MMD2004 -. 00002 NORTHWEST MEDICAL TEAMS 9 February 11, 2004 CITY OF TIGARD OREGON Group Mackenzie Attn: Bill Bezio PO Box 69039 Portland, OR 97239-0039 Dear Mr. Bezio: This letter is in response to your request for Minor Modification (MMD2004-00002) approval to relocate the main entrance and ADA parking spaces, install an overhead door on the northeast facade, install 2 strip windows along the northeast facade, and to construct a 1,250 square foot mezzanine addition to the interior of the office space for Northwest Medical Teams at 14150 SW Milton Court. The site is described as WCTM 2S112AB, tax lot 02300. The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." The original building was approved and constructed under a 1995 Site Development Review (SDR 95-00010.) Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. At the time of the original Site Development Review approval, the applicant was required to provide a minimum of 80 parking spaces. TDC Section 18.765.030(D) allows the primary use to provide 100% of required parking and the secondary use to provide for 90% of required parking. Therefore, the warehouse portion of the structure requires .05 spaces per 1,000 square feet of space. At a size of 33,000 square feet of warehouse, the primary use of the site requires 17 parking spaces. The office portion would require 2.7 spaces per 1,000 square feet of space. At a size of 28,800 square feet the secondary use portion of the building requires 70 parking spaces. The site would therefore require a total of 87 parking spaces. The present site plan indicates that there are exactly 87 parking spaces on site. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the building is proposed. The applicant is proposing to modify the structure and add a 1,500 square foot mezzanine within the structure; however, these changes do not change the type of occupancy for this structure. At the time that it was originally approved, it was defined as a B/S-1 occupancy type by Table 3-A of the Oregon Structural Specialty Code. The proposed modifications do not change this occupancy type. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The building height will not be increased as a result of this proposal. All proposed improvements are to the existing building, and require only minor structural modifications. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification is not expected to generate anymore vehicular trips than what is already occurring with the existing warehouse operation. Therefore, this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. Ten percent of the previously approved use is 4,890 square feet. The increase in floor area on this project is proposed to be 1,500 square feet. This standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The modification will not affect landscaping or open space by more than ten percent. The original amount of landscaping was 34,338 square feet and constituted 26.3 percent of the site. The I-L zoning classification only requires that 15 percent of the site be landscaped. The applicant is proposing to increase the total amount of impervious surface by 164 square feet, which is well under ten percent of the pre-approved landscaping of 34,338 square feet. This criterion is satisfied. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The addition will not reduce project amenities below the minimum of the development code. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The modification will not impact any of the conditions of approval of SDR95-00010. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE AFOREMENTIONED FINDINGS. In discussions with City staff in September 2003, Mr. Brewersdorf determined that the Northwest Medical Teams use would fall into the category of Warehouse and Freight Movement,which is permitted in the I-L zone.The proposed program consists of a 33,000 SF warehouse and 28,800 SF of office space(27,300 SF existing plus the 1,500 SF mezzanine addition). Office space is not permitted outright in the I-L zone; however, accessory office uses,as proposed,are.The Tigard Code does not specify a maximum limit on the amount of building area that can be utilized for accessory uses. However, since the office is clearly subordinate to the warehouse use of the proposed program,it is therefore permitted within the I-L zone.
