Dear Mr. Hoffman:
This letter is in response to your request for a Minor Modification (MMD2002-00005) of the
existing site development located at 11975 SW Pacific Highway, WCTM 1S135DD, Tax Lot
05000. You have requested to construct several small additions to the exiting buildings and
restripe the parking lot.
Analysis of Modification Request:
Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states;
"any modification which is not within the description of a major modification as provided in section
18.360.050 shall be considered a minor modification."
Section 18.360.050 states that the Director shall determine that a major modification(s) has
resulted if one (1) or more of the changes listed below have been proposed:
1. An increase in dwelling unit density or lot coverage for residential development.
The proposal does not involve residential property. Therefore, this standard does not
apply.
2. A change in the ratio or number of different types of dwelling units. This criterion is
not applicable, as this request does not involve a residential development.
3. A change that requires additional on-site parking in accordance with Chapter
18.765. The applicant has demonstrated that by converting the existing office use into
accessory offices for the auto repair use, even though an additional 680 square feet will
be added to the buildings, the overall parking requirement is unchanged. Therefore,
additional on-site parking is not required.
4. A change in the type of commercial or industrial structures as defined by the
Uniform Building Code. No change in the structural occupancy type of the building is
proposed. Therefore, this criterion is not applicable.

5. An increase in the height of the building(s) by more than 20 percent. The applicant
has proposed new additions and raising a portion of one of the buildings. There is
inadequate information to determine whether the 20% threshold will be met. This will
require subsequent verification upon building permit submittal.
6. A change in the type and location of accessways and parking areas where off-site
traffic would be affected. It is not clear by the site plan submitted whether the
accessway will be one way directional traffic. The 157.5 square foot addition on the
north side of the existing building in combination with the parking spaces along the north
property line effectively reduce the access on SW 87th avenue from 28 to 16 feet. The
minimum width for a two-way access is 24 feet. It is therefore inferred that the proposed
access is one way, but in which direction remains unknown. To not detrimentally affect
off-site traffic, the access to SW Pacific Hwy should be the entrance, and the access to
SW 87th should be the exit. Signs and marking will be necessary to ensure compliance
with this requirement.
Secondly, the minimum access width required by Tualatin Valley Fire and Rescue is 20
feet. The proposed site plan does not comply with this requirement and cannot be
approved as shown.
7. An increase in vehicular traffic to and from the site and the increase can be
expected to exceed 100 vehicles per day. This modification will not generate
significant additional vehicle trips. Therefore, this criterion does not apply.
8. An increase in the floor areas proposed for a non-residential use by more than ten
percent excluding expansions under 5,000 square feet. The proposal will increase
the square footage of the building by a total of 680 square feet, below the 5,000 square
foot limitation.
9. A reduction in the area reserved for common open space and/or usable open
space that reduces the open space area below the minimum required by the code
or reduces the open space areas by more than ten percent. There is no common
open space required for this type of development, therefore this standard does not apply.
10. A reduction of project amenities (recreational facilities, screening; and/or,
landscaping provisions) below the minimum established by the code or by more
than ten percent where specified in the site plan. There are no specific amenities
provided by the existing development. The amount of landscaping is non conforming in
that there is less than the required 15% provided, however, this request will not further
reduce the landscape area. The provision of parking along the north boundary will
require sight-obscuring screening between the subject property and the parcel to the
north. This can be accomplished with the use of a hedge, fence, or wall.
11. A modification to the conditions imposed at the time of Site Development Review
approval that is not the subject of criteria (B). 1 through 10 above. The site was
developed in Washington County prior to being a part of the City of Tigard. As such,
there are no preceding conditions of approval that affect this property.

THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO
THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR
BUILDING PERMIT APPLICATION.
Limitations on Minor Modification Approval
Prior to applying for building permits or making any exterior changes to the property:
1. Submit a revised site plan that shows:
a. The direction of vehicular access
b. The proposed striping, marking, and signage indicating the one way direction
c. The elimination of the addition on the north side of the larger building
d. Sight obscuring screening along the north property line between the building and SW
87' Avenue right of way line. Note that clear vision requirements will limit the height of
the fence to 3' in height for approximately 12' from the edge of the right of way.
2. Submit building elevations that adequately demonstrate the building height will not be
increased greater than 20% above the existing height.
3. The applicant shall acknowledge that once any changes to the site have been made, the
pending (and still incomplete) Site Development Review proposal will be rendered null and
void.
This request is determined to be a minor modification to an existing site. The Director's designee
has determined that the proposed minor modification of this existing site will continue to promote
the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding
properties provided that, development which occurs after this decision complies with all applicable
local, state, and federal laws.

entire building is within 150 feet of a fire access roadway, without the 20
