The site is located at 12930 SW Scholls Ferry Road, and is described as WCTM 1 S133AD-00900. The Tigard Community Development Code, Conditional Use Section, requires a new Conditional Use application if the requested modification meets any of the major modification criteria. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The applicant is not proposing a change in land use. 2. A 10% increase in dwelling unit density; There are no dwelling units associated with this project. This criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The proposal is to relocate the play ground to a location that is within the existing and approved play field. This move would not affect access ways or parking areas. This criterion is satisfied. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The proposal does not affect any floor area of the approved buildings. This criterion is satisfied_ 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; The applicant is proposing to relocate the playground, and the original space is going to remain in open space. This criterion is satisfied. 6. A reduction of specified setback requirements by more than 20%; The relocation will actually increase the setback from 20 feet to the nearest residential property to 25 feet. This criterion is satisfied. 7. An elimination of project amenities by more than 10°/a where previously specified provided such as: (1) Recreational facilities; (2) Screening; or 13125 SW Hall Blvd., Tigard, OR 97223 (503)639-4171 TDD (503)684-2772 (3j Landscaping provisions; and This proposa� would not eliminate any of the project amenities; rather it would relocate one of the amenities. 8. A 10% increase in the approved density; Density is not a conside�ation of this project, as there are no dwelling units associated with the use. This criterion is not applicable. ' • . - � Minor Modification Type I Application Applicant's Statement 1. An increase in dwelling density or lot coverage for residential development Our request for modification has nothing to do with residential development or dwelling units. We simply want to relocate our playground from one location on our site to another location, so as to better protect neighbors from noise. 2. A change in ratio or number of different types of dwetling units. We are not constructing or tearing down dwelling units. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. I do not see that Chapter 18.765 requires us to have additional parking to accommodate the relocation of our private playground. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. There are no changes to any of our buildings necessary in order to relocate our playground. � 5. An increase in the height of the buildings by more than 20%. I do not anticipate needing to raise any of our buildings to relocate our playground. 6. A change in the type and location of accessways and parking areas where off- site traffic would be affected. There are no changes in the type or location of any accessways or parking areas required to accommodate relocating the playground. 7. An increase in vehicular traffic to and from the site and increases can be expected to exceed 100 vehicles per day. There will be no impact on traffic to and from the site as a result of playground relocation. 8. An increase in the floor area proposed for a non-residential use by more than 10% excluding expansions under 5,000 square feet. We �vill not be adding to any of our buildin�s to move the playground. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space by more than 10%. The area the playground is moving to was intended to be used as a general playfield. Only a portion of the playfield (approximately 1/3) will be taken up by the playground. In addition, the area originally slated to be playground will be turned into open space. 10. A reduction of project amenities (recreational facilities, screening, and/or landscaping provisions) below the minimum established by this code or by more than 10% where specified in the site plan. There will be no reduction in project amenities as a result of relocating the playground. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of Criteria 1 through 10 above. At the time of our site plan approval, the playground was to be located directly to the east of our church office building. Restrictions were placed on the playground to protect the neighbors directly to the east from noise and disruption due to the close proximity of the playground to the east property line. Relocating the playground to the playfield area moves the main body of playground equipment much farther from any of our property lines (ten feet from the property line was the limit under Section E, Item#14, Section A of the Conditional Use final ruling). The new location will place the main body of equipment at least 50 feet from the south property line, with no equipment closer than 25 feet to the south property line.
