The property is located at 12805 SW 77th Place (WCTM 2S101 BD, Tax Lots 101 and 105). This property is zoned Light Industrial (L-I) in which a manufacturing use is permitted. The Tigard Community Development Code Chapter 18.360, Site Development Review, provides that a modification to an approved site plan or existing use may be a major or a minor modification. Major modifications are processed as a new Site Development Review application. Section 18.360.050.B states that the Director shall determine that a major modification will result if one (1) or more of the following changes are proposed: 1. An increase in dwelling unit density, or lot coverage for residential development. The proposal does not include residential development; therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not include residential development; therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Table 18.765.2 identifies required parking for industrial uses. Based on the applicant's information regarding the type of industrial activity, the use is classified as an Industrial Service use. A use of this type is required to provide 0.8 parking spaces per 1,000 square feet of gross floor area. The proposal is to add parking, not additional floor area for the industrial use. Therefore, this criterion is not triggered. It should be noted that Pacific Utility recently received Minor Modification approval to add approximately 5,000 square feet of assembly shop space. This request was processed under the previous version of the Community Development Code. The request did not trigger the "additional parking" criterion at that time because the parking requirement was calculated on the basis of the number of employees rather than square footage under that version of the code (see Minor Modification letter dated November 3, 1998). 13125 SW Hall Blvd., Tigard, OR 97223 (503) 639-4171 TDD (503)684-2772 Page 1 of 3 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposal is to add parking to the site and will not add to or alter any structure. Therefore, this criterion does not apply. 5. An increase in the height of the building by more than 20 percent. As noted above, the proposal will not add a building or alter any existing buildings in any way. Therefore, this criterion is not applicable. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The applicant's site plan indicates that no changes are proposed to the location and type of existing parking areas or accessways that would affect off-site traffic. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The applicant's statement indicates that the proposed 22 additional parking spaces are for employees. Based on this information, Staff does not expect vehicle trips to and from the site to increase more than 22 vehicles per day. Therefore, this criterion is not triggered. 8. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The proposal is for additional parking area only. No additional building floor area is proposed. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space by more than 10 percent. There is no common open space provided on the site and none is required in the underlying I-L zoning district. Therefore, this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening, and/or landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. Landscaping is the only existing on-site amenity. The I-L zoning district requires 15% of a site to be landscaped. According to the applicant's site plan, although some landscaping will be removed, this proposal will retain approximately 26,045 square feet (17%) of the site in landscaping. This is in excess of the minimum landscaping standard and, therefore, this criterion is not triggered. 2/2/99 Carter Case Ltr. Page 2 of 3 RE: Pacific Utility Corp. Minor Mod. Approval to Add 22 Parking Spaces 11. A modification to the conditions imposed at the time of Site Development Review approval that are not the subject of criteria (B) 1 through 10 above. Staff has found no record of any conditions imposed at the time of Site Development Review approval that would require modification as a result of this proposal. This request is determined to be a minor modification to approved site plans. Pursuant to Section 18.360.060.C, the Director's designee has determined, based on the above findings, that the proposed modification is not a major modification and does not violate any code provisions. The proposed minor modification is, therefore, approved. Please provide a copy of this letter when applying for permits. There is a fee for the required permits. The applicant's site plan indicates that the site currently provides 52 parking spaces, 24 spaces short of the total requirement for the site. The proposed new building will add approximately 5,000 square feet of assembly shop space. As noted above, parking for industrial assembly uses is based on the number of employees working in that space (1 space per employee). According to Pacific Utility, the p urpose of the new building is to alleviate a current space shortage and the number of shop employees will not increase as a direct result of the new building. Staff finds that although the site has a non-conforming parking situation, the proposed modification will not require additional on-site parking or increase the degree of non-conformity. According to the applicant's site plan, the proposed new structure has a building area of 5,074 square feet and the existing structure has a building area of 51,785 square feet. The proposed increase is therefore less than the 10% threshold and this criterion is not triggered. 9. There is no common open space provided on the site and none is required in the underlying I-L zoning district. Therefore, this criterion does not apply. 10.
