Broadway, Suite 110 Vancouver, WA 98660 Dear Ms. Holmes: This letter is in response to your request for Minor Modification (MMD2005-00006) approval to modify the existing drive thru at the north end of the existing Nimbus Center located at 10115 SW Nimbus Avenue, WCTM 1S134AA, Tax Lot 01900 in the City of Tigard, Oregon. The proposed modifications include an additional lane to the drive thru and changing the layout of the on-site circulation. The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. Y 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No increase in square footage is proposed, therefore, no additional on-site parking is required. However, the applicant has shown the proposed modification to decrease the existing amount of parking by three stalls. The applicant is required to provide a plan showing no loss of parking stalls. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the building is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The building height will not be increased as a result of this proposal. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification will not generate more than 100 additional vehicle trips per day according to the 5 edition of the ITE Handbook. Therefore, this criterion does not apply. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. No increase in floor area is proposed. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The modification will not affect the sites landscaping. Therefore, this standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The change of use will not reduce project amenities. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. Staff conducted a search of City records and found Site Development Review 5-86. The requested adjustment is to the pre-existing drive-thru, which will not modify the conditions of the original Site Development Review. Therefore, this standard is satisfied. THIS REQUEST HAS BEEN APPROVED BASED ON THE CONDITION BELOW. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. CONDITION: 1. Nimbus Center Associates are seeking approval for modifications that will improve the functionality of the existing drive thru at Nimbus Center. When the Center was constructed, it included a drive thru bank. The existing drive thru has a queuing length of approximately 48 lineal feet. The Center currently has 94 parking stalls. At present the space is not leased. One of the goals of modifying the drive thru is to make it more functional for the current needs of financial institutions. The proposed changes include adding a lane to the drive thru and changing the layout of this corner of the parking lot. At present there is no signage or striping indicating directional flow for this corner, which has led to some internal parking conflicts. The changes also include revisions to the parking area in the corner of the site, adding more angled parking at this location, and better delineating travel direction. The changes do reduce the number of parking spaces by 3, but greatly improve the mobility associated with the access off of Nimbus Avenue and the internal circulation of the parking lot. The proposed primary drive thru lane would have a stacking length of 104 lineal feet and the other lane would have a stacking length of 50 lineal feet. As noted above, angled parking would be striped in the central portion of the parking area, facilitating ease of parking and movement through the site. Any impact of the changes to off site traffic would be positive. The additional parking lot striping and directional delineation will work to improve the overall function of the Center's parking lot. Tigard Development Code requires that, in order to be eligible for a Type I process, the proposal not trigger any of the Major Modification outlined in Section 18.360.050(B). Following is a list of the criteria and a brief explanation of how the proposal relates to the criteria: 1. An increase in dwelling unit density or lot coverage for residential development. Not applicable to this commercial project. 2. A change in the ratio or number of different types of dwelling units. Not applicable to this commercial project. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No square footage is being added to the retail center, no change in the on-site parking requirements is triggered. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposal is to modify an existing drive-thru facility to increase it's functionality, no change in the type of structure is proposed. 5. An increase in the height of the building(s)by more than 20%. No change to building height is proposed. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. Site access will not be modified with approval of the proposal. The parking areas are proposed for modification, but it is unlikely the changes would have any negative impact to off-site traffic. 7. An increase in vehicular traffic to and from the site and increase can be expected to exceed 100 vehicles per day. The proposal would not result in increased vehicular traffic to the site, beyond what was contemplated in the original approval of the retail center. 8. An increase in the floor area proposed for a non-residential use by more than 10% excluding expansions under 5,000 square feet. No increase to floor area is proposed. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this code or reduces the open space area by more than ten percent. Not applicable to this proposal. 10. A reduction of project amenities (recreational facilities, screening, and/or landscaping provisions) below the minimum established by this code or by more than 10% where specified in the site plan. Landscaping will not be modified with approval of this proposal. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not subject of Criteria 1 through 10 above. Not to the Applicant's knowledge.
