SUMMARY OF THE REQUEST The applicant requests approval of a conditional use permit to remodel an existing ding church by adding. an acolytes' preparation room and small chapel to an existing sanctuary, converting an eatitting parish hall to offices and a new entry, and adding a two-story parish hall and Sunday school wing to the church. The applicant will add 10,190 square feet and remove 1895 square feet for a net addition of 8295 square feet. Hearings Offfcer Larry Epstein held a duly noticed public hearing regarding the application on January 23, 1995, City staff recommended conditional approval of the permit. The applicant accepted the Staff Report and recommended conditions of approvals except several conditions that require the applicant to make frontage improvements along Bull Mountain Road and to install utilities underground or a pay a fee in lieu thereof. Instead the applicant proposed to defer the frontage improvements and utility work or payment until a local improvement district is formed to Improve a larger portion of SW Bull Mountain Road. Four witnesses testified in favor of defening the road improvements, arguing frontage improvements would be unsafe, inefficient and costly. No one else appealed at the hearing or submitted written testimony about the appli.czttion. The hearings officer cloned the record at the end of the hearing and took the case under advisement. City planner Will D'Andrea and engineer Michael Anderson testified for the City. Mr. D'Andrea summarized the staff report and recommendation. In response to comments from Washington County, Mr. Anderson testified that condition of approval 4 is intended to require the applicant to comply. wit!), County requirements, but it could be made more clear that the applicant is required to obtain certification of sight distance and to grant a non - access reservation except at approved access points. Mr. Anderson also testified that condition 5 should be modified to require dedication of a storm drEan easement for a new catch basin at the northeast corner of the property and access to the easement. 3. Architect Lane Brown testified for the applicant. He accepted the Staff Report and recommended conditions except requirements for frontage improvements and for under grounding power lines in conditions of approval 2, 3, 4, 8 and 9 He submitted seven photographs showing conditions along Bull Mountain Road at the site. a. He argued against street improvements recommended by City staff along Bull Mountain Road (i.ei, paving to 22 feet from the centerline of the road with a curb and 6 foot wide sidewalk) for the following reasons. (1) At the east end of the sidewalk, pedestrians would move from the sidewalk to the shoulder at a point with poor sight distance because of trees on the neighbors property to the east; trees on the property to the east would prevent motorists from seeing pedestrians coming onto the shoulder of Bull Mountain Road from a sidewalk abutting the church property. He argued it is safer for people to walk on the paved shoulder, because they can be seen more easily by traffic, Also, because of the grade difference between the site and the neighboring property to the east, a retaining wall about three feet high would be needed at the end of the walk, (2) At the west end of the sidewalk, there is a catch basin which obstructs its westerly extension. Because there is no street lighting at the site, motorists might fail to see a pedestrian emerging onto the street from the sidewalk or the pedestrian might accidentally walk off the sidewalk into the catch basin. (3) Also he argued, because parking is not allowed along Bull Mountain Road and no bus service is available, the , sidewalk would not be usable by pedestrians from vehicle parking or transit access. West of the church is a subdivision of lots with access to streets internal to the subdivision and not to Bull Mountain Road. The City could require trimming or removal of trees in the right of way if necessary to improve sight distance. The transition from the sidewalk to the shoulder could be situated where sight distance can be maximized, even if the sidewalk does not extend to the edge of the property. (2) Installing utilities underground or paying a fee in lieu thereof does not create a potential safety hazard, because it does not affect sight distance or other characteristics ` s that contribute to motorist or pedestrian safety, except to the extent that, by installing utilities underground, safety is improved by removing one obstacle to people and vehicles - -- power poles. c. The hearings officer finds that it :3 unlikely that street improvements would be extended in the foible future, because the properties adjoining the site's Bull Mountain Road frontage already are developed. Therefore, the frontage improvement can be deferred consistent with CDC section 18.164.030.A.1.c if that improvement does not represent a significant improvement to street safety or capacity. (1) The hearings officer finds that the evidence is not overwhelming, g but the frontage improvement in this case does provide a significant improvement to street safety by providing a more improved, grade- and /or distance- separated pathway for pedestrian and cyclists along the relatively large frontage of the church. V1 SITE VISIT BY HEARINGS OFFICER The hearings officer visi ted the site and surrounding area. He observed the existing access, structures, vegetation, and grades on the site and adjoining property and the condition of the adjoining street. '/LL CONCLUSION AND DECISION I. The hearings officer concludes that the proposed conditional use permit does or can comply with the applicable criteria and standards of the Community Development Code, provided development iat occurs after this decision complies with applicable local, state, and federal laws and with conditions of approval warranted to ensure such compliance occurs. 