I. SUMMARY OF THE REQUEST FINAL ORDER CUP 91-0004 The applicant, Tigard Babe Ruth Inc., proposes to install field lights at the Fowler Junior High School Babe Ruth baseball field for evening games during the summer monthes. The lights would be used between Memorial Day and August 1st each year. Once installed, the lights would become the property of the Tigard- Tualatin School District. This proposal constitutes a minor modification to an existing development. As a minor modification, the proposal would normally be subject to a Director's decision. However, since there Was some controversey over the previous approval for field lights at this site, staff has elected to move this Conditional Use Permit arplication to the Hearings Officer to allow for public testimony. The Hearings Officer received public testimony regarding this application on June 10, 1991. A record of that testimony is included as Exhibit A (Parties of Record), and Exhibit B (Taped Proceedings). These exhibits are filed at the Tigard City Hall. B. Summary of Testimoy. 1. Dick Bewersdorff, Senior Planner, testified for the City and summarized the staff report and recommendation. 2. Bud Hillman, with the Tigard-TUalatin School District 23J spoke in favor of the application submited by Tigard Babe Ruth Inc. 3. Dave Smith, with Tigard Babe Ruth Inc. indicated that the 10:30 curfew recommended by staff as a condition of approval is fine. He also indicated that the availablity of lighted fields is at a minimum, and that this addition to the facility will become the property of the school district, once the lights are installed. 4. Preston Suthrie, who is a Babe Ruth Inc. parent, also spoke in support of the lighting project. 5. Cal. Wooly, eepresenting NPO 7, indicated that the two issues of concern to the NPO, namely, limiting the hours of operation to 10 pm and the containment of "Zugitive light"; appear to be met by the proposal. V. EVALUATION OF REQUEST The Hearings Officer incorporates by reference the recommendation of the staff as set out in section C of the Staff report dated May 31, 1991, with the following amendment: Condition 4 shall be atmended as follows: 4. Southwest Walnut Street is a two-lane road and is functionally classified as a collector street. Southwest Tiedeman Avenue is located to the east of Fowler Junior High School. 3. BAIALInfkrmatign_angLEggaggal Desulaign The subject site is a part of the larger Fowler Junior High School site Summer Creek lies to the north of the baseball field. The baseball field is buffered by trees on the north and west, by the school and main parking lot on the east, and a concession stand, tennis courts, landscaping and a smaller parking lot on the soath. A track and additional recreation area are located to the northeast of the baseball field. Tigard Babe Ruth proposes to install field lights at the Fowler Junior High School Babe Ruth baseball field to provide the ability for night use of the facility 6 The lights would not be used prior to Memorial Day and would cease use by August 1 each year Once installed, the lights would become the property of the Tigard-Tualatin School District. 4. AgIngy and NPO comments The City of Tigard Building Division has reviewed the proposal and has offered the following comments: The lights should be shielded or aimed so that they do not shine on adjacent residential property. The City of Tigard Building Division and the Tualatin Valley Fire and Rescue District have reviewed the proposal and have no objections to it. No other comments have been received. B. FINDINGS AND CONCLUSIONS Section 18.05.040 of the Code lists schools and related facilities as a Conditional Use for the R-4.5 zoning district. Section 18.130.040 of the Code contains the following Oeneral approval criteria for a Conditional Use: 1. The characteristics of the site are suitable for the proposed use considering size, shape, location, topography, and natural features. 3. All required public facilities have adequate capacity to serve the proposal. 4. The applicable requirements of the zoning district are met except as modified by this chapter. 5. The supplementary requirements set forth in Chapter 18.114 (SIGNS) and Section 18.120.180 (APPROVAL STANDARDS) Site Development Review, if appliioable, are met. 6. The use will comply with the applicable policies of the Comprehensive Plan. The proposed addition of field lights at the rowler Junice: high School Babe Ruth baseball field is consistent with the above criteria. The site provides adequate area for the needfi of the existing school buildings and associated site improvements as well as for the proposed field lights. The site also allows adequate area for the installation of the proposed lights so as to not compromise public safety. There are no apparent physical obiAacles to placement of the proposed field lights on the site The only utility connection that must be made for the field lights is for electricity. Setbacks, lot coverage, and building height requirements of the R-4.5 zone are all satisfied by the existing development and will not be affected by the proposed modification. Code Section 18.130.060 'States that any modification which is not within the description of a major modification as provided in Section 18.130.050 Shall be considered a minor modification This proposal does not meet the definition listed under Major modifications to existing development, therefore, thiS proposal is defined as a miner modification to an existing development As a mint= inodification, the propot3al would normally be subject to a DireCtor's decision. However, since there was some controversy over the previous appreval for field lights at this site, staff as elected to move this Conditional Use Permit application to the Hearings Officer agenda to allow for public testimony. Code Section 18.106.030 (B) (9) (b) (Parking) provides the parking requirements for a jVnior high school. Section 18.106.020(N) requires that one appropriately sized and located handicapped parking space be provided if 26 to 50 standard parking spaces are provided, plus one additional handicapped space for each additional parking spaces provided or fraction thereof thet are provided. Additionally# Section 18.106.020(P) requires that a minimum of one secured bicycle rack space be provided for every 15 automobile parking spaces. The applicant did not address these code sections in either the applicant's narrative or within supplemental application materials. Staff therefore relies upon the most recent Site Development Review approval by the City (SDR 21-81) in order to address this