Raz, President Raz Transportation Company 1660 SW Bertha Boulevard Portland, OR 97219 Re: Minor Modification for an above ground fuel storage tank Dear Mr. Raz: This letter is in response to your request for a Minor Modification of the previous land use approval for the property at 11655 SW Pacific Highway. You have requested to install a 15,000 gallon above ground diesel tank to serve the Raz Transportation bus shuttle use. The Director has approved this request as proposed. The fuel tank would be located approximately 470 feet north of SW Pacific Highway. Because the residential (R-12) zoning begins at approximately 560 feet north of SW Pacific Highway, the tank can be sited at the location as proposed. Based on the related Director's Interpretation Letter concerning the non-conforming use of the commercial and residential portions of the property, no screening and buffering measures are recommended at this time. AS STATED: THE PURPOSE OF THESE REGULATIONS IS TO GUIDE THE INSTALLATION OF STATIONARY FUEL TANKS WITHIN THE CITY LIMITS IN RESIDENTIAL. COMMERCIAL .AND INDUSTRIAL ZONES. THIS LEAVES US TO BELIEVE THAT THE CODE WOULD ALLOW DIESEL FUEL TO BE STORED WITHIN THIS ZONE. AS AN ACCESSORY USE TO THE PROPERTY. TO HELP WRITE THE EXISTNG CITY OF TIGARD CODES,ALLOWING THE USE OF ABOVE GROUND FUEL TANKS. AT THAT TIME WE WERE WORKING UNDER THE UFC '91 CODES, AS REVISED BY THE STATE FIRE MARSHALS OFFICE. FOR THE PAST 20 YEARS I HAVE DONATED MY TIME TO THE STATE AND LOCAL FIRE DEPARTMENTS. IN AIDING THEM TO UNDERSTAND FUELS AND FUEL SYSTEMS. I HAVE SERVED FOR MANY YEARS ON THE STATE FIRE MARSHAL OFFICE'S CODE COMMITTEE. FOR FUEL SYSTEMS. THE 1991 UFC CODE HELD THAT THE USE OF ABOVE GROUND TANKS SHOULD BE LIMITED TO SIX THOUSAND GALLONS, T'.MES THREE TANKS, FOR A TOTAL OF 18,000 GALLONS. HOWEVER, THE STATE REVISED CODES ALLOWED FOR CLASS II AND III COMBUSTIBLE LIQUIDS, WITH THE APPROVAL OF THE FIRE CHIEF AND JURISDICTION.TO BE RAISED IN CAPACITY TO ANY SIZE THAT WAS REQUESTED AND APPROVED BY THE LOCAL CHIEF. WE HAVE INSTALLED HUNDREDS OF 15.000 TO 30,000 GALLON FUEL TANKS. THROUGHOUT THE NORTHWEST, WITH FULL APPROVALS. THE THREE SIX THOUSAND GALLON BASIC STORAGE TANKS 2 USE WAS ORIGINALLY DESIGNED FOR THE USE IN RETAIL, OPEN TO THE PUBLIC, SERVICE STATIONS. THESE TANKS WOULD OF STORED MOSTLY GASOLINE. AS WE WERE BUILDING THE 1994 UFC, WE LOOKED AT WHAT REALLY WAS NEEDED AND HAPPENING, WITI IlN A SAFE PERIMETER TO THE PRESERVATION OF LIFE, PROPERTY, AND THE ENVIRONMENT. WE WERE LOOKING AT THE SIZE OF A NORMAL LOAD OF FUEL THAT WAS COMING INTO THE STORAGE SYSTEMS. THAT AVERAGED 10,000 TO 12,000 GALLONS OF FUEL, ON TODAY'S MODERN TANKERS. IT