2, The applicant's request, CUP 95-0009, is hereby approved, subject to the conditions in Section VII of the Staff Report, with the following amendments: a. Condition of approval 4 is hereby amended to read as follows: The applicant shall obtain a facility permit from the Department of Land Use and Transportation of Washington County to perform work wits the right-of-way of SVV Bull Mountain Road. A copy shall be provided to the City Engineering Department prior to issuance of a Public Improvement Permit.. Testimony). These exhibits are filed at the Tigard City Hall. 2. City planner Will D'Andrea and engineer Michael Anderson testified for the City. Mr. D'Andrea summarized the staff report and recommendation. In response to comments from Washington County, Mr. Anderson testified that condition of approval 4 is intended to require the applicant to comply with County requirements, but it could be made more clear that the applicant is required to obtain certification of sight distance and to grant a non access reservation except at approved access points. Mr. Anderson also testified that condition 5 should be rihodified to require dedication of a storm drain easement for a new catch basin at the northeast corner of the property and access to the easement 3, for the applicant. He accepted the °Staff Report Architect conditions except for frontage improvements and for under and teconimended eo p requirements grounding power lines in conditions of approval 2, 3, 4, 8 and 9. He submitted seven photographs showing conditions along Bull Mountain Road at the site. a. Bull Mountain Road. 4. Church members John Burgess and John Swiski agreed with Mr. Brown, Mr. Swiski testified he runs along the paved shoulder of Bull Mountain Road regularly, and a brief section of sidewalk abutting the church is not necessary. Church Pastor Douglas Hadley agreed with the other witnesses, and testified that the improvements should be coordinated in a timely manner. The improvements would be costly for the church alone, particularly if the church has to improve the frontage within 200 feet of the site S. Mr. Anderson argue „1 the conditions of approval for frontage improvements are required by the CDC, including consideration of improvements necessary within 200 feet of a site and those improvements cannot be deferred unless it complies with the CDC. Deferring the improvements in this case does not comply with those standards He argued the cost of improvements is less if those improvements are made privately as part of an adjoining development He said that the local improvement district (LID) process adds about 30 percent to the costs of improvements. He stated that the sidewalk does not have to be contiguous to the curb, but that it can meander away from the street so that trees can be avoided, That and other design measures can make the ends of the sidewalk safe. He argued the improvements are timely, because the expansion of the church will increase its impact on the road and increase the need for pedestrian features to accommodate them. He noted that surrounding property is developed and does not have direct access to Bull Mountain Road, so the owners of that property have little motivation to join an LID to improve that road. The City and County have no plans to improve Bull Mountain Road. 6„ In rebuttal, Mr. Brown repeated concerns about the grade differences between this site and adjacent properties and safe sidewalk endings at the east and west property lines. Mr. Cooper, a. neighbor, argued the improvement would be piecemeal and untimely. Mr. Burgess repeated concerns about the high cost of the required improvements. Mr. Anderson noted that the applicants can try to form an LID to pay for the improvements. 7. The hearings officer incorporates by reference the NPO and agency comments in Section IV of the City of Tigard Staff Report The hearings officer notes that the conditions of approval recommended by City staff do not explicitly include all of the infonrotion recommended by Washington County DUN. V. EVALUATION OF REQUEST 1. City staff recommended approval of the application based on thelindings in the Staff Report and subject to conditions of approval as amended at the hearing, The applicant largely accepted the findings and recommended conditions, as amended, without correction or objection, The applicant objected to conditions of approval 2, 3, 4, 8 and 9 for the reasons described herein. Washington County DLUT recommended additional conditions. 2. The hearings officer finds that the proposed conditional use permit does or can comply with the applicable standards of the CDC, based on the findings in Section V of the City of Tigard Staff Report, and the following findings. 