Dear Mr. Browning:
This letter is in response to your request for Minor Modification (MMD2002-00032) approval to remodel and
change of use from a video rental store to a bar (Dr. Feelgoods) and a fast food restaurant (Subway). The
site is located at 13707 SW Pacific Highway, and is described as WCTM 2s103DD-00400.
The Tigard Community Development Code, Site Development Review Section, states; "if the requested
modification meets any of the major modification criteria, that the request shall be reviewed as a new Site
Development Review application."
Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if
one (1) or more of the changes listed below have been proposed:
1. An increase in dwelling unit density or lot coverage for residential development. The
proposal does not involve residential property. Therefore, this standard does not apply.
2. A change in the ratio or number of different types of dwelling units. This criterion is not
applicable, as this request does not involve a residential development.
3. A change that requires additional on-site parking in accordance with Chapter 18.765. The
site currently has 94 spaces available for parking (81 standard spaces, 11 compact spaces, and 2
ADA accessible spaces. According to the information provided, the applicant has ample parking
to accommodate the proposed Dr. Feel Good's pub and eatery. In order to accommodate the
Subway restaurant the applicant would need to demonstrate that 97 parking spaces are available.
The applicant's architect has indicated that the parking lot would be re-striped to provide for more
compact spaces.
4. A change in the type of commercial or industrial structures as defined by the Uniform
Building Code. No change in the structural occupancy type of the building is proposed.
Therefore, this criterion is not applicable.
5. An increase in the height of the building(s) by more than 20 percent. The building height will
not be increased as a result of this proposal.
6. A change in the type and location of accessways and parking areas where off-site traffic
would be affected. This request will not require a change in accessways or parking areas where
off-site traffic would be affected. Therefore, this criterion does not apply.
7. An increase in vehicular traffic to and from the site and the increase can be expected to
exceed 100 vehicles per day. This modification is not expected to generate anymore vehicular
trips than what was already occurring when the video rental store was in operation. Therefore,
this criterion is satisfied.

8. An increase in the floor areas proposed for a non-residential use by more than ten percent
excluding expansions under 5,000 square feet. There is no increase in floor areas proposed
for this development. This standard is not applicable.
9. A reduction in the area reserved for common open space and/or usable open space that
reduces the open space area below the minimum required by the code or reduces the
open space areas by more than ten percent. The modification will not affect landscaping or
open space.
10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping
provisions) below the minimum established by the code or by more than ten percent
where specified in the site plan. The addition will not reduce project amenities.
11. A modification to the conditions imposed at the time of Site Development Review approval
that is not the subject of criteria (B). 1 through 10 above. The modification will not impact
any of the conditions of approval of SDR89-20.
THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION AND THE
AFOREMENTIONED FINDINGS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR
PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT.
CONDITION OF APPROVAL
1. Prior to issuing occupancy for the proposed subway, the applicant shall provide the Planning
Department with a revised parking plan demonstrating a minimum of 97 parking spaces available to
the development.
This request is determined to be a minor modification to an existing site. The Director's designee has
determined that the proposed minor modification of this existing site will continue to promote the general
welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided
that, development which occurs after this decision complies with all applicable local, state, and federal
laws.

Site Plan (see Exhibit A):
The attached site plan shows 81 standard parking stalls, 11 compact parking stalls and 2
handicapped parking stalls. In addition, the service bays of the existing Motor Vehicle
users have the capacity for up to 32 additional automobiles (8 bays @ 4 each). The tenant
employees are encouraged to use off site parking whenever possible.
Current Situation:
A Lease has been executed with Don and Rachel Harvey, dba Dr. Feelgood's Pub for
approximately 3,850 square feet. This use is Beverage and Food Service oriented_ Valid
building permits have been issued, EDU charges have been paid and leasehold
improvement work has commenced. An actual decrease in vehicular traffic is anticipated
since the former Tenant, Hollywood Video, conducted a high volume, video and DVD
rental and sales operation. Furthermore, most of Dr. Feelgood's business is anticipated
after 5pm when the other users of Tigard Retail Center have concluded their business.

Furthermore, an agreement has been reached with Subway Real Estate Corp., for
approximately 2,600 square feet for the balance of the former Hollywood Video space.
This user is fast food oriented with about 70% of the business volume occurring during
the lunch hour. As shown in Exhibit B, this change of use has previously been initialed as
"OK" by a City of Tigard representative, Morgan Tracy.
Most current tenants are involved in motor vehicle servicing, repairs or rentals. The
primary operating hours for these tenants is Sam to 5pm,Monday-Friday. The vacant
spaces that are the subject of this application have not generated income for ownership
since August 2001 and neither of these spaces have been designed to accommodate
automobile oriented uses since they lack service bays and adequate access. It has been
determined that food service is the highest and best use for these two vacancies.
Approval of these uses is hereby requested. If additional information is required, please

Dear Brad:
In response to the Condition of Approval, dated November 26, 2002, we are
hereby submitting a revised Parking Plan identifying the proposed location
of three additional stalls at Tigard Retail Center, 13707-13727 SW Pacific
Highway. Upon installation, the parking capacity as shown on the Site Plan
increases from 94 to 97 stalls as required under your Condition of Approval.

The attached site plan shows 81 standard parking stalls, 11 compact parking stalls and 2
handicapped parking stalls. In addition, the service bays of the existing Motor Vehicle
users have the capacity for up to 32 additional automobiles(8 bays @ 4 each). The tenant C L.(,
employees are encouraged to use off site parking whenever possible. ��
Current Situation:
A Lease has been executed with Don and Rachel Harvey, dba Dr. Feelgood's Pub for
approximately 3,850 square feet. This use is Beverage and Food Service oriented. Valid
building permits have been issued, EDU charges have been paid and leasehold
improvement work has commenced. An actual decrease in vehicular traffic is anticipated
since the former Tenant, Hollywood Video, conducted a high volume, video and DVD
rental and sales operation. Furthermore, most of Dr. Feelgood's business is anticipated
after 5pm when the other users of Tigard Retail Center have concluded their business,
