MMD2004-00009 MMD2004 00009 AT & T PCS WIRELESS ADDITION CITY OF TIGARD April 27, 2004 OREGON Paul Slotemaker AT&T Wireless, Inc. 506 SW 6th Avenue, Suite 900 Portland, OR 97204 RE: Minor Modification Request of CUP95-00004, Case File No. MMD2004-00009 Dear Mr. Slotemaker: This letter is in response to your request for a Minor Modification (MMD2004-00009) of the approved site development and conditional use permit located at 12655 SW North Dakota Street, WCTM 1S134BC, Tax Lot 00700. You have requested to add additional antenna array and associated equipment cabinets to the existing monopole for AT&T PCS. The submitted site and elevation plans reflect the current conditions and proposed additions. Analysis of Modification Request: Section 18.330.020.B. of the Tigard Development Code Conditional Use chapter, states; "any modification which i s n of within the d escription of a m ajor m odification a s p rovided i n [section 18.330.020.A.] shall be considered a minor modification." Section 18.330.020.A. states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: A. A change in land use; The previous and proposed land use are the same, therefore no change in land use is proposed. B. An 10% increase in dwelling unit density; No residential development is proposed. This criterion does not apply. C. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The equipment and monopole are outside of the parking area behind the building. No accessways or parking areas are affected by this request. No off site traffic would be affected by these changes, therefore this criterion is satisfied. D. This criterion does not apply. E. A reduction of more than 10% of the area reserved for common open space and/or usable open space; No areas of common or usable open space were required of this project. Landscaping area will remain unchanged. F. A reduction of specified setback requirements by more than 20%; Setbacks are unaffected by this proposal. This standard is met. G. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions; and No specific screening or buffering applies to this property boundary as the abutting use is also commercial in nature. Landscaping will not be reduced by this proposal. H. A 10% increase in the approved density; No residential development is proposed. This criterion does not apply. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws.
