Mr. Hasting:
This letter is in response to your request to construct an
accessory carport structure. Upon review of the applicable
approval criteria the Director has approved this request subject to
the following condition of approval :
1. The accessory structure model selected shall be no more
than 15 feet in height .
We would suggest that the carport be constructed a minimum of an
additional five feet to the east to avoid building over the sewer
easement. Related to this change the structure would also be
required to comply with any Uniform Building Code requirements for
minimum setbacks between two accessory structures .
The easement document you submitted with this request allows the
neighboring property owner to trench and repair the private sewer
provided that your property is restored to its previous condition
upon completion of the work.
Given the age of this line repair may be necessary at some point .
Due to the proposed location of the structure such a repair would
require temporary relocation of the carport and reconstruction of
any paved surfaces .

APPLICATION INFORMATION
ACCESSORY STRUCTURES
PART I - ACCESSORY ,STRUCTURE APPROVAL PROCESS
An Accessory Use review shall be required for the types of accessory
structures noted below:
A. Definition:
Accessory structure means a subordinate structure located on the lot, the
use of which is clearly incidental to • and associated with the' principal
structure. Where an accessory structure is attached to the principal
structure,' in a substantial manner, as by a roof., • such ,accessory . structure
shall be considered as a part of the principal structure. Examples of
accessory structures are barns, garages, carports, playhouses, sheds,
shelters for domestic animals, private greenhouses, ' gazebos, storage
buildings, boat houses and docks, wind generating devices, swimming pool
pump houses, and radio and television receiving antenna towers and - .
dishes.
B. The review , by the Planning Director of accessory structures shall be
required except for the following situations:
1. Buildings or structures within residential zoning districts which are
less than 120 square feet in gross floor area and less than 10 feet
in height, measured from base to highest point of structure.
2. Accessory buildings within commercial and industrial zoning districts
provided the setback requirements of the underlying zone are met. If
the structure represents an expansion of the existing primary use by
50 percent , or more, it must be reviewed as a Site Development Review
as outlined in Chapter 18'.120 of the Community Development Code.
3: Fences and walls within all zoning districts. Fences and walls shall
be consistent with section 18. 100.040 of the Community Development
Code.
C. All the provisions and regulations of the underlying zone apply unless
modified by other provisions contained herein.. • .
D. The application and approval process is a two-step procedure which
involves:
1. A Preapplication Conference .
Prior to submission of an Accessory Structure application, the
applicant must make an appointment with the Planning staff to discuss
the proposal as it relates to the applicable requirements.

2. Staff Approval of the Application
The preliminary application for an Accessory Use permit will be
approved, approved with conditions, or denied by the Planning
Director based on the applicable criteria contained in Part II
below. Notice of the decision will be given by the Planning Director
as provided in the Community Development Code.
E. Following .approval, the applicant must comply with all conditions .-of
approval prior to issuance of Building Permits.
F. Additional standards and required applications:
1. Sensitive Lands Area
If the proposed accessory structure involves land in a sensitive
'lands area, floodplain, drainway, greenway or steep slope area, you
will be required to complete the appropriate application form. and
submit it for approval as a part of this application.
2. Variances to the Provisions of Community Development Code
If your proposal does not meet the standards contained in the Code,
you will be required to complete the appropriate variance application
form and submit it for approval as part of this application.
PART II. ACCESSORY STRUCTURE APPROVAL CRITERIA
A. Accessory structures or buildings shall comply with all requirements 'for•.
the principal structure, except where specifically modified by Section B.
below.
B. If an application proposed for an accessory structure meets the following
criteria,. the Director shall approve the application proposal.
1. For parcels within a residential zone that are less than 2.5 acres in
size, any accessory, building within a residential zone shall have no
more than 500 square feet of gross floor area.
2. For parcels within a residential zone that are 2.5 acres in size •or
larger, any accessory building shall have no more than 1,000 square
feet of gross floor area.
3 . In no case shall the accessory building(s) and principal structure
exceed. the maximum' lot coverage allowed by the applicable zoning
district./
4. No accessory building or structure shall be allowed in any required
front yard. .
5. Except as provided in Section 6. below, accessory structures in
residential zones shall maintain a rear and side yard setback of 5
feet. Accessory structures within commercial and industrial zones
shall comply with the setback requirements of the applicable zone.

6. All freestanding and detached towers, antennas, wind generating
devices and TV receiving dishes shall have setbacks equal to or
greater than the height of the proposed structure. Suitable
protective anti—climb fencing and a landscaping planting screen, in
accordance with Chapter 18. 100 (LANDSCAPING AND SCREENING) of the
Code, shall be provided and maintained around these structures and
accessory attachments. .
• ' 7. • The . applicant, shall present documentation of the possession of any
required license by any federal, state, or local agency.
8. Any accessory building or structure attached to the principal
building- or structure must comply. with all setbacks of the applicable
, zoning district. (Attached means wall—to—wall or any permanent roof .
attachment such as breezeways).
9. No accessory building or structure shall encroach upon or interfere
• with the use of any adjoining property or public' right—of7way
including but not limited to streets, alleys, and public or private
easements.
10. An accessory structure shall not exceed an average height of 10 feet,
but at no point shall exceed 12 feet in height, (As defined in
Section 18.26.030 of the Code; See Chapter 18.98 BUILDING HEIGHT
LIMITATION, EXCEPTIONS) .
11. TV receiving dishes may be erected upon he roof of a structure only
within a commercial or industrial zone.
12. All accessory structures shall be built in . accordance with the
Uniform Building code.
C. Accessory structures which are nonconforming are subject to the
requirements of Chapter 18.132 (NONCONFORMING SITUATIONS)of the Code,
where an alteration, extension, or reconstruction is requested.
0. In instances where an alteration, extension, or reconstruction is
requested, the applicant shall apply for an accessory structure as
outlined herein.
E. A conflict of interpretation concerning whether a structure is an
accessory structure shall be resolved in accordance with the provisions of
Section 18.32.090 of the Code.

PART III. APPLICATION SUBMISSION REQUIREMENTS
AlI applications 'shall be made on forms provided by the Director and shall, be
accompanied by: '
A. Three copies for review by the Director of site plan(s) and necessary data.
} or narrative which explains how the accessory structure proposal conforms
to the applicable standards: .

drawings should preferably be drawn on sheets not exceeding 18" x
24"; and
2. The scale of the site plan shall be an engineering scale.
•` 3. All .drawings of structure elevations. shall be at standard
..1•: architectural, scale, being 1/4" or 1/8".
B. A, list of the: names and addresses of all who are property owners of record
within 250 feet of the site.
C. One copy of a current assessor' s map.
D. The required fee.
The proposed accessory structure site plan shall include the following
information:
A. The location of all existing and proposed structures on the site and .
directly abutting the site and their orientation;
B. The .locations of existing and proposed utility lines and easements;
•
C. The location of any streets abutting the site; .
• D. The location of any accessway to the proposed structure;
E. The size (square footage) of the accessory structure; and
' F. A copy of all existing and proposed restrictions or covenants . . .
The proposed accessory structure architectural plans shall include the
following information: .
• A. At least two elevations of any proposed structure; and
B. When a building permit is required, all structural drawings and data
required_ by the Uniform Building Code. .
