Project Purpose and Noed:
Install water and sewer mains to new site for a GTE telephone switching
equipment building.
Project Description:
Extension of existlg municipal utilities in the area,
DIP watermain extension (180' 4- in low land), and about
sanitary sewermain extension (180' 4. in low land).
Construction methods will be.by backhoe and truck haul to
stockpile site.
Trench backfill will 0-3/4" crush aggregate, compacted.
Trenches will vary from 4-8' deep and up to 8' wide.
There is no vegetation in the construction zone.
Adjoining land to the road ROW is undeveloped lowlands,
to 18" diameter.

(6) • PROJECT IMPACTS AND ALTERNATIVES
Describe alternative sites and project designs that were considered to avoid impacts to the waterway or wetland.
Ths building site is separated from the existing sewer main by the referred
tz' small wetlands. Constructing within road embankment is the only alter-
native from a standpoint of minimizing impact and ease of construction;
also as a means to maintain grade for the gravity flow sewer.
An on-site drainfield is not possible due to the lack of sufficient square
feet of drainfield area.
Describe what measures you will use (beivre and after construction) to minimize irripticb to the waterway or wetland.
Hay/Straw bales will be placed at the toes of the road embankment faring
trenching in the vicnity to trap any gravel that may roll off the pavement
work surface.
Assuming these to be only trace amounts, it is expected that the material
will become integral with the existing granular/clay road embankment slope.
If recoverable (bucket-sized) volumes of gravel are pushed down the slope,
it may be possible to drag the slope and recover them.

I am writing to follow -up on earlier conversations about sewer service to the
referenced property, 'The extent of open cut on Scholis Ferry Road required for a
gravity service has resulted in permitting problems with respect to allowing road
closure on this busy street.

convey domestic sewage from this building to the existing 8 gravity main crossing
Scholls Ferry in the vicinity of Reflection Apartments' east entrance. This piping
system would require only a typical 3 foot burial depth Washington County officials
have verbally indkated their approval of what is essentially a private sewer line, to
locate this pipe within Scholls Ferry providing it is accomplished by a tone wire and
is filed with the Utilities Notification Center.
More specifically to the matter of the pumping unit, 1 would like to present a

depth of 24" is much more conducive to allowing a couple of cycles a day at
a 12" depth pump -on signal.
The 48" diametei barrel also has a bigger surface area which will be more
prone to odor generation, and to the build up of sediment on the floor at
points more distant from the influence of the pump.
Considering that the wastewater discharge from a facility like this can be
regulated (stopped) if a mechanical failure should develop,
the need for a
back-up pump is not as critical as in the usual pump station. However,
several measures would be implemented to address the potential pump
failure situation. An alarm light would be placed :,aside the building at the
entrance to the restrooms. This would signal that the liquid level in the basin
has risen past the normal pump -on stage. Perhaps a more positive indicating
system could also be used by means of a constant green light indicating that
an alarm condition does not exist.

Dear Ron:
This is to verify our conversation yesterday, The Final Order by
the Hearings Officer requires that a 45 foot right of way be dedicated to
Washington County. However, in a revised letter from the County
(attached) they require 37 feet rather than the initial 45 feet. This 37
feet has been verified with the County and is in agreement with the
requirements from the previously approved MLP 91-0012.
We understand that the senior planner for the city has agreed that
the requirement should be 37 feet. We are continuing with the design
based on this decision. Thank you for your assistance.

Recommendation A.2. on the letter dated 1/18/92, in error, states that
right-of-way dedication (from Scholia Ferry centerline) should be 45 feet.
Actnally, dedication from Soholls Ferry centerline on this site's frontage
should only be 37 feet.
Additionally, it has =Me to my attention that County Staff did not provide
cdMments on the Minor Partition for the site which was previously approved
(Casefile 91-00012/14LP ?) . Typically, CciUnty Staff mild have provided
comments, for the partition, almost verbatim like the Ocatanents on the
attached. This would then require public ‘reweraents along the frontages of
BOTH partitioned parcels, and not just along GTE frontage, as one could
interpret from the attached.
Therefore, it is County Staff's recoatmendation that au recaramended conditionm
(as amended above) listed on the attached, be required of both parcels approve ,
through the partition on the site.

