MMD2004 00010 T- MOBILE WIRELESS CITY OF TIGARD May 18, 2004 OREGON Sprint PCS c/o Kevin Martin 2495 NW 121st Place Portland, OR 97229 RE: Minor Modification Request of SDR2003-00018, Case File No. MMD2004-00010 Dear Mr. Martin: This letter is in response to your request for a Minor Modification (MMD2004-00010) of the approved site development permit located at 13680 SW Pacific Highway, WCTM 2S12CC, Tax Lot 01100. You have requested to add additional antenna array and associated equipment cabinets to the existing monopole for T-Mobile. The submitted site and elevation plans reflect the current conditions and proposed additions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The parking requirement for Wireless Communications Facilities is 0. Moreover, it is likely given the operational characteristics that the technicians that service the antennae will not be at the site at the same time. Therefore, there is no additional parking required for the proposed additional user. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to the existing tower height. The additional antennae will be placed below the approved antennae heights. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This application will not affect driveways, accessways or parking aisles. Since off site traffic will not be affected, this standard is satisfied. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Based on the expected 1 service visit per month, this equates to an addition of .07 trips per day, far below the 100 trip threshold. Therefore, this criterion is met. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal will not increase floor area. Therefore, this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal will slightly reduce the existing open space areas, from 25% presently to 24% of the site area, in compliance with code requirements (which requires a minimum of 15% landscaping). 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed modifications to the site will not reduce or eliminate project amenities. Recreational facilities, screening, and landscaping will not be detrimentally affected. Additional screening was required at the site's perimeter by the previous SDR approval. The Minor Modification has proposed landscaping materials around the equipment compound. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The previous Site Development Review approval has not been constructed. All conditions that pertain to that approval are still relevant and in effect. This proposal does not appear to conflict with any of those requirements. However, should a conflict arise that cannot be satisfactorily resolved in compliance with those prior conditions of approval, this minor modification request will be invalidated. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. 1. PROJECT DESCRIPTION Sprint PCS) is expanding and upgrading its Pacific Northwest wireless services network in the Tigard area. The proposed wireless communication facility is necessary to improve signal coverage along SW Pacific Highway between downtown Tigard and King City, and to improve "in-building" coverage in surrounding areas. Sprint PCS proposes to co-locate its antennas on the recently approved T-Mobile monopole at the Tigard Lodge. The associated accessory equipment will be located in a 15' x 30' expansion of the previously approved equipment area(Exhibit A). III. APPLICABLE STANDARDS 18.798 WIRELESS COMMUNICATION FACILITIES 18.798.040 Uses Permitted Outright A. Collocation of antenna(s) on existing towers in commercial and industrial zones. Installing an antenna(s) on an existing communication tower of any height is permitted outright, so long as the additional antenna(s) are no more than 20 feet higher than the existing tower, no more than three providers are collocating on the towers, and the color of the antenna(s) blends with the existing structure or surroundings; Sprint PCS is proposing to co-locate antennas on the recently approved T-Mobile monopole at the Tigard Lodge (Case No. SDR2003-00018). The height of the tower will not be increased. The property is zoned C-G General Commercial. Therefore, the co-location is a permitted use. Staff determined that the co-location should be reviewed as a Type I Minor Modification. 18.360 SITE DEVELOPMENT REVIEW 18.360.050 Major Modification(s) to Approved Plans or Existing Development A. Determination request An applicant may request approval of a modification to an approved plan or existing development by: 1. Providing the Director with three copies of the proposed modified site development plan;and 2. A narrative which indicates the rationale for the proposed modification addressing the changes listed in subsection B below. The applicant has submitted three copies of the development plan. This does not change the type of structure. No changes will be made to the existing Lodge building. Therefore, no change is proposed. 5. An increase in the height of the building(s) by more than 20%; No changes will be made to the existing Lodge building. The new antennas will not increase the height of the approved monopole. A change in the type and location of accessways and parking areas where off-site traffic would be affected; Sprint PCS will use the existing access onto SW Pacific Highway.