3. CDC section 18,164.030,A.1 requires an applicant for development to improve streets adjoining the site, including pedestrian and utility improvements. Motorists have a responsibility to be watchful for pedestrians on the shoulder. The City could require trimming or removal of trees in the right of way if necessary to improve sight distance. The transition from the sidewalk to the shoulder could be situated where sight distance can be maximized, even if the sidewalk does not extend to the edge of the property. (2) Installing utilities underground or paying a fee in lieu thereof does not create a potential safety hazard, because it does not affect sight distance or other characteristics that contribute to motorist or pedestrian safety, except to the extent that, by installing utilities underground, safety is improved by removing one obstacle to people and vehicles --- power poles. c. The hearings officer finds that it is unlikely that street improvements would be extended in the foreseeable future, because the properties adjoining the site's Bull Mountain Road frontage already are developed. Therefore, the frontage improvement can be deferred consistent with CDC section 18.164.030.A.1.c if that improvement does not represent a 'significant improvement to street safety or capacity. (1) The hearings officer finds that the evidence is not overwhelming, but the frontage improvement in this case does provide a significant iroproverrient to street safety by providing a more improved, grade- and/or distance separated pathway for pedestrian and cyclist's along the relatively large frontage of the church. (2) There was some dispute about the need for such a feature and, therefore, the sigmfi° cance of it. However, the hearings officer finds there is a need for enhancing pedestrian and bicycle features to the standards required by the CDC, Although there is a paved shoulder for pedestrians along Bull Mountain Road, that is not the safest facility, because of its proximity to and common surface with the road. People now walk, run and bicycle along the church frontage based on the oral testimbny, sometimes to attend church activities. A sidewalk also would enhance safety for people who are dropped-off along Bull Mountain Road to attend church activities. In the future, Tri-Met bus service can be provided along that road even if it is not provided now In part, the relatively large size of the church frontage ,nakes the improvement significant, even though incremental. (3) The incremental improvement is related and proportionate to the impact of the church and its expansion, It is consistent with City standards and practices to require the improvements in this case, and, therefore, to recognize that the improvements are needed and significant enough to require them in this case, d. The hearings officer finds frontage improvements (including utility improvements or fees) are not in conflict with an adopted capital improvement plan and are not related to a land division. e. The hearings officer finds frontage an' provements (including utility improvements or fees) can be done without additional planning work to define the appropriate design standards for the street in this case. The City can rely on adopted standards and modifications to those standards permitted by law. f. The hearings officer rinds the cost of frontage improvements is not relevant to whether the unit provements should be deferred, because cost is not one of the considerations in CDC section 18,164.030.A.1.c. Chapter 18,150 requires a permit and contains standards for removal of trees having a trunk 6 inches or more in diameter measured four feet above the ground on undeveloped residential land. A permit for tree removal must present rationale which complies with specified criteria in order to obtain approval. 13. Chapter 111,1_64 contairls standards for streets and utilities. a. Section 18.164,030(Al requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section ja,16.1,11325.1 requires Major Collector streets to have a minimum 60 foot right-of-way and a 44 foot minimum roadway width, and 2-4 moving lanes. c, Section 18.164.090 requires sanitary sewer service. d. Section 18,164.100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. B. Applicable Comprehensive Plan Policies. 1. Policy 2,1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planing and development review process. 2. Policy 4.2.1 provides that all development within the Tigard urban planning area shall comply with applicable federal, state and regional water quality standards. 