I. SUMMARY OF THE REQUEST
The applicant requests approval of a conditional use permit to 6iild a roughly 9100 square
foot one story building for use as a telephone switching station and associated functions.
The applicant submitted a tree survey and wetlands assessment for the property and a
preliminary site plan showing one point of access to Scholls Ferry Road, one building
situated consistent with required setbacks, parking for 7 vehicles, and preservation of an
existing wetland and certain vegetation. The site is a roughly 1-acre parcel in the R-25 zone
on the southeast side of Syphons Ferry Road. It was created by means of a minor land
partition conditionally approved in November, 1991 (MLP 91-0012).
At the public hearing in this matter on January 13, 199. ,City staff recommended
conditional approval, amending the written staff report to incorporate conditions proposed
by Washington County. The applicant accepted the recommended conditions with certain
clarifications. The applicant subsequently sent the Examiner two facsimiles with additional
arguments, but the Examiner did not consider them, because the record was closed.

H, FINDINGS ABOUT SITE AND SURROUNDINGS
A. Site size, shape, and location :
The site is an irregularly-shaped parcel as much as 276 feet deep (east-west) and 215
feet wide (north-south) and contains about 1 acre. It has about 264 feet of frontage
along SW Schoils Ferry Road. It is situated about 2000 feet southwest of the
intersection of SW Scholls Ferry Road and 135th Avenue.
B. Existing uses, structures, and vegetation
The site is not developed with sttuctures. There are about 100 trees on the site in
excess of 6 inches diameter, based on the tree survey provided by the applicant, and a
wetland in the southwest corner of the site.

C. Proposed uses, structures, and landscaping
The applicant proposes to build a one - story, 9000 square foot structure situated about
40 feet from the front property liner about 15 feet from the nearest (north) side property
line, and 45 feet from the rear (east) property line, based on the preliminary site plan.
The location of the building may shift somewhat to accommodate the required street
dedication and setbacks. One access drive to the site is proposed from Scholls Ferry
Road. There will be parking for 4 vehicles in front of the building and for 3 more
vehicles behind the building, plus paved maneuvering areas in front, behind, and one
the south side of the building, The applicant will preserve an existing wetland at the
southwest corner of the site, and will set back the maneuvering area pavement about 40
feet from that wetland. Existing trees on the undeveloped portion of the site will be
preserved. An 18- by 42 -inch logo sign is proposed to be attached to the building.
D. Plan c.esignation and zoning
The site is designated and zoned R -25 (Residential, 25 units per acre) as is the
surrounding land in the City.
E. Public services and utilities
1. There is supposed to be a sanitary sewer line in Scholls Ferry Road operated by the

City of Beaverton, although its location has not been verified in the the City
of Beaverton has not agreed in writing to provide sewer service. The closest USA
sewer line is situated about 400 feet north. If public bewer service cannot be provided,
the applicant could apply to USA for approval of a subsurface sanitation system.

