Hudson Tigard Tualatin School District No. 23J 13137 SW Pacific Highway Tigard, OR 97223 Dear Mr. Hudson: This letter is in response to your request for Minor Modification approval (MMD1999-00016) to expand the Metzger Elementary School Facility located at 10255 SW 90th Avenue. You have requested approval to place one (1) additional modular classroom building on the site. This property is designated for Low-Density Residential use and is located within the R-4.5 zoning district. The R-4.5 zone lists "Schools" as a Conditional Use. The Tigard Community Development Code Chapter 18.330, Conditional Use, provides that a modification to an approved conditional use may be a major or a minor modification. Major modifications are processed as a new conditional use application. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density. No additional dwelling units are proposed. Therefore, this criterion does not trigger Major Modification review. 2, A change in ratio or number of different types of dwelling units. According to the applicant and as indicated on the site plan, the proposed modification will not involve dwelling units. Therefore, this criterion does not trigger Major Modification review. 3. A change that requires additional on-site parking in accordance with Chapter 18.795. The proposed modification is to accommodate existing educational programs. The applicant is not proposing any new on-site parking. Based on this analysis, this criterion does not trigger Major Modification review. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the building is proposed. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20%. No increase in the height of the existing buildings is proposed. A change in the type and location of accessways and parking areas where off-site traffic would be affected; The proposal does not include revisions to existing driveway locations or parking areas. Therefore, off-site traffic would not be affected. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; This proposal is to add space to serve existing students, that will not increase vehicular traffic. Therefore, this criterion does not trigger Major Modification review. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The applicant is proposing a 1,680 square foot expansion. The existing buildings equal 52,874 square feet. Therefore, the proposed building is under the ten-percent (10%) by 3,607 square feet. This request is determined to be a minor modification to an approved conditional use. Pursuant to Section 18.330.020.3.C., the Director's designee has determined, based on the above findings, that the proposed modification is not a major modification and that it is in compliance with the applicable requirements of the Tigard Community Development Code.