3. This proposal is consistent with the applicable approval standards, As indicated on the site plan, the site will provide adequate area for the proposed expansion. Site characteristics are suitable for the expansion as the site contains adequate area and does not contain physical constraints, Adequate public facilities are present and currently serve the site or shall be provided by conditions of approval. Compliance with the applicable zoning district requirements, Conditional Use review and Comprehensive Plan Policies can be satisfied by this proposal as demonstrated by the analysis presented within this report and review process. Section 11121212EI,111 is satisfied. The subject site is approximately 2.4 acres, well in excess of the minimum 20,000 square foot lot area. As indicated on the site plan, the building is in compliance with setback standards, Section 18,46, The applicant is proposing to expand an existing church facility. A church is classified in code section 18442 (Use Classifications) as Religious Assembly. The proposed structures are in compliance with height limitations, The conditional use criteria for a church also requires increased setbacks for buildings over 45 feet in height. This criteria is not applicable as the proposed additions are not greater than 45 feet in height. Section 18,100.015. This requirement has been satisfied as the applicant has submitted a plan indicating the type and location of trees and shrubs, and as addressed in the applicable sections below. Section 111.0. This requirement shall be satisfied as the site plan shows the addition of two new street trees. Section 1 100110(A). The preliminary p lan indicates the provision of 67 parking spaces. Based on the ratio of one tree per seven spaces, the applicant is required to provide approximately 10 parking lot trees. The site plan shows 11 parking lot trees, located within the existing landscaped area. Existing landscaping screens the parking lot from view, thereby satisfying the screening requirement, Section 18.102.020. As shown on the site plan, the vision clearance requirements are satisfied. Section 18.10 §.030111(8). The proposal does not include increasing the area of the sanctuary, therefore this application will not require the addition of required parking spaces. The site plan shows the provision of 5 bicycle parking spaces, thereby satisfying this criteria. Section 18.108.080, This section satisfied as the plan provides for two, 24 foot access drives. The preliminary site plan shows the provision of a walkway connecting the front entrance of the building with the sidewalk along SW Bull lviountain Road, thereby satisfying this requirement, Section. i 14.130 A1. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Plcnning Division. Section 18.150,. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. PUBIC FACILITY CONCERNS: Sections 18.164:030 (Streets), 18.164.090 (Sanitary Sewer), and 18,164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The existing parking lot for the church currently has two one -way driveways that connect to SW Bull Mountain Road, a Major Collector street as shown on the City Comprehensive Plan. SW Bull Mountain Road is also a Washington County road. No change is proposed to the onsite driveway system. The existing right-of-way for SW Bull Mountain Road, as measured from the centerline of street, is 20 feet wide. The right - of-way required to match the existing dedications to the west is 35 feet. The applicant should be required to dedicate the additional right -of -A. vay. The existing roadway consists of a 32 foot wide asphalt concrete pavement that provides one 11 foot wide vehicular and one 5 foot wide pedestrian lane in each direction. The standard condition of approval for this type of development is to require one -half street improvements along the entire frontage. The applicant has requested that the improvements be deferred to the future when a Locg Improvement District is formed to improve a larger portion of SW Bull Mountain Road that would include the project frontage. The Engineering Department has reviewed the topographic constraints at the site and would suggest that an alternative sidewalk location may be justified to save the cedar HEARINGS OFFICER. - CUP 94 -0009 ST. The widening of the existing street can be accomplished without any unusual circumstances, except that a portion of the proposed sidewalk should be located in an easement on private property, to align with a grade compatible with the adjoining properties and the existing trees. As noted, there are power poles and overhead lines on both sides of the street, and the applicant should be required to place these facilities underground, or pay the fee in -lieu of undergrounding. The existing building is connected to the existing 8' public sanitary sewer in SW Bull Mountain Road and no changes are proposed. The sewer has sufficient capacity for the proposed addition. 3. STORM DRAIN The site slopes in a northeasterly direction to the 6" storm drain located in an easement on the adjoining "Shadow Hills" subdivision. The storm drain should be extended onto the site to a point located a minimum of 5 feet southerly of the northerly property line and a catch basin constructed to City standards. In addition, a storm drain easement should be dedicated to the City for access and maintenance of the storm drain. A .1' • The drainage from the additional impervious area created by the new construction should to be directed to a new on -e4te Swale, from the end of the existing on -site "daylight" storm drain, to the new catch basin. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective develop ment. ", the fee may apply. It is our op iniot that this site p P Y p is consistent with this criteria, and we recommend that a fee in -lieu be required. 