B. Testimony.
Ron Pomeroy testified for the City and summarized the staff report and comments
.-41:0S, Washington County.
2. Chris Defferding testified for the applicant. He accepted the conditions
recommended by staff. He requested that the decision reflect the fact that only 3
employees will be on the site; therefore, the traffic impact fee should be calculated
accordingly. He also requested that dedication requirements apply only to the GTE site
and not the adjoining parcel that was created by MU' 91-0012.
C. Agency Comments.
The Hearings Officer incorporates by reference the agency comments on pages 4
through 5 of the January 13, 1992 staff report and the Washington County letter dated
January 8, 1992.
V. EVALUATION OF REQUEST
A. Compliance with Title 18 (Zoning).
1. The proposed use complies with Chapter 18.56, because the proposed use is listed
as a conditional use in the R-25 zone, and the lot and structure comply with the
dimensional requirements of the zone.
2. The preliminary site plan complies with Section 18.84.028, because there is no
development of or within 25 feet of the identified wetland on the site.
3. The proposed use can comply with Chapter 18.100 by providing landscaping and
street trees as shown or the preliminary plan.
4. The proposed use complies with Chapter 18.106, because the applicant will provide
7 parkin' g spaces on the site, based on the prelim" iriary site plan. A condition is
warranted requiring one of those spaces to be designed for handicapped use and
requiring at least 1 bicycle parking space.
5. The proposed use will comply with Chapter 18.108, because the drive to Scholls
Ferry Road is at least 30 feet wide, will be improved with a minimum 24-foot paved
surface, and vehicles can enter the street in a forward direction, based on the
preliminary site plan.
6. Signs associated with the proposed use comply with Chapter 18,114, based on the
plan for an 18- by 42-inch building-mounted sign.
7. The proposed use complies with Chapter 18.130, because:
a. The site size and dimensions accommodate the proposed use while preserving
existing mature vegetation and a wetland in a manner that minimizes adverse visual
and noise impacts.
b. The characteristics of the site are suitable for the proposed use, because it ig
large enough to accommodate development and landscaping, it is situated along a

busy street, it preserves an existing wetland and substantial trees on the site, and the
site does not contain significant physical hazards or natural features that would be
adversely affected by development.
c. Public sewer and water are available to the site and have capacity to serve the
site, or an adequate private sanitation system can be approved.
d. The applicable provisions of the R-25 zone are fulfilled as noted above. The
front yard exceeds 20 feet, the rear yard exceeds 20 feet, and the side yards exceed
10 feet. Although the height of the building is not identified on the preliminary site
plan, the building is proposed to be one story, and it is unlikely that a one story
building will exceed 45 feet in height. Compliance with the setback and height
standards can be verified in the building permit review process.
e. The use will comply with the applicable Comprehensive Plan policies, based on
finding V.E.
8. The proposed use complies with section 18.130.150(C)(18), because the use is
proposed in a multiple family zone and the lot exceeds 5000 square feet.
9. The proposed use complies with Chapter 18.150, because the applicant has
prepared a tree survey and proposes to preserve existing substantial trees that are not in
the proposed development area. Compliance can be facilitated with a condition of
approval.
10. The proposed use will comply with Chapter 18.164, provided the applicant
dedicates tight of way adjoining the conditional use site consistent with comments by
Washington County, installs a sidewalk and drainage consistent with County
standards, executes a future street improvement guarantee acceptable to the County, and
pays a traffic impact fee consistent with applicable standards. For what it is worth, the
Hearings Officer recommends the County consider classifying the traffic impact fee for
the proposed use based on the applicant's testimony about the nature of the proposed
use and the number of employees accommodated therein. The Hearings Officer does
not have jurisdiction to require a certain traffic impact fee to be imposed and does not
have authority to modify applicable Washington County Road Standards in this
proceeding.
B. Compliance with applicable Comprehensive Plan Policies.
The proposed use complies with Policy 2.1.1, because notice of the application or
hearing was provided to the neighborhood planning organization in the area and to
owners of property in the vicinity of the site and published in the Tigard Times.
C. Compliance with Resolution and Order 9147.
The proposed use can comply with Resolution and Order 91-47, because the

