Coleman OREGON 10580 SW McDonald St. #101 Tigard, OR 97224 Dear Mr. Coleman: This letter is in response to your request for Minor Modification approval (MMD1999-00016() to include the selling and leasing of automobiles out of the Farmers Insurance office space located at 10580 SW McDonald Street, Suite 101; WCTM2S110AA,00500. This property is designated for General Commercial and is located within the C-G zoning district. The use of the site is listed as a permitted use for this zoning district. The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No additional parking is needed. There currently are 32 spaces which is sufficient for this building. Therefore, this criterion does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the building is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. No increase in the height of the existing building is proposed. Therefore, this standard does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. Therefore, this criterion does not apply. 10/07/1999 Brock R. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Five additional customers per month are anticipated to come to the site. This will generate ten additional vehicle trips per month. The additional trips are well within the maximum 100-vehicle trip limit allowed. Therefore, this criterion is satisfied. • 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. There is no expansion proposed to the floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There is no area reserved for common open space; therefore, this standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. No changes of project amenities are planned. Therefore, this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The applicant has provided findings that demonstrate the modification will not preclude conformance to the original Site Development Review's Conditions of approval. Therefore, this criterion is satisfied. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. Property: Existing office building with approximately 8000 square feet of office space at the above address. Request: I would like a location approval from the City of Tigard for the operation of an auto dealer's office location at the above address. This approval may include a restriction that no inventory be stored at this location. Business Operations: For the past 10 years I have leased approximately 1400 square feet at the above location for a business office for my insurance agency. I plan on offering an additional service to my existing customers which will help them negotiate the purchase and or lease of a new or used automobile. I may at times be considered to be operating as a used car dealer,broker or wholesaler and therefore need to be licensed as such. I will have no inventory at the subject property. Changes: No changes to the existing property will be made. There will be no impact on traffic,parking or building usage. Regarding the design criteria in section 18.360.050(B) below is a response to each of the eleven listed criteria. 1.) The proposal does not involve residential property so item number one does not apply. 2.) The proposal does not involve residential property so item number two does not apply. 3.) No additional parking is needed and none is planned. There are 32 spaces currently which is sufficient for this building, so item number three does not apply. I 4.) My business plan indicates we may be able to help five customers per month with their auto purchase or trade. This may generate five additional vehicles entering and leaving our parking lot per month. Well less that the 100 vehicles per day allowed by the criteria therefore I am in compliance with item number seven. 8.) No increase in floor area is proposed so item number eight does not apply. 9.) No changes in open space are planned so item number nine does not apply. 10.) No changes of project amenities are planned so item number ten does not apply. 11.) No modifications of criteria one through ten are requested so item number eleven does not apply. Summary: I believe that the location approval requested will have no impact on the subject property. My activity as an auto dealer will be very limited, and there will be no signage or other outward appearance of an auto dealer's location here. Please grant the location approval as requested.
