Lake Oswego, OR 97034 RE: Minor Modification to existing Conditional Use (MMD 1999-00012) Dear Mr. Durham: This letter is in response to your request for Minor Modification approval to modify the existing conditional use to allow a 1,500 square foot storage shed. This property is zoned R-4.5 which allows cemeteries as a conditional use. The Tigard Community Development Code Conditional Use Section states that if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Site Development Review application. Section 18.330.020.B states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: A change in land use; The proposal is to construct a storage shed for maintenance equipment, therefore, there is no change of use and this standard is met. An 10% increase in dwelling unit density; The proposal does not involve a residential use, therefore, this standard does not apply. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The proposal will not result in re-location of access ways or parking areas, therefore, this standard is not applicable. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The use is a cemetery, therefore, the amount structures compared to the open space is very small. The site is approximately 20 acres and the combined square footage of all structures will be about 1`)/0 of the site. The additional square footage of the storage building is .2% of the total site, therefore, this standard is satisfied. Page 1 of 2 A reduction of more than 10% of the area reserved for common open space and/or usable open space; As stated above, even with the additional square footage for the storage shed, the area covered with structures is approximately 1°/0 of the entire site, therefore, this addition will not reduce the amount of open space significantly. A reduction of specified setback requirements by more than 20%; The structure will be 103 feet from the west boundary, 44 feet from the south boundary and greater than 800 feet from the north and east. The structure will not be closer to the property lines than other existing structures. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions; and The proposal will not result in a reduction of project amenities other than a light reduction in landscape area. Because the site encompasses approximately 20 acres, the reduction in landscaping is well under 10%. A 10% increase in the approved density; The proposal does not result in an increase in density, therefore, this standard does not apply. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification will promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that development which occurs after this decision complies with all applicable local, state, and federal laws. All necessary building permits must still be obtained. This letter is considered part of the approved plan. Any further modifications to the approved plan must be reviewed and approved as well. With the proposed storage structure, this accounts for about 1% of the site 6. Reduction of specified setback requirements: Existing approved setbacks include the western most mausoleum which has an approved setback of 10.5 ft.
