ZONE: R-4.5 (Residential, 405 units/acre) LOCATION: 10865 SW Walnut Street (WCTM 181 34DC, tax lot 3000, and 281 3AA, tax lot 101). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted below: A. FINDINGS OF FACT 1. Background Information Fowler Junior High School received it's original site development review approval in 1973. Subsequent development review approvals were granted 1973, and 1976. The most recent development review was in 1978 (SDR 21- 8]). This review approved the addition of ten Olastrooms/ two teacher planning areas, four restrooms and two janitorial areas. Along with this current application, there is a Conditional Use Permit under review regarding the installation of field lights at the Fowler Junior High School Babe Ruth baseball field (CUP 91-0004). This sito lies on the north side of SW Walnut Street. Southwest Walnut Street iS a two-lane road and 1.14 functionally classified as a collector street. Walnut Street is under the jutiodictitth of both the City of Tigard and Washington COUnty between approximately SW 106th Avenue and SW 135th Avenue. Besides the school building there is a large open recreation, area and track located to the north, a baseball field to the northwest, and tennis courts to the west. Summer Creek runs along the northern portion of the site A large parking area is located across the southern frontage of the site The balance of the site is essentially grass-covered. The school district proposes to expand the Junior High School operations at this site through the installation of a two classroom modular building. The modular building is proposed to be located on a blacktopped area adjacent to the southwest corner of the existing school building. Expansion of a school within the R-4.5 zoning district requires Conditional Use approval. Conditional Use review is conducted by the City's land use Hearings Officer. However, this application is classified as a minor modification to an existing conditional use because the modular unit will add less than 10% additional floor area to the existing structure(s) (Code Section 18.130.030-060). This application ia therefore subject to a staff review and not a Hearings Officer review. 4. Agency and,, 1P0 comments The City of Tigard Building Division has reviewed the proposal and has offered the following comments: 1. Public Improvements: Alter reviewing the proposal the Engineering Department has determined that all existing public improvements, streets, storm drainage, and sanitary sewer systems are adequate to handle this development and do not require additional upgrading. 2. StorM sewer: The Unified Sewerage Agency has established and the City has agreed to enforce, Resolution 90-43 Surface Water Management RegulationS, requiring construction of on-site water quality faCilities or NOTICE OF DECISION CUP 914002 - TIGARD SCHOOL DisT, PAGE 2 • fees in-lieu of their construction. The applicant has not proposed any such on-site water quality facility and based on the size and location of the development a on-site facility should not be required. In addition, even though this is a temporary structure, as explained by the applicant, the Resolution requires that the fee be paid for any development that will be in place for more than a one year period; therefor a fee in-lieu of their construction of a water quality facility should be required. The City of Tigard Building Department has reviewed the proposal and has offered the following comments: 1. Building permits shall be required prior to the placement and/or construction of the modular unit on the site. Tualatin Valley Fire and Rescue District has reviewed the proposal and has offered no comments or objections. No other comments have bee received. R. ANALYSIS AND CONCLUSION Applicable Amminslgmiteria: Community Development Code Chapters 18.50.0401 18.130.060(C), 18.130.150(C)(9), and Comprehensive Plan Policy 2.1.1. The applicable criteria for approval of a minor modification to an existing approved conditional use are contained in Code Section 18.130.060 (C). They are as follows: 1) No Code provisions will be violated; and 2) The modification is not a major modification. The proposed addition of a portable classroom building on the site of the Fowler Junior High School is consistent with the above criteria. Section 18.50,040 lists schools as a conditional use in the R-4.5 zoning district. The site was approved for this use in 19/3 when the School District was issued a building permit to construct the original zchool building. The proposal satisfies the setback, lot coverage, and building height requirements of the R-4.5 zoning district and Section 18.130.150 (C)(9) (Locational Criteria Schools). Adequate landscaping already exists on the site The site provides adequate area for the • needs of the existing school buildings 3 NOTICE OF DECISION - OUP 91-0002 - TIGARD SCHOOL DIST. PAGE •• .241: .4+ 1'•1,1■ 4 4 as well as the additional building. The only utility connection that must be made for the proposed building is for electricity. Other public service providers have not indicated that they would be unable to serve the new modular building. Existing site