issue. Specifically, this approval states: "Adequate parking exists for this facility." Additionally, the proposed installation of the field lights will not require a mandatory increase in the provision of on-site parking at this facility. The installation of field lights will allow for the expansion of the hours of operation of this baseball field. The additional numbers of players and spectators utilizing this field during the evening hours will produce additional noise and/or extended hours of noise generation. The Department of Environmental Quality (DEQ) (Chapter 340 OAR), the City of Tigard Comunity Development Code Section 18.90 (Environmental Performance Standards), and City of Tigard Ordinance (ORD 90- 30) each address the issue of allowable sound levels from noise generating sourees. ORD 90-30 7.40.180(b) states that persons conducting should level measurements shall have received training the techniques of sound measurement and the operation of sound measuring instruments from DEQ, a registered acoustical engineer e or other competent body prior to engaging in any enforcement activity. Therefore, allowable sound levels and sound measurements shall by addressed by the City of Tigard Code Enforcement Officer. Additionally staff would recommend that the evening hours of operation of this field be limited to no later than 10:30 p.m. This permit should be conditional in that if a pattern of valid complaints should develop concerning a violation of the hours of operation, the City would have the authority to reexamine and/or revoke this approval. The nearest residences are located to the west of the baseball field. The distance from the proposed location of the westernmost lights on the baseball field to the nearest residence to the west is approximately 350 feet. Due to the buffering effect of the trees which are located between the baseball field and these residences, the properties which may be most affected are those which are located on the north side of Walnut Street directly in front of the school (approximately 200 feet from the nearest north facing field light) and those residences which are located approximately 400 feet to the south across SW Walnut Street. Staff contends that these factors, together with the specific mounting angles of the lights, may provide the ability to mitigate the glare which will be emitted by the field lights. Since the applicant did not address this code requirement within the materials which were submitted for review, this requirement shall be addressed in the conditions of approval. Section 18.130.150(C)(9) contains the following additional Conditional Use criteria for a junior high school: a. Lot Size: I. There shall be no minimum lot size requirements for schools other than what is required for the applicable zoning district; b. Setbacks: i. The front yard setback shall be a minimum of 30 feet. ii. On corner lots and through lots, the setback shall be a minimum of 20 feet on any side facing a street, plus meet visual clearance areas (Chapter 18.102). al. The side yard setback shall be a minimum of 20 feet. iv. The rear yardsetback shall be a minimum of 30 feet. The proposed field light locations are consistent with all setback requirements. The proposed minor modification complies with al]. applicable Comprehensive Plan Policies as follows: 1. Policy 2.1.1 is satigfied because 1120 #5 has been informed of the proposal and has been given an opportunity to comment on the proposal. Her report included a listing of students who were successful in the recent ASB elections. COMMENTS FROM THE PUBIAZ ON AGENDA AND NON-AGENDA IT$MS Mr. David Cutrigit, parent, Indicated that he wished to speak to the policy on early entrance and Steve Meagl et, TEA member/representative, wished to speak to the tax base election. Mr. Cutright requested that the Board re-consider revising its policy which allows for testing of students who do not meet the cut-off date for entrance to kindergarten and grade 1 He stated the policy should remain as it is in order to give children who are ready for school a chance to enroll. Mr. Art Rutkin will investigate the success of those students who have been tested and admitted early. Mr. Meagher stated, ae the representative of the TEA, that the Board of Directors L'nd School District staff have the complete support of the TEA toward working for the passage of the Tax Base Election in May, 199 t. and as such, the TEA will make a contribution of $1,500 toward the support of this election. BUSINESS & OPERATIONS REPORT Bud Hillman made a report on the status of the construction projects at Hazelbrook Middle School and Tualatin High School. Frank Hodapp requested that the agenda item dealing with the bid award for portable classrooms be removed at this time to allow further review of the bids. Mr. Dave Smith from the Tigard-Tualatin Babe Ruth Board, presented a lighting project at Fowler Field, asking to light Fowler's baseball field. Director Biggs recommended approval for the Babe Ruth Association to put lights at Fowler Field and Director Carlson seconded the motion, The motion carried with unanirnous approval. Frank Hodapp presented an appropriations resolut6 to adjust funds to the Service Support area of the PL 94-141 Handicapped Program for testing through Washington County artl staff development training needs. Director Nelson made the motion to approve, this resolution as presented and Director Cutnpston seconded the motion. The motion carried, Mr, Hodapp updated the Board on events at the Legislature. The Educatiln First Coalition has proposed amendments to SB 815 which will be presented to the Legislature through the Confederation of Oregon School Administrators. This amended language would help Districts like Tigard-Tualatin as Well as smaller district through the state qualify for state replacement dollars. Staff recommended that letters and telephone calls to Delna Jones, Chairman of the House Revenue Committee, would be appropriate at this time, INSTRUCTION & CURRICULUM REPORT Dr. DavidiEm presented further information on the proposal to reduce . the graduatio requirements at Tigard High School to 23 from 25 in conjunction with establishing a six-period day at THS from a seven-period day in light of Ballot Measure 6. The study made its report and recommended implementation: Seven-periods would Still be available for junior and senior students choosing electives,. Letters are being sent out to parents in the District With this information, but with the Stipulation that the TaX Base Update is necessary for funding the existing programs.