VII. CONCLUSION AND DECISION

In recognition of the findings and conclusions contained herein, , and incorporating the
Summary and other reports of affected agencies and public testimony and exhibits received
in this matter, the Hearings Officer hereby approves CUP 91 -0009 (GTE), subject to the
following conditions:
THE FOLLOWING CONDITIONS SHALL BE MET PRIOR TO THE ISSUANCE OF A
BUILDING PERMIT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR
ALL CONDmONS SHALL BE anus DAVIES, ENGINEERING DIVISION.
1. The applicant shall install and maintain a water quality facility that complies with
Resolution and Order 91-47 as approved and adopted by the Unified Sewerage
Agency. The City Engineer may waive this requirement to the extent yawed by

they exist at the time public improvement plans are approved.
2. The applicant shall provide the following to Washington County:

permitted by City Code, that street trees will be provided unless the planning. manager

applicant shall modify the preliminary site plan to identify one handicapped parking

Dear Mr. Epstein:
After our review of the items .requested from Washington County
(letter dated 1-8-92) another item has become of concern to us. That is
Item 02 in the comment section, Sight Distances.
We have had the surveyor gather the elevations along Scholls Ferry
Road and find we more than adequate sight distances to the Southwest but
only 250' to 300 of adequate sight distance to the Northeast. We have
located the access to the site as far from the crest of the small rise as
possible,
We respectfully request your consideration in reducing the sight
distance standard to the Northeast given the following circumstances;
1) The County intends to realign Scholis Ferry Road and downgrade
the existing road whicl, serves this site from Major Collector
to a Local Street. The existing road will become a cul-de-sac
with the resultant substantial decrease in traffic and lowering
of posted speed limits which in turn affect sight distances.
2) We have maintained the minimum access spacing standard of 100'
from the adjacent residence to the North which itself has only
approximately 150' sight distance to the Northeast.

1 have received a copy of the comments from Washington County for
the above referenced CUP, I have also received a copy of the 1-14-92
letter concerning modifications of the Right-of Way request to 37. We
have had our surveyor prepare the revised partition plat to reflect the
37'.
We have reviewed the request of the County to require public
improvements on both partitioned parcels. We request however that public
improvements only be required for the South parcel (GTE). Since there is
some questior but the future of this roadway and the requirements to
deliver
non-remonstrance agreements from the owner (Mrs. Karls) regarding future
improvements, we request that improvements be required for GTE's property
only.

B. FINDINGS OP FACT
1. AmakgrEvad Information
This parcel was created through the November 12, 1991 approval of
minor land partition MIX 91-0012. There have been no other land use
applications considered on this site.
2. Vicinity Information
The subject site is located east of SW Scholar Ferry Road north of •
the Cotewald subdivision. City of Tigard properties which are
located in the vicinity of this site are all zoned R-25 (Residential,
25 units per acre). These properties are substantially developed
with dingle-family residences. The Sunflower Apartments are located
east of the subject site. The newly completed Reflections apartment
complex is located across SW. Scholls Ferry Road to the west.
3. Site Information and Pg222gal Descriatim
This site is approximately 1 acre in size. The ptcpezty is currently
heavily wooded with a designated wetlands in the Southwest corner.
No built structures are present on this site.
The applicant requests the approval of a Conditional Use to allow
construction of a 9,100 square foot public utility building .to be
used as a telephone switching station. Parking and other site
improvements are proposed.
4. Staff Contents
Engineering Considerations:
1. STREETS The site has access from SW Scholia Ferry Road.
Until recently, SW Scholia Ferry Road has been under the
jurisdiction of the Oregon State Highway Division. The
jurisdiction has recently been shifted to Washington County.
Southwest Scholls Ferry is now classified as a major collector.
The City has not, as of the writing of this report, received
any comments from Washington County.
It is the intent of Washington County to realign this portion
of Scholia Perry Road; although no definite plans or time
schedule have been annoUnced. The Current plan is to bring sW
Schools Petry Road into alignment with SW Davied Road, thereby
eliminating the cumbersome intersection of SW Scholla Perry,
Old Seholls Ferry, and SW 135th Avenue. southwest Scholia

