of the existing land uses over the course of a typical weekday. The existing parking demand at the Pacific Terrace shopping center during a weekday at 6:00 p.m. (when Vine Gogh's parking demand is anticipated to start) is approximately 28 spaces. Parking demand was also reviewed on a Saturday and was found to be less than a weekday during both the midday and evening when Vine Gogh would be open. Saturday midday parking demand was found to be 32 spaces as compared to 48 spaces on a weekday.The Saturday evening parking demand was 13 spaces. It also includes provisions for reductions in the minimum parking requirements for developments with multiple tenants, such as the Pacific Terrace shopping center. These requirements were updated effective June 14th, 2013 providing lower minimum parking requirements for several land uses (including retail and eating and drinking establishments) as well as larger reductions for minimum parking requirements in mixed-use and multi- tenant developments. Table 2 shows the parking reduction factors assumed for the Pacific Terrace shopping center by land use type. All vacant land uses were assumed to be "Retail" except for the Vine Gogh Artist Bar and Studio, which was assumed to be an "Eating and Drinking Establishment," for the purposes of the parking code and determining the square footage totals by land use. Although 118 spaces is twelve spaces over the existing parking supply of 106 parking spaces, a review of existing parking demand indicates that the site has adequate parking available to accommodate Vine Gogh Artist Bar and Studio, as well as to accommodate the remaining retail vacancies. As shown in Exhibit 1, the peak parking demand of the existing tenants is approximately 48 parking spaces. This is significantly below the parking code requirement for the existing uses of 81 spaces (a surplus of approximately 33 spaces). This is due in part to the characteristics of the shopping center not having an anchor tenant. All of the tenants are relatively small in size and more similar to specialty retail than traditional retail which has a significantly lower trip generation rate as well as a significantly lower parking demand rate. In addition, Vine Gogh's Artist Bar and Studio will not generate significant parking demand until approximately 6:00 p.m. when the majority of the existing tenants are beyond their peak parking demand. Similar to the existing Sellwood site operations, Vine Gogh's Artist Bar and Studio may operate one class per week for children which start at 4:00 p.m. Attendance is typically lower for these events, beer and wine are not served, and the parking demand is more similar to the Day Care parking characteristics where vehicles are parked briefly for drop-off and pick-off. FINDINGS AND CONCLUSIONS Although the site is approximately twelve parking spaces short of meeting the parking code requirements, the site has adequate parking available to accommodate Vine Gogh Artist Bar and Studio, as well as to accommodate the remaining retail vacancies based on the following findings: • The existing parking supply for the Pacific Terrace shopping center includes a total of 106 parking spaces. • The existing weekday peak parking demand was found to be approximately 48 spaces while the code requirement for the existing tenants requires approximately 81 spaces (creating a surplus of approximately 33 spaces). This indicates that the existing tenants generate a lower parking demand compared to the parking code. This is characteristic of a smaller shopping center without a large anchor tenant and is unlikely to change over time. • The existing peak parking demand occurs in the early afternoon at approximately 1:00 to 2:00 p.m. and remains steady until approximately 4:00 p.m. at which point it tapers down through the evening.
