This property is zoned Medium Density Residential, 12 units pr, acre (R-12). The present use of the site is listed as a Conditional Use in this zoning distr!. The site received original Site Development Review approval in 1981 (SDR 26-81) and Cr.(' :Mona! Use approval in 1982 (CUP 20-82) an additional CUP (92-0005) was approved in *W92 for the construction of three (3) classrooms and a library. The Tigard Community Develooment Code, Conditional Use Section, states: "if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Conditional Use application." Section 18.130.050(B) states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: 1. A change in land use. The use is currently for a church, community center and private school. That use will not change as a result of the proposed modification. 2. An increase in dwelling unit density. The proposal is to add a modular classroom, therefore, this standard does not apply. 3. A ten percent change in the ratio of the different types of dwelling units to the number of units. The proposal does not involve dwelling units, therefore, this standard does not apply. 4. A change in the type of commercial or industrial structures. This proposal does not involve a change in the structural occupancy type, therefore, this standard has been satisfied. 5. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. 6. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The proposal is to place a 1,792 square foot modular class room on the existing school site, therefore, this standard has been satisfied. 13125 SW Hall blvd., Tigord, OR 97223 (503) 639-4171 TDD (503) 684-2772 2,. • ,•.„ Page 1 of 2 :". • 7. A reduction of more than ten percent of the area reserved for common open space and/or usable open space. The proposal will reduce the open space slightly, however, due to the extensive amount of outdoor open area provided for the .school facility, the open space will not be reduced by more than 10%. 8. A reduction of specified setback requirements by more than 20 percent. The proposed modular location is in the center of the site, thus not affecting required setbacks. The applicant should verify with the Building Division that the building meets fire code requirements for setbacks between buildings. 9. An elimination of project amenities by more than ten percent where previously specified such as: Recreational facilities, Screening; and/or, Landscaping provisions. The proposed addition will result in the removal of some grar,s, however, new landscaping will be added around the proposed building. The proposal will not reduce existing playground or recreational facilities and the overall landscaping will exceed the required 15% landscaping. Therafore, this standard has been met. 10. A ten percent Increase in the approved density. This does not involve a residential development, therefore, this standard does not apply. This request is determined to be a minor modification to an existing Conditional Use. The Director's designee has determined that the proposed minor mmaication of this existing sits will promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties, provided that development which occurs after this decision complies with all applicable local, state and federal laws. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION: 1. A building permit must be obtained for the proposed expansion. Please provide a copy of this letter when applying for permits. There is a fee for the required permits. Please contact the Development Services Division for information on the current fees. Narrative indicating the rationale for the proposed modification The addition of a double modular classroom to the St. Anthony School campus is necessary to accommodate double classes moving up into the middle school, which was originally designed for single classes in each grade. This is the last addition of classrooms the school foresees for at least the next five years. It will also provide a permanent classroom space for several of the school's specialists who now have ?),o homeroom. This will ease crowding in g evenly spread among school campus„ the main school building and will more e enl s read out the students anion the sc The school board estimates that these modular units will only be necessary for 3-5 years, until the parish has had time to determine and prioritize needs for new buildings, and then time to fund raise and actually construct. The site plan indicates placement of the modular so that it is readily accessible to the middle school, which accommodates the grade of students who will be using them. The site is close to utilities, and will only result in a loss of grass. New landscaping will be put in around the modular once it is in place. V. EVALUATION OF REQUEST A. ornijancconY_____MununitDevelomitS1Dde. Section 18.130.040: The construction of school facilities in an R-12 zone requires a conditional Use approval. This proposal is consistent with the applicable criteria. The site provides adequate area for the construction