2. Compliance_ volt i Comprehensive. Policy 2.1 i 1 is satisfied as the applicant was required to hold a neighborhood meeting with nearby property owners, notice of the application amid public hearing on this item was provided to the Citizen i Involvement Team West Representative, to owners of property in the vicinity of the site and in a newspaper of general circulation. The site has also been posted with a sign which states that a land use development application is pending for this property. 2. 'Water Quality. Policy 4.2.1 is satisfied as the applicant is paying a fee as established under the guidelines of Unified Sewerage Agency Resolution and Order No. 91 -47. 3, Public Facilities and Services. The conditional use complies with Policies 7.1.2, 7.3.1, and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. Public facility services were provided in conjuction with the construction of the existing facility and are adequate to serve this proposal. Where services are substandard the applicant has been conditioned to upgrade those services. 4. _> nsp i .. Section 18,100.030 (Street Trees) states that all development projects fronting on a public, private street, or a private driveway more than 100 feet in length shall be required to plant street trees in accordance with the standards in Section 18,100.035. Section 18.100,035(A) requires that landscaping in the front and exterior side yards shall include trees with a minimum caliper of two inches at four feet in height as specified in the requirements stated in subsection 18.100.035(B), Section 18.100.035(B) requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium, or large). c. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect, The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. 7. Section 18,102 i020 (Visual Clearance) requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway, A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or pernnanent obstruction exceeding three feet in height, T he code 'MA RIM I'S OFFICER CUP 94 -0009 ST. A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right -of -way and the driveway and then connecting these two 30 foot distance points with a straight line. 8. Section 18.108,080 (Access and Circulation - Minimum Requirements) requires that uses which provide less than 100 parking spaces provide a minimum of one accesss with a width of 30 feet. This proposal is consistent with the applicdle approval standards. As indicated on the site plan, the site will provide adequate area for the proposed expansion. Site characteristics are suitable for the expansion as the site contains adequate area and does not contain physical constraints. Adequate public facilities are present and currently serve the site or shall be provided by conditions of approval. Compliance with the applicable zoning district requirements, Conditional Use review and Comprehensive Plan Policies can be satisfied by this proposal as demonstrated by the analysis presented within this report and review process. Section 18.130.150(C)(10) is satisfied. The subject site is approximately 2,4 acres, well in excess of the minimum 20,000 square foot lot area. As indicated on the site plan, the building is in compliance with setback standards. Section 18.46, The applicant is proposing to expand an existing church facility. The proposed structures are in compliance with height limitations, The conditional use criteria for a church also requires increased setbacks for buildings, over 45 feet in height. This criteria is not applicable as the proposed additions are not greater than 45 feet in height. Section 18,100.015. This requirement has been satisfied as the applicant has submitted a plan indicating the type and location of trees and shrubs, and as addressed in the applicable sections below. Section 18.100.030. This requirement shall be satisfied as the site plan shows the addition of two new street trees. Section 18.100.110(.�). The preliminary plan indicates the provision of 67 parking spaces. Based on the ratio of one tree per seven spaces, the applicant is required to p rovide approximately 10 parking lot trees. The site plan shows 11 parking lot trees, located within the existing landscaped area. Existing landscaping screens the parking lot from view, thereby satisfying the screening requirement. This requirement will be satisfied as a tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. PUBLIC FACILITY CONCERNS: Sections 18,164.030 (Streets), 18,164.090 (Sanitary Sewer) and 18.164,100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The existing parking lot for the church currently has two one-way driveways that connect to SW Bull Mountain Road, a Major Collector street as shown on the City Comprehensive Plan, SW Bull Mountain Road is also a Washington County road, No change is proposed to the orisite driveway system. The existing right-of-way for SW Bull Mountain Road, as measured from the centerline of street, is 20 feet wide, The right-of-way required to match the existing dedications to the west is 35 feet. The applicant should be required to dedicate the additional right-of-way. The existing roadway consists of a 32 foot wide asphalt concrete pavement that provides one 11 foot wide vehicular and one 5 foot wide pedestrian lane in each direction. The standard condition of approval for this type of development is to 4 require one-half street improvements along the entire frontage. The applicant has requested that the improvements be deferred to the future when a Local Improvement District