Ferry Road will curve to the north approximately 400 to 600
feat south of this proposed development. The "new" road
serving this property, and affected properties which currently
have access from SW Scholls Ferry Road, would be classified as
a local street. This requires a minimum of SO feet of right-
of-way. Since there is uncertainty as to the time schedule for
this reconfiguration of SW Sehollo Ferry Road, the applicant
ohould be required to:
A. Dedicate additional right-of-way, as requested by
Washington County, along the sites' frontage of SW
Scholia Ferry Road; and
B. Sign a waiver not to remonstrate against the formation
Of a local improvement district or other mechanism to
improve the base facility of SW Scholia Ferry Road.
2. SANITARY SEWER - The applicant is proposing to connect to the.
public sanitary sewer line which is located in SW Schools Ferry,
Road. Based on the information provided by the Engineering
Department, the closest available line is a Unified Sewerage
Agency (USA) line that is located approximately 400 feet to the
north of the site. The City of Beaverton has been contacted
and stated that there is a line which is adjacent to the site
and runs parallel to SW Scholls Ferry Road (this has not been
field verified). If it is determined that there is no existing
sanitary sewer which can serve this site, the applicant should
be required to obtain written approval from the Washington
County Health Department to install a septic system,
3. STORM SEWER - The existing public storm sewer system which is
located in SW Scholls Ferry Road and adjacent to the site
consists of an open ditch with culverts at driveway locations.

storm water from the site and pipe it to the wetlands.
Effective December 1, 1991, the City is required to comply with
a neW requireMent of the State Environmental Quality Commisdion
(EQC). The EQC is requiring that all new developments which
add additional impervious Oervice area within USA's
jurisdiction must include a water quality treatment facility.
Previously, developments without a Suitable Site for water
quality treatment were allowed to pay a fee in lieu of on..site
water quality treatment.
These fees would then be used to
construct regional facilities.
The City feels that these new requirement are inappropriate.
It is not feasible for many small developments to build such
on-site facilitieb. Construction of numerous small facilitied
Will create maintenance probleme both for cities and USA.

However, effective December 1st, the City must require these
facilities or be in violation of State regulations.
This iosue of on-site water quality treatment facilities was
not addressed in earlier staff reports, as the City expected
the issue between USA and the EQC to be resolved. The City is
still hopeful that this .11e will be resolved within the next
three menthe. Therefore, although the applicant should be
required to install a water quality facility, the City Engineer
may be allowed to waive this requirement if the regulations are
amended.
Building Considerations:
1. Building permits will be required prior to any on-site
construction.
Traffic impact Fee:
1. The Traffic Impact Fee (TIF) is bilged upon the number of
employees. "Utilities" is listed ae an industrial use,
category 170, according to Table 11.1 of the TIF manual.
Calculation is ail follows: number of employees X 1.07 average
weekly trips per employee X $133.00 e TIP. Applicant must
submit information with the Building Permit application.

The Tigard Water District has reviewed this proposal and has offered
the following comments:
The Water District has no objectioneo but would like to restate
that a 12" water main is required along the frontage of SW
Scholia Ferry Road to serve this site. The developer shall
incur all costs associated with said extension of the water
facilities. Pleaee contact the Water District office for
design assistance.
Tualatin Valley Fire and Rescue District #1 has reviewed this
proposal and has offered the following comments:
The approval of the fire hydrant location shall be coordinated
with the Tigard Water Dietticte
The City of Beaverton, Portland General Electric and General
Telephone and Electric have reviewed this proposal and have offered
no ob3ection to it.

