Thayer CITY OF TIGARD Palston Architects OREGON 15220 NW Greenbrier Parkway, Suite 340 Beaverton, OR 97006 Dear Mr. Thayer: This letter is in response to your request for Minor Modification approval to add new ADA parking and signage, construct a new concrete ramp and stairs, repave the existing parking, and construct a new concrete sidewalk in front of the Northwest Landscape Industries building at 16045 SW Upper Boones Ferry Road. This property is zoned Industrial Park (I-P): The present use of the site is listed as a permitted use for this zoning district. The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.120.070(B) states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: 1. An increase in dwelling unit density, or lot coverage for residential development. This criteria is not applicable as this request does not involve a residential use. 2. A change in the ratio or number of different types of dwelling units. This criteria is not applicable as this request does not involve a residential use as previously indicated. 3. A change that requires additional on-site parking in accordance with Chapter 18.106. The proposal is to re-pave and re-stripe the existing parking only. Additional parking is not required and is not being proposed. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structure of the building is proposed. 5. An increase in the height of the building(s) by more than 20 percent. No change in the height of the building is proposed. 6. A change in the type and location of accessways and parking areas where off- site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. 7. An increase in vehicular traffic to, and from the site, and the increase can be expected to exceed 20 vehicles per day. An increase in the floor area proposed for a non-residential use by more than , 10 percent excluding expansions under 5,000 square feet. No increase in floor area is proposed. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this • code or reduces the open space area by more than 10 percent. The amount of open area (landscaping) will not be reduced as a result of this modification. 10. A reduction of project amenities (Recreational facilities, Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. There is no change in existing project amenities proposed. 11. A modification to the conditions imposed at the time of Site Development Review approval which are not the subject of B. 1 through 10 above. The proposal is to upgrade the existing site by adding handicap accessible parking and access, re-paving the existing parking lot, and minor remodeling of the exterior of the building. Thus, the proposal will not modify any conditions imposed at the time of Site Development Review approval. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state and federal laws. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION: 1. A building permit shall be obtained from the City of Tigard Building Division. Please refer to the attached drawings for more detailed information on the following modifications: a. New windows in existing exterior concrete panels b. New ADA parking and signage c. New exterior storefront d. New concrete ramp and stairs e. Repaving of existing parking f. New concrete sidewalk The above modifications are described as they relate to the eleven criteria used to establish a minor modification below: 1. Since the proposed modifications are for Commercial use, there is no increase in unit density or lot coverage as for residential use. 2. Since the proposed modifications are for Commercial use, a change in dwelling units does not apply. 3. The proposed modifications to the existing parking area involve the relocation of (6) parking stalls and turning (2) existing parking spots into a van accessible stall with the required striping adjacent. There are no parking stalls to be added. 4. There is no increase in the height of the building. 6. The proposed modifications to the existing parking area will have no affect on the off-site traffic. The new ramp located at the rear of the building will have no significant impact to off-site traffic. 7. There will be no increase in vehicular traffic to and from the site as a result of the proposed modifications. 8. There is no increase in floor area included in the proposed modifications. 9. The proposed modifications will cause no reduction in existing usable open space. 10. The proposed modifications will have little to no effect on the existing landscape. All areas designated as "Future Landscaping Area" to be landscaped by Owner (Northwest Landscape Industries) at a yet to be determined time in the future (by separate permit). 11. The new concrete ramp, accessible parking stall, new curb ramp, dual height drinking fountains (interior) and toilet rooms are considered ADA upgrade items. There are no other significant site modifications. In closing, the completion of these proposed modifications to the existing building located at 16045 Upper Boones Ferry Road will to the best of our knowledge result in the building and surrounding site conforming to all applicable codes and site requirements of the City of Tigard and the State of Oregon.