WAS OUR BELIEF THAT IT WAS MUCH SAFER TO STORE THE LARGER AMOUNT OF FUEL IN ONE TANK, SO AS TO NOT CAUSE THE DELIVERY DRIVER TO RUN THE INCOMING FUEL UP AGAINST THE 90% LIMITING VALVE, IN AT LEAST TWO IF NOT THREE OF THE TANKS. THIS IN TIME WOULD CAUSE AT LEAST ONE OF THE LIMITING VALVES TO FAIL, AND WOULD ALLOW THE FUEL TO THEN JUST RUN OVER THE TOP OF THE TANK. AND TO WHERE EVER THAT MIGHT TAKE IT. THIS WAS DEEMED TO BE AN UNSAFE PRACTICE, AND WE CHANGED IT. THE '94 UFC RAISED THE STORAGE LIMIT TO 10.000 GALLONS, AND UP TO 40,000 COMBINED STORAGE. THIS AGAIN WAS INTENDED TO LIMIT THE RETAIL SERVICE STATION SIZE OF STORAGE. THE COMMERCIAL. INDUSTRIAL USERS WERE AGAIN LEFT UP TO THE LOCAL CHIEF AND JURISDICTION. WITHIN THE T.V.F.R. AREA. THEY HAVE ALLOWED UP TO A 30,000 GALLON DIESEL, SINGLE COMPARTMENT TANK. ALONG WITH OTHER TANKS, WITHIN THE SAME FUELING AREA. TO BE INSTALLED. ANOTHER DECIDING PART OF THIS DECISION, TO ALLOW THE LARGER TANKS, WAS TO ONLY HAVE THE FOUR SIDES OF ONE TANK TO COOL. IN PLACE OF THE SIXTEEN SIDES OF THE FOUR TANKS, IN THE EVENT OF A FIRE THAT MIGHT ALSO INVOLVE THE TANKS. THE LARGER FUEL TANK ACTS AS AN INSULATING FACTOR TO THE STORED FUEL. MY PAST EXPERIENCE INCLUDES BUILDING AND MAINTAINING BULK PLANTS AND SERVICE STATIONS, WITH THIRTY FIVE YEARS OF IT BEING WITH CHEVRON USA. OVER THE PAST FORTY PLUS YEARS THAT I HAVE BEEN WITHIN THIS BUSINESS, I DO NOT KNOW OF ANY INSTANCES THAT THE FUEL SYSTEM HAS CAUSED ANY FIRES. WE HAVE HAD SOME TANKS THAT WERE EXPOSED TO CLOSE BUILDING OR EQUIPMENT FIRES. THE TANKS T7-1AT WERE EXPOSED. BUILT AFTER 1984. UNDER EDITION SIX U/L 142 STANDARDS. DID NOT ADD TO THE FIRE. THEY JUST STAYED DORMANT. AND AFTER THE FIRE THEY WERE CHECKED OUT. TESTED. REPAINTED. AND PLACED BACK INTO FULL SERVICE. FROM THE ABOVE INFORMATION. WE THEREFORE ARE ASKING THE CITY OF TIGARD TO ALLOW US TO USE ONE FIFTEEN THOUSAND GALLON TANK. 3 FOR THE STORAGE AND DISTRIBUTION OF DIESEL FUEL INTO THEIR EQUIPMENT. THIS TANK IS U/L 142 WITH: MONITORED 100% + FULLY SECONDARY CONTAINMENT. WITH A SEISMIC FOUR FREE STANDING RATING, THE REQUIRED PRIMARY AND SECONDARY EMERGENCY VENTING. TIlE REQUIRED HIGH LEVEL 90% LIMITING TO FULL VALVE, THE REQUIRED ANTI-SIPHON VALVES, AND ALL OF THE REST OF THE REQUIRED EQUIPMENT. THE TANK. BY FIRE CODE DIRECTION, IS PAINTED WHITE. FOR THE REFLECTION OF ALL INCOMING RADIATED HEAT. THIS SYSTEM IS VERY NEAT. ORDERLY, NON-BUSY LOOKING. IT IS CONSIDERED BY BOTH FIRE AND PLANNING DEPARTMENTS. TO HAVE AN ACCEPTABLE EYE APPEAL. AND LOOKS LIKE IT BELONGS THERE. THEREFORE, IT DOES NOT STAND OUT LIKE A SORE EYE. THE ONE TANK WILL TAKE UP LESS SPACE AND WILL BE TEN FOOT HIGH, THIRTY-TWO