C. FINDINGS AND CONCLUSIONS
Section litaLosi of the Code lists Utilities as a Conditional Usa in the
R-25 zoning district. This proposal is determined to be a Conditional Use
as listed in Section
Section 2.121.3CJAVIZA of the Code contains the following applicable general
approval criteria for a Conditional Use:
. 1. The site size and dimensions provide:
a. Adequate area for the needs of the proposed use; and
b. Adequate area for aesthetic design treatment to mitigate
possible adverse effects from the use on surrounding properties
and uses.
2. The characteristics of the site are suitable for the proposed use
considering size, shape, location, topography, and natural features.
3. All required public facilities have adequate capacity to serve the
proposal.
4. The applicable requirements of the zoning district are met except as
modified by this chapter.
5 The use will comply with the applicable policies of the Comprehensive
Plan.
This use is consistent with the above criteria. The site provided adequate
area for use as a telephone switching station. There are no apparent
physical obstacles to this use on this site. Adequate public utilities are
either present or shall be required. ThiS plan complies with all
applicable requirements of the zoning district.
Section 18.130.150,31 contains the following applicable Conditional Use
Criteria for Public Services and Utilities;
a. Applicable zones: single and multiple-family residential;
b. Minimum Lot Size: 5,00( square feet;
C. Setbacks: See applicable tone;
d. Height Restrictions: in accordance with Chapter 18.98;
e. Of f-,Street. Parking and Loading Requirement: bed Chapter 18.2.06;
Screening: in accordance with Chapter 18.100.
This BUbjedt site is zoned R-25 and therefore is an acceptable Zone for the
proposed use. The subject to is approximately 43,560 Equate feet in site

and therefore surpasses the 5,000 square foot lot minimum code requirement.
The above referenced items c -f shall be further addressed within the
following analysis.
Section 18.55.050 (J.
The setbacks on this site exceed the,most restrictive setbacks of the R-25
zone as listed below:
20 foot front yard setback
10 foot side yard setback
20 foot rear yard setback
Additionally, this code section states that no building in an R -25 zoning
district shall exceed 45 feet in height. This criteria was not addressed
within the application material. Therefore, the Planning Department shall
verify building height prior to issuance of building permits.
Section 130.040 . ].0 states that the Hearings' Officer may require
berming, screening or landscaping and the eptalilishment of standards for
their installation and maintenance. The applicant states that the south
and west property lines will be left as wooded as possible. The applicant
has also proposed the installation of a minimum five foot buffer along both
the north and east sides of the nite. Supplementary landscaping will be
placed where the existing is removed.
Section 18.84.023 states that the definitioxn of wetland in Chapter 16.26
of the CDC includes land adjacent to and within 25 feet of a wetland. The
Ate plan shows that the edge of the paved parking area will comes as close
as approximately 45 feet from the edge of the onsite wetland. Therefore,
development wil]. not encroach into the wetland area or the 25 foot buffer
surrounding the wetland.
Community Development Code Section 18.106 does not address parking
requirements for uses listed as The ill occupy the

a Ugie which provides 0-99 parking spaces. The access width shall be a
minimum of 30 feet with a minimum pavement width of 24 feet. The site plan
ehows the provision of one accessway of adequate dimensions.
Section .18.150.030 lists the criteria for obtaining tree removal permits.
Tree removal permits are required for the removal of all trees which are
over six inches in diameter when measured four feet up form grade.
Section 18.161dIE0(ILLWALLEil states that the Director may accept a
future improvement guaranten in lieu of street improvements if additional
planning work is required to define the appropriate design standards for
the street and the application is for a project which would contribute only
a minor portion of the anticipated future traffic on the street.
Therefore, .a waiver not to remonstrate against the formation of a local
improvement district or other mechanism to improve the base facility of SW
Scholia Ferry Road as noted above under Engineering Considerations would
be satisfactory.
The applicant has stated that GTE would like to place one 18 inch X 42 inch
GTE logo sign on one wall face of the building. Code Section 18.114
provides the criteria for approving signage., This request shall be further
reviewed when a Sign Permit application form is submitted to the City.
D. DECISXON
Therefore, the City of Tigard recommends that the Hearings Officer APPROVE
Conditional Use Permit CUP 91-0009 with conditions based upon the foregoing
findings.

