ANTHONY CHURCH March 7, 2003 44t CITY OF TIGARD St. Anthony Church Attn: Fran Avery OREGON 9905 SW McKenzie Tigard, OR 97223 Dear Ms. Avery: This letter is in response to your request for Minor Modification (MMD2003-00005) approval to CUP2002-00006, which approved the expansion and the renovation of the existing parish facilities. The minor modification request is to relocate the existing construction trailer to the southwest portion of the lot, next to the existing offices. The construction trailer is used to store and distribute emergency food by the St. Vincent DePaul Society. The subject property is located at 9905 SW McKenzie Street (WCTM 2S102BD, Tax Lot 00100) The Tigard Community Development Code, Conditional Use Section, states; "Upon the Director determining that the proposed modification to the conditional use plan is a major modification, the applicant shall submit a new application in accordance with Section 19.320.020A." Section 18.330.020.B. states that the Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: 1. A change in land use. he requested modification does not involve a change of use. Therefore, this standard does not apply. 2. An 10% increase in dwelling unit density. The requested modification is to relocate an existing construction trailer. Therefore, density is not an issue of the applicant's request. 3. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected. The request is to relocate an existing construction trailer, which will temporarily eliminate 4-5 parking spaces. However, there are presently 284 existing parking stalls on-site. According to the Tigard Development Code the site is required to provide 233 parking stalls. Therefore, the reduction of 4-5 parking stalls will not warrant the applicant to apply for a major modification. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The requested modification is to relocate a construction trailer elsewhere on the subject site. Therefore, no increase in floor area is proposed. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space. There will be no reduction in area reserved for common open space. The requested modification is to move the existing construction trailer to the southwest side of the site, which is paved and used for parking. 6. A reduction of specified setback requirements by more than 20%. Existing Structures located on the subject site are to maintain a 20-foot setback from SW McKenzie Street. An elimination of project amenities by more than 10 % where previously specified provided such as: Recreational facilities; Screening; or Landscaping provisions. No project amenities will be eliminated with the requested modification. Therefore, this standard does not apply. 8. A 10% increase in the approved density. The subject site is constructed with a church. Therefore, density is not an issue with this site. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, or injurious to surrounding properties, provided that development which occurs after this decision complies with all applicable local, state, and federal law.