is formed to improve a larger portion of SW Bull Mountain Road that would include the project frontage, The Engineering Deparment has reviewed the topographic constraints at the site and would suggest that an alternative sidewalk location may bo justified to save the cedar HEARINGS OFFICER - CUP 94-0009 ST, JAME S EPISCOPAL CHURCH Page 12 S. trees noted in the application, that are located at the easterly end of the site. The widening of the existing street can be accomplished without any unusual circumstances, except that a portion of the proposed sidewalk should be located in an easement on private property, to align with a grade compatible with the adjoining properties and the existing trees. As noted, there are power poles and overhead lines on both sides of the street, and the applicant should be required to place these facilities underground, or pay the fee in -lieu of undergrounding. The existing building is connected to the existing 8" public sanitary sewer in SW Bull Mountain Road and no changes are proposed. The sewer has sufficient capacity for the proposed addition. 3. STORM DRAIN Y 'r The site slopes in a northeasterly direction to the 6 tt , storm drain located in an easement - - on the adjoining "Shadow Hills" subdivision. The storm drain should be extended onto the site to a point located a minimum of 5 feet southerly of the northerly property line and a catch basin constructed to City standards. In addition, a storm drain easement should be dedicated to the City for access and maintenance of the storm drain. The drainage from the additional impervious area created by the new construction should to be directed to a new on -site swale from the end of the existing on -site "daylight" storm drain, to the new catch basin. The Unified. Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. Section 7,10b of the above noted Resolution and Order cites conditions under which the fee in -lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on -site facility would preclude the effective development. ", the fee may apply, It is our opinion that this site is consistent with this criteria; and we recommend that a fee in- lieu be required. 2. Dear Sirs: This is a request for Conditional Use Permit approval for the above referenced project. A Pre-Applica 4' Conference was held on October 4, 1994 regarding thik,,, ix;,oject. PROJECT _DESCRIPTION The project, as shown on the attached drawings, is addition of an acolytes preparation room and small chapel to an existing sanctUary, remodel of an existing parish hall for use as handicapped accessible offices and new facility entry and addition of a two story Parish Hall/Sunday School wing to an existing church building. As part of this project, a classroom building and portions of the existing parish hall and offices Will be removed. A total of 47 spaces are required and 67 are provided. Perimeter landscape and fence screening, lighting and interior tree planting are existing. The only parking modification is to construct a sidewalk along a portion of the east edge of the existing parking lot and to re-stripe as shown to meet current handicapped access parking standards. LANDSCAPING Two new street trees are proposed, to replace those that Would be destroyed by construction of the sidewalk along Bull Mountain Road. All other site landscaping is existing and all areas of landscaping are currently irrigated. SIGNS No new signs are proposed, however, existing signs are to be relocated as a result of sidewalk conotruction. The signs Will not be within the 30 foot clear vision area adjacent to the parking lot access drives. RIGHT OF-WAY DEDICATION The existing right-of-way width is 20 feet frt.1 the centerline of the right-of-way to the church property. City of Tigard Engineering Division staff is recommending an increaoed dedication to 35 feet from the centerline of the right-o This is shown on the site plan. STREET IMPROVEMENTS Engineering Division staff is recommending half street improvements along Bull mountain Road to include paving to 22 feet from the centerline of the road with a curb and 6 foe4t Wide sidewalk. This is shown on the site plan, hoWever, we Would request that this requirement be postponed until such time as development of sidewalks at adjacent properties takes place' The reason kor our reqUest Is that the sideWalk, If deVeloped now, would not be accessible from either end and, since parking is not allowed along Mill Mountain Road and no bus service ia available, would not be usable via vehicle parking or transit access either, Because of the existing adjacent site grade at the neighboring property to the east, a retaining wall approximately 3 feet high would be :^equired at that end of the walk. East of that wall location exists a dense planting of cedar trees that would prevent any potential pedestrian access prior to major modifications on the neighbor's single family residential property. Immediately in line Wth the west end of the sidewalk is an existing ditch and storm drain inlet, with no existing pedestrian access other than the bicycle lane, which also exists along the church property. The property development to the west of the church property is a single family residence, with access from S.W. Mc Farland Blvd. and no access to Bull Mountain Rd. Power poles are currently