1. STREETS:
The site has access from S.W. Scholls Ferry Road. Until
recently the road was under the jurisdiction of the Oregon
State Highway Division, but now the jurisdiction has been
shifted to Washington County and is classified as a major
collector. We have nOt, at the time of this report, received
any comments from Washington County.
It is the intent of Washington County to realign this portion
of Scholls Ferry Road though no definite plans or time schedule
has been made at this time The current plan is to bring SW
Schools Ferry Road in alignment with SW Davies Road thereby
eliminating the cumbersome intersection of SW Scholls/Old
Scholls/135th Avenue. Southwest Scholls Ferry Road would curve • to the north approximately 400 to 600 feet south of this
development. The "new" road serving this property and
properties which currently have access off SW Scholls Ferry
Road would be classified as a local street thereby requiring
a total of 50 feet of right-of-way. Since there is uncertainty
as to the schedule for the reGonfiguration of SW Scholls Ferry
Road, the applicant should by requited to
A. Dedicate additional right-of-way, as requested by
Washington County, along the frontage of SW Scholls Ferry
Road frontage, and

2. SANITARY SEWER:
The applicant is proposing to connect to a public sanitary
sewer line located in S.W. Schools Ferry Road. Based on the
information the Engineering Department has, the closest
available line is a Unified Sewerage Agency line located
approximately 400 feet to the north, The City of Ueaverton was
contacted and they have a line that is adjacent to the site and
runs parallel to S.W. Schools Ferry Rd. (this has not been
field verified) . If it is determined that there is no existing
sanitary sewer that can serve this site then the applicant
should be required to obtain written approval from the
Washington County Health Department to install a septic system.
3. STORM SEWER:
The existing public storm sewer system loeated adjacent to the
site in S.W. Scholls Ferry Road consists L2 an open ditch with
culverts at driveway locations. In the southwest corner of the
site there are wetlands, as identified by the applicant. The
applicant plans to drain the storm water from the site and pipe
it to the wetlands.
Effective December 1, 1991, we are required to comply with a
new requirement of the State Environmental Quality Commission
(EQC). The EQC is requiring that all new developments, that
add additional impervious service area, within the Unified
Sewerage Agency (USA) must include a water quality treatment
facility. Previously, developments without a suitable site for
water quality treatment were allowed to pay a fee in lieu of
on-site water quality treatment, with the fees to be used to
construct regional facilities.
We feel that the new requirement is inappropriate. For many
small developments, it is not feasible to build an on-site
facility. Construction of numerous small facilities will
create maintenance problems for the cities and USA. However,
we have no choice. Effective December 1st, we Must require the
facilities or be in violation of State regulations.
This issue was not addressed in our earlier staff reports, as
we expected the issue to be resolved between USA and the EQC.
We are still hopeful that the issue will be resolved within the
next three months. Therefore, the applicant should be requited
to install a water quality facility; but we recommend that the
City Engineer be allowed to waive this requirement if the
regulations are amended.
ENGINEERING COMMENTS: CUP 91-09 GTE NORTHWEST/KARLS 2
Recommendations:
1.. The applicant shall install and maintain a water quality
facility meeting the requirements of Resolution and Order No
91.47 as approved and adopted by the Unified Sewerage Agency
of Washington County, The City Engineer may waive this
requirement to the extent allowed by the regulations of the
Environmental Quality Commission and Unified Sewerage Agency
as they exist at the time the Public Improvement plans are
approved and installed.
2. Provide the following to Washington County:
A. Additional right -of --way shall be dedicated to the Public
along the SW Scholls Ferry Road frontage as requested by
Washington County.
B. An agreement shall be executed by the applicant on forms
provided by Washington County which waives the property
owner's right to remonstrate against a future Local
Improvement District or other mechanism to improve the
base facility of SW Scholls Ferry Road.
3. The applicant shall supply a copy of the executed and recorded
documents (from Washington County) to the City of Tigard
Engineer Department.
4. The applicant shall be required to connect to a public sanitary
sewer line. Alternatively, if there is no public sanitary
sewer line the applicant shall obtain written approval from the
Washington County Health Department to install a septic system.
Verification that approval has been given by the Washington
County Health Department shall be provided to the City
Engineering Department.
IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS
OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE L.ST,
1, SECTION 16.120.060 BONDING AND ASSURANCES
A. On all projects where public improvements are required
the Director shall:
1. Require a bond in an amount not greater than 100
percent of other adequate assurances as a condition
of approval of the site development plan in order to
ensure the completed project is in conformance with
,the approved plan; and
2. Approve and release such bonds.