FEET LONG. AND IN A CYLINDRICAL DESIGN. BUILT ON SADDLE SUPPORTS. A THREE TANK SYSTEM LOOKS VERY BUSY. HARD TO KEEP THE TANK AND AREA CLEAN, AND HAS A TANK FARM EYE APPEAL. AS YOU CAN SEE, WE COULD GO ON AND ON ABOUT THIS AND THESE SYSTEMS. THEREFORE. I WOULD REQUEST THAT YOU REVIEW THE THE ABOVE. AND REQUEST ANY INFORMATION THAT I MAY HAVE OVERLOOKED. LOOKING AT THE TIGARD MUNICIPAL CODE, CHAPTER 18.104 - FUEL TANK INSTALLATIONS, WE REQUEST THE FOLLOWING: 01 - THE CODE STATES THAT FLAMMABLE LIQUIDS (CLASS I) - GASOLINE - MAY ONLY BE STORED IN INDUSTRIAL ZONES. AS STATED: THE PURPOSE OF THESE REGULATIONS IS TO GUIDE THE INSTALLATION OF STATIONARY FUEL TANKS WITHIN THE CITY LIMITS IN RESIDENTIAL, COMMERCIAL AND INDUSTRIAL ZONES. THIS LEAVES US TO BELIEVE THAT THE CODE WOULD ALLOW DIESEL FUEL TO BE STORED WITHIN THIS ZONE, AS AN ACCESSORY USE TO THE PROPERTY. TO HELP WRITE THE EXISTING CITY OF TIGARD CODES, ALLOWING THE USE OF ABOVE GROUND FUEL TANKS. AT THAT TIME WE WERE WORKING UNDER THE UFC `91 CODES, AS REVISED BY THE STATE FIRE MARSHALS OFFICE. FOR THE PAST 20 YEARS I HAVE DONATED MY TIME TO THE STATE AND LOCAL FIRE DEPARTMENTS, IN AIDING THEM TO UNDERSTAND FUELS AND FUEL SYSTEMS. I HAVE SERVED FOR MANY YEARS ON THE STATE FIRE MARSHAL OFFICE'S CODE COMMITTEE, FOR FUEL SYSTEMS. THE 1991 UFC CODE HELD THAT THE USE OF ABOVE GROUND TANKS SHOULD BE LIMITED TO SIX THOUSAND GALLONS, TIMES THREE TANKS, FOR A TOTAL OF 18,000 GALLONS. HOWEVER, THE STATE REVISED CODES ALLOWED FOR CLASS II AND III COMBUSTIBLE LIQUIDS, WITH THE APPROVAL OF THE FIRE CHIEF AND JURISDICTION, TO BE RAISED IN CAPACITY TO ANY SIZE THAT WAS REQUESTED AND APPROVED BY THE LOCAL CHIEF. WE HAVE INSTALLED HUNDREDS OF 15,000 TO 30,000 GALLON FUEL TANKS. THROUGHOUT THE NORTHWEST, WITH FULL APPROVALS. THE THREE SIX THOUSAND GALLON BASIC STORAGE TANKS 2 USE WAS ORIGINALLY DESIGNED FOR THE USE IN RETAIL, OPEN TO THE PUBLIC, SERVICE STATIONS. THESE TANKS WOULD OF STORED MOSTLY GASOLINE. AS WE WERE BUILDING THE 1994•UFC, WE LOOKED AT WHAT REALLY WAS NEEDED AND HAPPENING, WITHIN A SAFE PERIMETER TO THE PRESERVATION OF LIFE, PROPERTY, AND THE ENVIRONMENT. WE WERE LOOKING AT THE SIZE OF A NORMAL LOAD OF FUEL THAT WAS COMING INTO THE STORAGE SYSTEMS. THAT AVERAGED 10,000 TO 12,000 GALLONS OF FUEL, ON TODAY'S MODERN TANKERS. IT WAS OUR BELIEF THAT IT WAS MUCH SAFER TO STORE THE LARGER AMOUNT OF FUEL IN ONE TANK, SO AS TO NOT CAUSE THE DELIVERY DRIVER TO RUN THE INCOMING FUEL UP AGAINST THE 90% LIMITING VALVE, IN AT LEAST TWO IF NOT THREE OF THE TANKS. THIS IN TIME WOULD CAUSE AT LEAST ONE OF THE LIMITING VALVES TO FAIL, AND WOULD ALLOW THE FUEL TO THEN JUST RUN OVER THE TOP