CITY OF TIGARD City of Tigard OREGON Attn: Duane Roberts 13125 SW Hall Blvd. Tigard, OR 97223 Dear Mr. Roberts: This letter is in response to your request for Minor Modification approval (MMD2005-00003) to modify CUP2003-00001/SLR2003-00001NAR2003-00009NAR2003-00020 (the new Tigard Public Library). The request is for approval to install a 1,800 square foot parking area along SW Hall Boulevard, north of the existing Tigard Library Building. The driveway connection to the proposed parking area to SW Hall Boulevard is the pre-existing access to a former single-family home. This request also includes a 150-foot walkway leading from the proposed parking area to the existing gazebo and to the future intersection with the Fanno Creek Greenway Trail. The parking area and pathway are located outside any required vegetated corridor areas, wetland areas, and any portion of the 100-year floodplain. The applicant has shown on the plans where the proposed trail will end and where the future extension into the 100-year floodplain will extend. The subject property, is located at 13500 SW Hall Boulevard; WCTM 2S102DA, Tax Lot 00600. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The proposal is to construct a 1,800 square foot parking area with associated walkway. No change in the approved land-use (Library) is proposed. 2. An 10% increase in dwelling unit density; This criterion is not applicable, as this request does not involve a residential development. 3. A change in the type and/or location of accessways and parking areas where off- site traffic would be affected; Southwest Hall Boulevard is controlled and maintained by the Oregon Department of Transportation (ODOT). A permit to use the existing access off of Hall Blvd. was granted by ODOT at the time the City of Tigard made application to build the new library. At that time the existing curb cut was for a single- family home, which was to be used as a support structure for the new library until the home was destroyed by fire. A letter from ODOT has been included in the record stating that the proposed parking lot does not change the original ODOT approval as long as the library's parking lot is not connected to the proposed. Based on ODOT's approval, this standard is satisfied. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The definition of "floor area" excludes space devoted to off-street parking. A reduction of more than 10% of the area reserved for common open space and/or usable open space; The applicant has indicated that the subject site consists of five plus acres. An eighteen hundred square foot parking area serving the open space users is under a tenth of a percentage of five acres. Therefore, this standard is satisfied. 6. A reduction of specified setback requirements by more than 20%; The applicant's proposal does not include any alteration of the existing setbacks that apply to the library site. Therefore, this standard does not apply. 7. An elimination of project amenities by more than 10% where previously specified provided such as; Recreational facilities; Screening; or Landscaping provisions; The proposed project is intended to serve open space users exclusively. The proposed improvements represent an enhancement to the usable open space of the new Tigard Library. Therefore, this standard has been satisfied. 8. A 10% increase in the approved density; The proposed request does not involve residential property. Therefore, this standard does not apply. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION OF APPROVAL. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental or injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. Sincerely, go■ Mathew Scheidegger Associate Planner I:\curpin\mathew minmod\mmd2005-00003.dec c: CUP2003-00001 Land Use File MMD2005-00003 Page 2 of 2 Request for a Minor Modification to modify CUP2003- 00001/SLR20001/VAR2003-00009 Applicant Narrative: This is a request by the City of Tigard, as applicant, to install a small, approximately 40- foot by 45 foot, 4-stall, paved parking lot along Hall Boulevard, north of the existing Tigard Library building. The driveway connecting to Hall Boulevard is a pre-existing access to a former single family residential lot. The request also includes approval for the installation of 150 feet of 8-foot wide, hard surface trail leading from the proposed parking lot to an existing gazebo/shelter and onward to a future segment of the main stem Fanno Creek Greenway Trail. The parking lot is located outside any required vegetated corridor areas, wetland areas, and any portion of the 100-year floodplain. The same is true of the proposed pedestrian/bicycle trail. The trail alignment does not intrude into any required vegetated corridor, wetland, or any portion of the 100-year floodplain. The trail and all connections will be set at grade level and will not disrupt the existing hydrology. Runoff will sheet flow over the pavement. A future extension of this trail will connect to the Fanno Greenway Trail main stem trail. This proposed extension will intrude into the 100-year floodplain. This floodplain segment will be included as part of a future Fanno Creek Greenway trail Sensitive Lands Permit application. A water quality swale is located east and north, respectively,of the proposed parking lot and trail improvements. The improvements do not interfere with or disturb the swale. One tree will be removed as result of the improvement. As identified in the project site map,this is a 32-inch cedar located within the footprint of the proposed parking lot area. Approximately the top half of the cedar in question is missing. According to City forester Matt Stine,the topping of the tree appears to be the result of ice damage. As noted,the hammer-head parking area is proposed to include four parking spaces, one of which will be striped for handicapped parking. A CWS-required Natural Resource Assessment and site plan, depicting the parking area and trail along with other existing and proposed site improvements has been submitted to and approved by CWS. A CWS Service Provider Letter is included in this submittal. The Minor Modification approval criteria are listed below,along with a discussion of how each applies to the project under discussion. 1. A change in land use: the proposal is to construct some 1,800 square feet of paved parking and an 8-foot wide trail 150 feet in length. No change in the approved primary use of the land as a public library is proposed T � 2. A 10% increase in dwelling unit density: this criterion is not applicable to the present proposal. No residential use is proposed. 3. A change in the type and/or location of accessways and parking areas where off- site traffic would be affected: The driveway in existing. It formerly served a single family house. The present paved curb and driveway were identified as site improvements in the Conditional Use Permit proposal for the library. The house was destroyed by fire some two years ago. The new parking area is designed to serve gazebo users and as a trail head for the Fanno Creek Greenway Trail. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified: No increase in the floor area of the library is proposed. 5. A reduction in the floor area proposed for non-residential use by more that 10% of the area reserved for common open space and/or usable open space. Altogether, the library site includes some 5 plus acres of open space. The trail connection is included in the definition of open space. The new parking area accounts for only a fraction of the usable open space and is intended to serve open space users, as opposed to library patrons. The parking area and trail are support facilities to the open space. The open space on the library property is also known as the Fanno Creek Park extension. 6. A reduction of specified setback requirements by more than 20%: The present proposal does not include any alteration of the existing setbacks that apply to the library site. 7.