a. The overall site area is approximately 43,560 square feet, one
acre. The proposed building area is 9,100 square feet (about 21%
lot coverage). The proposed paved area is about an additional
5,300. Maximum lot coverage allowed is 80%. Actual is 33%.
b. This site is currently heavily wooded with a designated wetlands in
the Southwest corner. GTE's desire is to leave the wetlands as it
is In addition they will leave as many trees as possible,
specifically, along Scholls Ferry Road and the perimeter of the
site. The location and setting of the site allows the construction
of the building to minimize the impact on adjacent properties and
allows a buffer onto Scholls Ferry Road.
c. The impact on eNisting public facilities will be minimal because of
the limited use of the site. The largest impact will be on
electricity, which is adequate.
d. The current zoning is R-25. The proposed utility building will be
a very translucent use of the site That is, there will be

applications for processing. No applications will be accepted after 3:00

Maps submitted with an application shall be folded in advance to 8.5 by 11
inches. One 8.5 by 11 inch map of a proposed project should be submitted
for attachment to the staff report or administrative deCision.

The Planning Division and Engineering Division will do a preliminary
review of the application and will determine whether an application is
complete within 10 days of submittal. Staff will, notify an applicant if
additional information or copies of the submitted materials are needed.
The administrative decision/public hearing typically will occur
approximately 45 to 60 days after an application is accepted as complete
by the Planning Division. Applications involving difficult issues or
requiring review by other jurisdictions may take additional time to
review. Written decisions are issued within 10 days of the hearing. A 10
day appeal period follows all Iecisions. An appeal on this matter would
be heard by the LID bit
A basic flow diagram illustrating the review process is attached to this
sheet.
The pre-application conference and the notes of the conference are
intended to inform the prospective applicant of the primary Community
Development Code requirements applicable to development of a particular
site and to allow the staff and *prospective applicant to discuss the
opportunities and constraints affecting development of the site. The
conference and notes cannot cover all Code requirements and aspects of
good site plahning that should apply to the development.of your site plan.
Failure of the staff to provide any information required by the Code °hall,
not constitute a waiver of the applicable standards or requirements.

PUBLIC FACILITIES
The purpose of the pre-application conference is tot (i) identify

including identifying who will be the final decision maker for the

TRAFFIC IMPACT FEES
In August, 1990, the Washington County Boar e of Commissioners adopted the
county-wide Traffic Impact Fee (TIP) Ordinance and referred the measure to
the Washington County voters. In September, 1990, the:paOhington County
electorate overwhelmingly approved expanding the TIF program throughout
'all jurisdictions within the county. This action placed into effect an
increased street development fee on all new development in Washington
County, The City of Tigard has adopted the county's program.
The City Traffic, Impact Fee program will collect fees from new development
based on the develepment 00 projected impact on the transportation system.
Developing properties will be required to pay based on the number of trips
they are projected to generate. The TIF is calculated based on type of
Use, size of project, and a general use based fee category. The TIF shall
be calculated at time of building permit issuance. In limited
circumstancee, payment of 'the TIF may be allowed to be deferred' until
issuance of occupancy permit. Deferral of payment until occupancy is
permissible only when the TIF is greater than $5,000.00.
STORMATER MUTE FEES
The Unified Sewerage Agency has established and the City has agreed to
enforce, Resolhtion No 90-43, Surface Water Management Regulations,
requiring the construction of on-site water quality facilities -or fees in

construction of a'water quality facility be built. The fee is based on
the amount of impervious surface; for every 2640 square feet or pOrtion
