MMD2004-00013 MMD2004 00013 LIBRARY GAZEBO AND SHELTER August 11, 2004 ^'' CITY OF TIGARD OREGON City of Tigard Attn: Duane Roberts 13125 SW Hall Blvd. Tigard, OR 97223 Dear Mr. Roberts: This letter is in response to your request for Minor Modification approval (MMD2004-00013) to modify CUP2003-00001/SLR2003-00001NAR2003-00009 (the new Tigard Public Library). The request is for approval to install a wood, 25 x 25 foot hexagonal gazebo/picnic shelter, located within the northwest quadrant of the subject property, between Fanno Creek and the north wall of the library building at 13500 SW Hall Boulevard; WCTM 2S102DA, Tax Lot 00600. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; the proposal is to construct a 625 square foot gazebo/picnic shelter for the new library. Therefore, there will be no change in the approved land use. 2. An 10% increase in dwelling unit density; this criterion is not applicable, as this request does not involve a residential development. 3. A change in the type and/or location of accessways and parking areas where off- site traffic would be affected; the proposal is for a 625 square foot gazebo. No changes to the existing acessway to the library site will occur. This standard has been satisfied. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; the proposal is to place a gazebo in the northwest portion of the library site. Therefore, no increase in floor area to the library will occur. This standard has been satisfied. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; the project qualifies as an open space facility and, as such, its construction will not change the previously-approved area of common and usable open space. Therefore, this standard has been satisfied. 6. A reduction of specified setback requirements by more than 20%; the applicant is proposing to construct a 625 square foot gazebo. Therefore, the library's setbacks will not be reduced. 7. An elimination of project amenities by more than 10% where previously specified provided such as; Recreational facilities; Screening; or Landscaping provisions; the applicant is proposing to construct a gazebo, which will enhance the usable open space of the new Tigard Library. A 10% increase in the approved density; the proposed request does not involve residential property. Therefore, this standard does not apply. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITIONS OF APPROVAL. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. 1. Only the preferred gazebo/picnic shelter location (OPTION B) is approved. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws.