of the proposed classrooms and library. There are no apparent physical obstaclea to thie use on the site. Adequate public utilities are available to serve this use as addressed further in this report. Setbacks, lot coverage, and building height requirements of the R-12 zone, and the applicable Comprehensive Plan Policies can be satisfied by this propoSal. Section 18.130.150(C1(9$: The construction of the proposed classrooms and library either meet or exceed all lot area and setback requirements of this code section. Thid site is approximately 0.96 acres in area. The front yard setback of the existing Kelly Center is approximately 30 feet. The rear yard is approximately 50 feet. The north and south side yard setbacks of the expansion will be approximately 55 and 20 feet respectively. Section 18.106.0300.= (Parking) can be satisfied by the three existing off-Site parking lots Which cdttently Serve the Kelly Center, Saint Anthuny'S Church, and Saint Anthony 's SchoOl. There is an BEARINGS OFFICER - CUP 92,-0005 - ST. ANTHONY'S/PAMSEN PAGE 5 4 44 • additional parking lot located across SW McKenzie Street which also serves these facilities. The two proposed classrooms will provide a total of new 70 seats. The library and science room are not full time classrooms but will be used by classes on an intermittent basis. Therefore, based on the ratio of one space for every eight seats, the proposed use requires the provision of a total of 9 additional parking spaces. The applicant's narrative states that 90 parking epaces are provided by the adjacent parking lots. The oubject site currently provides no parking spaces of its' own and none are proposed in conjunction with this application. Even though the adjacent parcels are under different ownerships, the uses are directly connected. Since the hours of operation of some of the uses on these adjacent parcels differs from that of the Kelly Center, the parking for the Kelly Center has historically been provided by these adjacent parcels. Adequate bicycle parking is provided by the adjacent schobl. Though this parking arrangement has been used for a number of years, the City has no evidence of a parking agreement to guarantee this arrangement. Therefore, while no parking spaces are provided on the subject site, the parking requirements shall be met upon the provision of a reciprocal use agreement between the site and those parcels which currently provide the required parking. Section is.s4,g91mi6i. requires that at least 20 percent of the site be landscaped. The applicant etatee that the landecaping will form a transition leading from the baseball field and playground to the proposed expansion. GraBe will be replanted in areas disturbed by construction in addition to providing arborvitae in planters which are located to the east of the proposed addition. The applicant also states that the areas immediately to the north and south of the addition will be planted with rhododendrons under the eaves of the building to match the planting scheme of the existing building. More than 20 percent of the oite will be landscaped upon completion of this expansion. In addition, a large portion of the surrounding tax lots are presently landscaped or being used ao playground and recreation areas. Therefore, this code section is satiefied. Seetion 18.108.050 requiree that a pedestrian walkWay extend from the ground floor entranCes to the street Which provides the required access and egress. since this parcel Le in the Center of the block, it is not pradtical to construct a dedicated pedestrian walkway leading to SW McKenzie Street. Rather, the site plan shown three existing WalkWaysi that lead to the parking areas which serve this bite. Staff contends that by demonstrating that the use of this site is connected to the parking area° which serve the site by these existing walkways, the intent of this cede section has been Met. Therefore, this code requirement has been satisfied. The reciprocal parking agreement would confirm this Site may also use other existing walkway extensions. Section AgAgl (Trees) The applicant's narrative States that all existing majOr fir trade will be retained. The preliminary site plan and subsequent Site visit do not indicate the need td remove any trees over six inches in diameter as a result of this expansion. Therefdre, HEARINGS OFFICER P. CUP 92-0006 ST. ANTHONYWPAULSEN PAGE 6 • a tree removal permit will not be required unless it is shown that such trees will need to be removed. Section 18.164.030(E) (Minimum Rights -of -way and Street Widths) contains the regulations pertaining to street standards. In discussions with the applicant during the pre - application conference, it was determined the majority of the traffic would be utilizing the parking area adjacent to the south side of the school (along Pacific Highway). Access to this parking area is from SW Johnson Street. Southwest Johnson Street is classified as a minor collector, and therefore is required to meet the following minimum standards (all distances are from centerline of right- of-way): 30 feet of right -of -way, 20 feet of pavement, curb and sidewalk. There currently is 25 feet of right -of -way, approximately 15 feet of pavement and no curb or sidewalk. The i applicant should be p required to provide half - ,street improvements from the intersection of SW Johnson Strnet and Pacific Highway to the west end of the second driveway on Johnson Street (west of the convent). The standard half - etreet improvements may place the sidewalk and right- of-way close to the existing school building. Minor variations in both the sidewalk and right -of -way standards should be allowed, if necessary, to avoid conflicts with the existing building. Section 18.164.090 requires the provision of sanitary sewer service. The site is currently being served by an adequate public sanitary Sewer system. Therefore, no conditions should be required concerning the public sanitary sewer line. Section ec niesti . o16 .10 requires the adequate provision or storm drainage existing building is connected to the public stone sewer system which is located in SW Johnson Street. The applicant should be required to meet the requirements of the Building Department for the adequate disposal of the additional storm water resulting from this proposed expansion. The Unified Sewerage Agency has established, and the City has agreed to enforce (Resolution and order No. 91 -47), surface Water Management Regulations requiring either the construction of on -site water quality facilities or the payment of fees in-lieu of their construction. Construction of an oil -site water quality treatment facility is not appropriate because the site is small compared to the development plan, and the loss of area for the on -Site facility would preclude effective development. In addition, requiring surface water quality facilities on small Bites would result in numerous facilities that Would become a maintenance burden to the City. Purthermore, the applicant has not proposed any such facilities and there pare no natural depressions or other areas of this site that are particularly suitable for water quality facilitied4 Regional facilities, funded by feed in -1 ,eu of construction of these facilities, would provide the required treatment With improved reliability and less maintenance. Therefore the applicant should be required to pay the fee in -lieu of constructing an on -site facility. HEARINGS OFFICER - CUP 9.2.0005 ST. Policies 7.1.2, 7.3.1 and 7.4.4 provide that the City will require as a condition of development approval that public water, sewer, and storm drainage will be provided and designed to City standards and that utilities shall be placed underground. This conditional use permit proposal complies with these policies because the applicant will extend public sewer and water systems to this site and will provide for underground installation of telephone, electricity, and cable television lines as appropriate. Additionally, the City will assist in the coordination of the provision of water services with Tigard Water District. Policy 8.1.1 and 8.1.3 provide that the City will plan for a safe and efficient street and roadway system that Meets current needs and anticipated future growth and development. Thin application complies with Policies 8.1.1 and 8.1.3 because the development abuts a dedicated street. 'Vehicular access to the site is provided at additional points. Appropriate street improvements will be required along the affected portion of SW Johnson Street as Specified in conditions of approval noted below. VI. ANTHONY'S KELLY CENTER Background: The existing St. Anthony's primary school building, located at the west corner of Pacific Hwy. and Johnson St., is at capacity with current enrollment. Also, plans for future highway widening improvements suggest that an addition to the existing school building would be inappropriate. Additonally, maintenance and operation costs of this older building have been high, The proposed addition to the existing Kelly Center, located about 200 feet from the existing school on the same property, solves these problems. It provides the needed additional capacity, will not interfere with the possible future highway widening, and lessens maintenance and operating problems. The four room addition includes a libvary, two classrooms and a science classroom. A steal enclosed outdoor garden area may also be developed to the north of the library, The balance of the ptopertY, including parking lots, buildings and play area is to remain unchanged. Three existing on-site parking lots serve St. Anthony's Church, School, and Kelly Center. AS the parking needs for the school are relatively light, the existing site provisions are more than ample, providing a total ofT3OriiaCedS including two handicap parking stalls at the west end Of the site. Also another parking lot across McKenzie St, provides additional parking fot the church. This proposal does not include providing additional parking for our