located in the edge of the existing bike lane paving, These would have to be relocated and would require replacement of the power connections to properties across Bull Mountain Road. If these wires are to be located underground in the future, it would mean demolition of portions of this recommended street and sidewalk improvement to accomplish. It seems that all of this work would be better undertaken at the time when adjacent properties develop pedestrian access or when a local improvement district addresses improvement of a larger section of Bull Mountain Road. The church would, therefore, request to be allowed to sign a waiver of remonstrance to future improvement rather than to be required to provide an unusable improvement at this tiMe. SANITARY SEWERS The church isicurrently connected to the public sewer system. WATER SUPPLY The church is currently connected to the public water system. VIRE PROTECTION Fire protection requirements have been reviewed with Gene Birchill of the Tualatin Valley Fire District, Vire flows are adequate and two additional fire hydrants, as shown on the site plan, will be added as part of this project. STDRMWATER The first phase of the existing building (sanctuary, built in 1963) was connected to the public storm drain system at BUll Mountain Road. The second phase (pariqh h411, built in 1974) utilized on-site disposal via daylighted drain piping. There are no surface ponds or Waterways created by this diaposal method and runoff to neighboring properties is not apparent. A system of an-site disposal will be utilized for thin addition, if deemed appropriate by the Unifi eWerage Agency, If thi method is not approved, the additional storm drainage may be connected to an existing storm main at the northeast corner of the site. CONCLUSION It is our feeling that all elements of this proposal are consistent with the applicable zoning requirements. JAMES EPISCOPAL CHURCH DIMajalati2a: The applicant requests a Conditional Use Permit to allow the construction of an addition to the existing sanctuary at the church located at 011511 SW Bull Mountain Road. The site is also known as Tait Lot 2S1 10BD 100 which has an area of 2.40 ac. Findinqs: 1, STREETS: The existing parking lot for the church currently has two one-way driveways that connect to SW Bull Mountain Road, a Major Collector street as shown on the City Comprehensive Plan. SW Bull Mountain Road is also a Washington County road. No change is proposed to the onsite driveway system. The existing right-of-way for SW Bull Mountain Road, as measured from the centerline of street, is 20 feet wide. The right-of-way required to match the existing dedications to the west is 35 feet, The applicant should be required to dedicate the additional right- of-way. The existing roadway consists of a 32 foot wide asphalt concrete pavement that provides one 11 foot wide vehicular and one 5 foot wide pedestrian lane in each direction. The standard condition of approval for this type of development is to require one-half street improvements along the entire frontage. The applicant has requested that the improvements be deferred to the future when a Local Improvement District is formed to improve a larger portion of SW Bull Mountain Road that would include the project frontage. The Engineering Department has reviewed the topographic constraints at the site and would suggest that an alternative sidewalk location may be justified to save the cedar trees noted in the application, that are located at the easterly end of the Site. The widening of the existing street can be accomplished without any unusual circumstances, except that a portion of the proposed sidewalk should be located in an easement on private property, to align with a grade compatible with the adjoining properties and the existing trees, As noted, there are power pol3s and overhead lines on both sides of the street, and the applicant should be requited to place these facilities underground, or pay the fee in-lieu of undergroUridingi ENGINEERING COMMENTS CUP 94-09 ST. The sewer has sufficient capacity for the proposed addition. 3. STORM DRAIN: The site slopes in a northeasterly direction to the 6" storm drain located in an easement on the adjoining "Shadow Hills" subdivision. The storm drain should be extended onto the site to a point located a minimum of 5 feet southerly of the northerly property line and a catch basin constructed to City standards. In addition, a storm drain easement should be dedicated to the City for access and maintenance of the storm drain. The drainage from the additional impervious area created by the new construction should to be directed to a new on-site swale, from the end of the existing on-site "daylight' storm drain, to the new catch basin, The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Section 7.10b of the above noted Resolution and Order cites conditions under which the fee in-lieu may be accepted. Specifically, it provides, that if, "The site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development.", the fee may apply. It is our opinion that this site is consistent with this criteria, and we recommend that a fee in- lieu be required. LEGIBILITY STRIP Recommendations: PRIOR TO THE ISSUANCE OF A BUILDING PERMIT THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED: 1.
