MMD2005-00007 MMD2005 - 00007 CASCADE VETERINARY CLINIC May 23, 2005 I:411 Leonard Lodder, AIA CITY OF TIGARD Webstar IV LLC 610 Glatt Circle OREGON Woodburn, OR 97071 RE: Cascade Veterinary Clinic Minor Modification Request, Case File No. 0 D2005-0000 Dear Mr. Lodder: This letter is in response to your request for a Minor Modification (MMD2005-00007) of the approved site development plan (SDR 2004-00012) located at 11140 SW 68th Parkway, WCTM 1 S136DA, Tax Lot 02600. You have requested to modify the approved site plan by correcting the building square footage from 9,512 square feet to 9,612 square feet. The submitted construction plans reflect the corrected square footage amount. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Table 18.765.2 states that the minimum parking for Office Uses is 2.7 per 1,000 gross square feet. Under the original approval with a building square footage of 9,512, the off-street parking requirement was 25 parking spaces. With the proposed change in square footage to 9,612, the requirement is 26 spaces. The site lies within the Zone B parking area for the purpose of calculating maximum number of parking spaces. The maximum allowed parking is 4.1 spaces per 1,000 gross square feet or 39 spaces. The applicant has proposed 37 parking spaces which is in compliance 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to the existing building that will affect the height. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. No changes to the access points, driveway aisles, or location of parking is being requested with this application. This standard is satisfied. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. A traffic study submitted for the original review indicated an estimated total of 44 trips would be generated during peak traffic hours. The correction to building area by 100 square feet will not increase the number above 100 vehicle trips per day. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The original submitted plan had an actual building square footage of 9,612 square feet. Building square footage was stated on the plans to be 9,512 square feet. This change will increase the square footage of the building by only 100 square feet or approximately 1%. Therefore, this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. Because the actual square footage and the footprint of the building are not changing, no open space will be affected by the proposal. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed change will not reduce or eliminate project amenities. Recreational facilities, screening, and landscaping will not be modified from the original proposal. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. This request will not affect compliance with any specific previous conditions of approval. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an approved site development plan. The Director's designee has determined that the proposed minor modification of this existing plan will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws.
