Dear Mr. Cooper:
This letter is in response to your request for a 1,845 square foot addition to
be used as an office and rehabilitation space at 14145 SW 105th Avenue.
This property is zoned R-12 (Residential, 12 units per acre). The present use
of the site is listed as a permitted use for this zoning district. The Tigard
Community Development Code, Site Development Review Section, states;
"if the requested modification meets any of the major modification criteria,
that this request shall be reviewed as a new Site Development Review
application."
This request does not meet any of the eleven (11) approval criteria for
qualification as a major modification, as listed in Section 18.120.070(B). This
is specified as follows:
1.) Dwelling unit density will not be affected since this is a
commercial use;
2.) A change in dwelling unit type will not be affected since this is
a commercial use;
3.) This change will not increase the need for additional on-site
parking since no additional employees will be added.
4.) The request will not result in a change in the type of commercial
or industrial structures;
5.) There will not be an increase in any building height;
6.) The request will not result in a change in the type and location
of accessways and parking areas where off-site traffic would be
affected;

7.) The modification will not produce an increase in vehicular traffic
to, or from the site, of more than twenty (20) vehicles per day;
8.) The requested building is for approximately 1,845 square feet
and is therefore excluded because it is less than 5,000 square
feet;
9J The request will not cause a reduction of more than ten (10)
percent of the area reserved for common open space and\or
usable open space;
10.) This request will not cause the elimination of project amenities
by more than ten (10) percent;
11.) The request will not modify conditions of approval imposed at
the time of site development review approval.
Therefore, this request is determined to be a minor
modification to an existing site. The Director's designee
has determined that the proposed minor modification of
this existing site will promote the general welfare of the
City and will not be significantly detrimental nor injurious
to surrounding properties, provided that development
which occurs after this decision complies with applicable
local, state and federal laws.
This request has been approved subject to the following conditions:
1.) A building permit shall be obtained from the Building
Department.