improvements satisfy other applicable Community Development Code requirements. Existing trees along S.W. Walnut Street provide for appropriate numbers of street trees. Existing trees also satisfy Code requirements for parking area trees. Adequate access and internal circulation are provided for by the separate access and driveway which directs the bulk of school traffic, including all school bus traffic, away from the parking area on Walnut Street. Adequate vision clearance is provided at all driveway/road intersections. Pedestrian access to the school is provided by the public sidewalk and bike path along S.W. Walnut Street. Code Section 18.106.030(B) (9) (b) addresses the parking standards required to provide adequate parking at junior high schools. This code section requires 1.5 spaces for every employee, plus 1 space for each 100 square feet of floor area in the auditorium or other assembly or 1 space for each 8 seats, whichever is greater. This criterion was not addressed within the applicant's narrative or supplemental information, nor was this information readily attainable by the City. Therefore, this code requirement shall be addressed through the conditions or approval. It is required that the parking areas provide at least one appropriately sized and located handicapped parking space for every 50 standard parking gpaces (Section 18.106.020(N)) . This standard was not addressed within the information provided in the application materials. Additionally, the applicants' proposed placement of the modular classroom unit will displace three bicycle parking racks. Code Section 18.106.020(P), which requires that a minimum of one secured bicycle rack space be provided for every 15 automobile parking spaces, was similarly not addressed in this application. Therefore, these code requirements shall be addressed through the conditions of approval. The proposed expanded use complies with applicable plan policies as follows: 1. Policy 2.1.1 is satisfied because NPO #7 has been informed of the proposal and hag been given an opportunity to comment on the proposal. In addition, notice of the proposal and the opportunity to comment on the proposal has been sent to nearby property • owners. NOTICE or DECISION - CUP 91-0002 - TIGARD SCHOOL DIST. PAGE 4 0 • • • C. RECOMMENDATION: The Planning Director's designee for the City of Tigard approves Conditional Use Permit CUP 91-0002 allowing placement of a portable modular classroom on the Fowler Junior High School site SUBJECT TO THE FOLLOWING CONDITIONS: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF A BUILDING PERMIT FOR INSTALLATION OF THE PROPOSED MODULAR BUILDINGS. 1. The applicant shall submit either a revised site plan specifying the new location of the three displaced bicycle parking racks, or verification that the three displaced bicycle parking racks are in excess of that which the code requires and therefore their retention is not necessary. Hillman; X am writing in response to our telephone conversation on July 3, 1991 regarding parking requirements for Tigard public schools. The need to address parking requirements stems from the recently submitted conditional use applications, wherein School District 23J has received approval to allow the placement of temporary modular classrooms on school grounds within the City. The code requirements regarding the provision of adequate on-site parking for elementary and junior high schools, state that 1.5 spaces be provided for each employee of the school. Two additional employees shall be added to each school. This would necessitate a minimum of three additional parking spaces to be added to each of the affected scholls. Therefore, School District 23J has proposed, and the City has accepted, the addition of the following numbers of parking stalls to compensate for additional teaching staff at each of the following schools: Pour (4) spaces to be added to Twality Junior High School ao Four (4) spaces to be added to Templeton Elementary School Three (3) spaces to be to Fowler Junior High School Three (3) spaces to be added to Macy Woodtdard. Twality Junior High and Fowler Junior High now exceed capacity and projections indicate continued growth. We therefore find it necessary to request conditional use for one temporary classroom building at Twality and one building at Fowler. Conditional use is requested through September 1993, At that time we will have additional permanent schools constructed that will help to eliminate the need for temporary portable structures. The buildings will be portable in construction, Manufactured by a firm in that meets all Oregon requirements for temporary structures and issues an Oregon Certification on factory inspection for compliance with building codes. The buildings will be approximately 28 x 6O', with two classrooms. The classrooms will be heated and air-conditioned. The exterior of the buildings shall be T-111, painted to match the existing school The buildings will have a sidewalk, ramps with handrails and porches of suitable size. No utility connections will be required other than electricity. It is planned to obtain electricity from the existing school power.