OF THE TANK, AND TO WHERE EVER THAT MIGHT TAKE IT. THIS WAS DEEMED TO BE AN UNSAFE PRACTICE, AND WE CHANGED IT. THE `94 UFC RAISED THE STORAGE LIMIT TO 10,000 GALLONS, AND UP TO 40,000 COMBINED STORAGE. THIS AGAIN WAS INTENDED TO LIMIT THE RETAIL SERVICE STATION SIZE OF STORAGE. THE COMMERCIAL, INDUSTRIAL USERS WERE AGAIN LEFT UP TO THE LOCAL CHIEF AND JURISDICTION. WITHIN THE T.V.F.R. AREA, THEY HAVE ALLOWED UP TO A 30,000 GALLON DIESEL, SINGLE COMPARTMENT TANK, ALONG WITH OTHER TANKS, WITHIN THE SAME FUELING AREA,TO BE INSTALLED. ANOTHER DECIDING PART OF THIS DECISION,TO ALLOW THE LARGER TANKS, WAS TO ONLY HAVE THE FOUR SIDES OF ONE TANK TO COOL, IN PLACE OF THE SIXTEEN SIDES OF THE FOUR TANKS, IN THE EVENT OF A FIRE THAT MIGHT ALSO INVOLVE THE TANKS. THE LARGER FUEL TANK ACTS AS AN INSULATING FACTOR TO THE STORED FUEL. MY PAST EXPERIENCE INCLUDES BUILDING AND MAINTAINING BULK PLANTS AND SERVICE STATIONS, WITH THIRTY FIVE YEARS OF IT BEING WITH CHEVRON USA. OVER THE PAST FORTY PLUS YEARS THAT I HAVE BEEN WITHIN THIS BUSINESS, I DO NOT KNOW OF ANY INSTANCES THAT THE FUEL SYSTEM HAS CAUSED ANY FIRES. WE HAVE HAD SOME TANKS THAT WERE EXPOSED TO CLOSE BUILDING OR EQUIPMENT FIRES. THE TANKS THAT WERE EXPOSED. BUILT AFTER 1984, UNDER EDITION SIX U/L 142 STANDARDS, DID NOT ADD TO THE FIRE. THEY JUST STAYED DORMANT, AND AFTER THE FIRE THEY WERE CHECKED OUT, TESTED, REPAINTED, AND PLACED BACK INTO FULL SERVICE. FROM THE ABOVE INFORMATION, WE THEREFORE ARE ASKING THE CITY OF TIGARD TO ALLOW US TO USE ONE FIFTEEN THOUSAND GALLON TANK, 3 FOR THE STORAGE AND DISTRIBUTION OF DIESEL FUEL INTO THEIR EQUIPMENT. THIS TANK IS U/L 142 WITH: MONITORED 100%+ FULLY SECONDARY CONTAINMENT, WITH A SEISMIC FOUR FREE STANDING RATING, THE REQUIRED PRIMARY AND SECONDARY EMERGENCY VENTING, THE REQUIRED HIGH LEVEL 90% LIMITING TO FULL VALVE, THE REQUIRED ANTI-SIPHON VALVES, AND ALL OF THE REST OF THE REQUIRED EQUIPMENT. THE TANK, BY FIRE CODE DIRECTION, IS PAINTED WHITE, FOR THE REFLECTION OF ALL INCOMING RADIATED HEAT. THIS SYSTEM IS VERY NEAT, ORDERLY,NON-BUSY LOOKING. IT IS CONSIDERED BY BOTH FIRE AND PLANNING DEPARTMENTS, TO HAVE AN ACCEPTABLE EYE APPEAL, AND LOOKS LIKE IT BELONGS THERE. THEREFORE, IT DOES NOT STAND OUT LIKE A SORE EYE. THE ONE TANK WILL TAKE UP LESS SPACE AND WILL BE TEN FOOT HIGH,THIRTY-TWO FEET LONG, AND IN A CYLINDRICAL DESIGN, BUILT ON SADDLE SUPPORTS. A THREE TANK SYSTEM LOOKS VERY BUSY, HARD TO KEEP THE TANK AND AREA CLEAN, AND HAS A TANK FARM EYE APPEAL. AS YOU CAN SEE, WE COULD GO ON AND ON ABOUT THIS AND THESE SYSTEMS. THEREFORE, I WOULD REQUEST THAT YOU REVIEW THE THE ABOVE, AND REQUEST ANY INFORMATION THAT I MAY HAVE OVERLOOKED.
