OREGON Tigard, OR 97223 To Whom It May Concern: This letter is in response to your request for Minor Modification (MMD2000-00011) approval to build a 640 square foot structure at Durham Elementary School at 8048 SW Shaffer Lane. The facility will be utilized for educational purposes. This property is designated for Public Institutions within the R-12 zoning district. The use of the site is listed as a conditional use for this zoning district. The Tigard Community Development Code, Conditional Use Section, states; "Any modification which is not within the description of a major modification as provided below shall be considered a minor modification." Section 18.330.020.B. states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; This modification is for an accessory structure to be used in the education of elementary students. Therefore, the addition of the structure meets the intent of the Conditional Use approval for a school in a residential zone. 2. A 10% increase in dwelling unit density; The structure does not fall under Tigard's definition of a dwelling unit. Therefore, this standard does not apply. 3. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected; This request will not require a change in accessways or parking areas where off-site traffic would be affected. The proposed building is located in the field adjacent to the school and it's parking lot. Therefore, this standard does not apply. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The modification will increase the floor area from 63,175 square feet to 63,815 square feet. The net increase is a total of 640 square feet or .01%. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; There is no area reserved for common open space. Therefore, this standard does not apply. 6. A reduction of specified setback requirements by more than 20%; A primary stream is associated with this piece of property and has a 50-foot buffer. An elimination of project amenities by more than 10% where previously specified provided, such as: Recreational Facilities; Screening; or Landscaping provisions; and The proposed structure is south of the existing soccer field. Therefore, no recreational facilities or any other project amenities will be effected. 8. A 10% increase in the approved density. This proposal is to build a 640 square foot structure for educational purposes and does not include a residential development. Therefore, this standard does not apply. This request is determined to be a Minor Modification to an existing Conditional Use (CUP88-05). The Director's designee has determined that the proposed Minor Modification of this Conditional Use is in compliance with all applicable requirements of this title, and the modification is not a major modification as defined in Subsection 18.330.020.A. of the Tigard Development Code. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification will not result in an increase in daily traffic. 8. An increase in the floor area proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The modification will increase the floor area from 63,175 square feet to 63,815 square feet. The net increase is a total of 640 square feet or .01%; therefore, this standard has been satisfied. 9.