addition. Although out understanding is that religious institutions are exempt from the requirements of the new ADA accessibility laws, we will designate a handicap parking stall on an existing parking area as you require. Our proposal includes landscaping to match the Kelly Center existing landscaping. All existing major fir .trees will be retained. The existing grass would be replanted in areas disturbed by construction, The location of the addition adjacent to a playing field and baseball diamond, would prohibit the use of major ttees. The style of architecture suggests a clean transition from ground to building and the existing building features pyramidal arborvadie along blank walls in Selected locations. We Will provide mAtching trees at matching Spacing in planters located to the east or the addition. Areas immediately to the north and south of the addition will be planted with rhododendrons under the eaves of the building, Et) match the existing Wilding planting scheme. This action placer:: into effect an increased street development fee on all. new development in Washington County. The City of Tigard has adopted the county's program. The City Traffic Impact Fee program will collect fees from new development based on the development's projected impact on the transportation system. Developing properties, will be required to pay based on the number of trips they are projected to generate. The TIP is calculated based on type of Use, size of project, and a general use based fee category. The TIF shall be calculated at time of building permit issuance. In limited circumstances, payment of the TIP may be allowed to be deferred until issuance of occupancy permit. De I tral of payment until occupancy is permissible only when the TIP is gre ter than $6,000.00. STORMWATER QUALITY FEES The Unified Sewerage Agency has established and City has agreed to enforce, Resolution No. 90-43, Surface Water Maneoement Regulations, requiring the construction of on-site waten quality facilities or fees in lieu of their construction. The resolution requires that a fee and/or construction of a water quality facility be built. The fee is based on the amount of impervious surface; for every 2640 square feet or portion thereof, the fee shall be $375.00: The City of Tigard determines if a fee or facility shall be built. STREET OPENING PERM/ No work within a public right-of-way shall commence until the applicant had obtained a street opening permit from the Engineering Department. FINISHED FLOOR ELEVATIONS On all projecte that require a grading plan the applicant shall submit with the grading plan a typical floor plan for each lot Which shall have the elevations of fou r corner e of that plan along with elevations et the corner of each lot. RE: CUP 92-0005 - ST. ANTHONY'S/PAULSEN 22m2LiEllmo The applicant proposes to expand an existing building by adding three classrooms totaling approximately 3,015 square feet and a library of approximately 1,214 square feet. Findings: 1. STREETS: The site is located on the southwest corner of Highway 99 and S.W. Johnson St. St. Anthony's Church and associated buildings encompasses the entire block, except a small portion in the southeast corner, bounded by S.W. Johnson/Grant/McKenzie and Highway 99. In addition, the church property is under several tax lots. The construction site is located in the center of the block with legal access onto S.W. McKenzie, though actual access is from several different points. In discussions with the applicant during the pre-application process it was determined the majority of the traffic would be utilizing the parking area adjacent to the school. Access to the parking area is from S.W. Johnson St. S.W. Johnson St. is classified as a minor collector, and has the following minimum standards (all distances are from centerline of right-of-Way): 30 feet of right-of-way, 20 feet of pavement, curb and sidewalk. Currently there is 25 feet of right-of-way, approximately 15 feet of pavement and no curb or sidewalk. The applicant should be required to provide half-street improvements from the intersection of S.W. Johnson St. and Highway 99 to the west end of the second driveway located on Johnson St. The standard half-street improvements will place the sidewalk and right-of-way close to the existing school building. Minor variations in sidewalk and right-of-way standards should be allowed if necessary to avoid conflicts with the existing building. ENGINEERING COMMENTS: CUP 92-05 ST. ANTHONYtS/PAULSEN A 444 4. * 4' 4' *) „ „;. • 4114 ' 4 4-4!4',. • 44 04 .10. • • to 2. SANITARY SEWER: The site is currently being served by a public sanitary sewer system. Therefore no conditions should be required for the public sanitary sewer line. 3. STORM SEWER: The additional storm water run-off created by this development will come from the expansion. The existing building is connected to the public storm sewer system located in S.W. Johnson St. The applicant should be required to meet the requirements of the Building Department for the disposal of the storm water. