Dear LaVelle Day:
This letter is in response to your request for Minor Modification (MMD2002-00007) approval to
relocate the outdoor barbecue of the Church of Jesus Christ of Latter Day Saints.
The subject property is located at 15555 SW 98th Ave. The site is the location of the Church of
Jesus Christ of Latter Day Saints. The Tigard Community Development Code, Conditional Use
Section, states; "if the requested modification meets any of the major modification criteria, that the
request shall be reviewed as a new Conditional Use application."
Section 18.330.020.B. states that the Director shall determine that a major modification(s) has
resulted if one (1) or more of the changes listed below have been proposed:
1. A change in land use. The applicant is proposing to relocate an outdoor barbecue.
Therefore, this standard does not apply.
2. An 10% increase in dwelling unit density. This criterion is not applicable, as this
request does not involve a residential development.
3. A change in the type and/or location of access ways and parking areas where off-
site traffic would be affected. The relocation of an outdoor barbecue will not effect
off-site traffic. Therefore, this standard does not apply.
4. An increase in the floor area proposed for non-residential use by more than 10%
where previously specified. No increase in floor area is proposed with this
modification. Therefore, this standard does not apply.
5. A reduction of more than 10% of the area reserved for common open space and/or
usable open space. No reduction to open space is proposed with the relocation of the
outdoor barbecue. Therefore, this standard does not apply.
6. A reduction of specified setback requirements by more than 20%. Currently, the
existing concrete pad of the outdoor barbecue is approximately 1-foot from the north
property line. The proposed modification will increase the setback of the barbecue pad
to 5 feet from the property line. Therefore, this standard does not apply.
7. An elimination of project amenities by more than 10% where previously specified
provided such as: (Recreational facilities; Screening; or Landscaping provisions).
The proposed modification will result in the removal of an existing flagpole, the
transplanting of an existing rhododendron and the removal of an existing tree. Based on
the criterion above, this modification will not reduce project amenities below 10% of the
entire site. Therefore, this standard does not apply.

8. A 10% increase in the approved density. The proposed modification has not altered
the original use of the site. Therefore, this standard has been met.
This request is determined to be a minor modification to an existing site. The Director's designee
has determined that the proposed minor modification of this existing site will continue to promote
the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding
properties, provided that development which occurs after this decision complies with all applicable
local, state, and federal laws.
Therefore, this request for Minor Modification approval is hereby granted.

Project Statement
This is a project to replace an existing BBQ of the same size, relocate it and put a cover over it.
It will be necessary to remove a tree(see pictures), relocate a flag pole and transplant a plant in
addition to building the BBQ and cover.
