The site is located at 16300 SW 92nd Avenue, and is described as WCTM 2S114AA-0100. The Tigard Community Development Code, Conditional Use Section, requires a new Conditional Use application if the requested modification meets any of the major modification criteria. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The applicant is not proposing a change in land use. 2. A 10% increase in dwelling unit density; There are no dwelling units associated with this project. This criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The proposal is to replace an existing modular classroom with a newer and larger modular classroom on the back side of the school. The proposed location would not affect access ways or parking areas. This criterion is satisfied. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; According to Conditional Use Permit 91-00007, the floor area of the school including portable classrooms is 292,000 square feet with completion of the second phase. The existing modular is 1,680 square feet in size; the replacement portable is 2,296 square feet in size. This constitutes a net gain of 616 square feet and less than a 1% increase in floor area for this site. This criterion is satisfied. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; The site is over 43 acres in size, and according to the available site history, there is approximately 1,582,910 square feet in open space or common open space. A replacement modular that is 616 square feet larger than the existing 1,680 square foot modular will not reduce this area by more than 10%. A reduction of specified setback requirements by more than 20%; The location of the proposed addition is interior to the project site and will not reduce any of the specified setbacks for schools in residential areas. This criterion is satisfied. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions; and This proposal will eliminate one tree to accommodate construction. This tree will be required to be included as part of the tree survey for any application filed within the next year. However, one tree will not reduce the project amenities by more than 10 percent. 8. A 10% increase in the approved density; Density is not a consideration of this project, as there are no dwelling units associated with the use. This criterion is not applicable. THIS REQUEST HAS BEEN APPROVED AS PROPOSED. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. Tigard H.S. Preschool Portable Applicants Statement Feb. 23, 2004 The new Pre-school portable will be set in a location currently in use by a standard classroom portable. The old classroom portable will be either moved or demolished. The new portable is approximately 500 square feet larger than the portable it is replacing. The structure will be set behind the High School's main building and will not be visible from the road. Parking and building height will not be changed or affected by this addition. A single tree of more than 12"will have to be removed to make way for the new structure. The portable will not affect Clear Vision areas nor will it be near a driveway or intersection. Tigard H.S.