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on- site water quality facilities or fees in-lieu of their construction. Construction of an on-site water quality treatment facility is not appropriate because the site is small compared to the development plan, and the loss of area for the on-site facility would preclude the effective development. In addition, requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in-lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Therefore the applicant should be c'equired to pay the fee in-lieu of constructing an on-site facility. RECOMMENDATIONS: 1. Additional right-of-way shall be dedicated to the Public along the S.%, Johnson St. frontage to increase the right-of-way to 30 feet from the centerline. The description shall be tied to the existing right-of-way centerline. The City Engineer may approve minor varialtions to the right-of-way width where • necessary to avoid encroachment of existing buildings into the right-of-way. The dedication document shall be on City forms. Instructions are available from the Engineering Department. ENGINEERING COMMENTS: CUP 9205 ST. ANTHONY'S/PAULSEN 2 4 t 2. The applicant shall pay the fees as established under the guidelines of Resolution and Order No. 91-47; Surface Water Management. NOTE: The fee shall be paid prior to issuance of building permit; contact the Building Department for additional information. 3. Standard half-street improvements, including concrete sidewalk, driveway apron, curb, asphaltic concrete pavement, sanitary sewer, storm drainage, streetlights, and underground utilities shall be installed along the S.W. Johnson St. frontage. Improvements shall be designed and constructed to minor collector street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the Engineering Department. Half-street improvements shall be installed from the intersection of S.W. Johnson and Highway 99 to the scond driveway west of the intersection. 4. If it is unfeasible to underground the utilities, as required for the half-street improvements, the applicant may pay a fee in-lieu of undergrounding. APPROVED: Randall R. Also, plans for future highway widening improvements suggest that an addition to the existing school building would be inapPropriate. Additonally, maintenance and operation costs of this older building have been high, The proposed addition to the existing Kelly Center, located about 200 feet from the existing school on the same property, solves 'these problems. It prviies the needed additional capacity, will not interfere with the possible future highway widening, and lessens maittenaAce and operating problems. The four room addition includes a library, two classrooms and a science classroom, A Mall enclosed outdoor garden area may also be developed to the north of the library. The balanoe of the property, including parking lots, buildings and play area is to remain unchanged. Three existing on-site parking lots serve St. Anthony's Church, School, and Kelly Center. As the parking needs for the school are relatively light, the existing site provisions are more than ample, providing a total of :IC space01 including two handicap parking stalls at the west eid of the Bite Also, another parking lot across McKenzie St, provides additional parking for the church, This proposal does not include providing additional parking for our addition. Although our understanding is that religious institutions are exempt fro M the requirements of the new ADA accessibility laws, we will designate a handicap parking stall on an existing parking area as you require, our proposal includes landscaping to match the Kelly Center existing landscaping. All existing for fir trees will be retained, The existing grass would be replanted in areas disturbed by construction, The location of the addition adjacent to a playing field and baseball diamond, would prohibit the use of major trees, The style of architecture suggests a clean transition from ground to building and the existing building features pyramidal arborvadie along blank walls in selected locations, We will provide matching trees at matching spading in planters located to the eat of the addition, as immediately to the north and south of the addition will be planted with rhododendrons under the eaves of the building, to match the existing building planting scheme. This addition is architecturally compatible with the eXisting Kelly Center building, The impact on the church property and neighborhood is minimal. This pro)v.ct will comply with all applicable zoning ordinances, buildino codes and oublid 417111waMigvnt- Visionar9 Homes • • d • . 503 666 5004 P.01 , r CONDITIONAL USE APPLICATION Sr. ANTHONY'S KELLY CENTER • 1:•ti • V4 /fix + AiGhti3MAIT made entered into this day or by d between the ?ranc i s oan Province of St. Barbara, represented by t t3 Provincial Suoerior,, acting by and with the 'consent of his ` o©unoil, hereinafter called ORD?3t Of MARS MIN'C1 and Moat Reverend Edward ,7.
