You have requested to modify the use of the site from office/warehouse to religious institution. The modification involves renovating the interior of the existing structure. No exterior changes are proposed. The proposed use (religious institution) is permitted in the MUE-2 zone. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The parking requirement for religious institutions is 1.0 per 3 assembly seats. The assembly area will have 750 seats, requiring 188 parking stalls. The site itself includes 139 parking stalls; however, the site is part of a largeer office park (Scholls Business Center) that provides a total of 1,267 parking stalls, which are not assigned to specific tenants or buildings. Section 18.765.030.0 states that owners of two or more uses, structures or parcels of land may agree to utilize jointly the same parking and loading spaces when the peak hours of operation do not overlay, subject to the conditions of 18.765.030.C1 through 3. Users of Building T (at 10500 SW Nimbus Avenue) may use any parking area in the Scholls Business Center. Building R, located directly north of Building T, provides over 100 parking stalls. In addition, church operating hours are 7 pm to 10 pm, Wednesday and Friday, and Saturday morning. In contrast, the majority of the office park tenants operate during regular weekday business hours. Therefore, the proposed modification does not require additional on-site parking. 4. A change in the type of commercial or industrial structure(s) as defined by the Uniform Building Code. The existing building is classified as a Type III-B construction and will remain Type III-B after the proposed interior renovations. Therefore,there is no change in the type of commercial or industrial structure as defined by the Uniform Building Code. 5. An increase in the height of the building(s) by more than 20 percent. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The former use (office/warehouse) generated an average of 406 vehicle trips per day to and from the site. The proposed use (religious institution) generates an average of 390 vehicle trips per day. Therefore, no increase in vehicular traffic to and from the site is expected. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The applicant does not propose to increase floor area. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to common or usable open space. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include a reduction of any project amenities. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. Hall Blvd. TIGARD, OR 97223 RE: SCHOLLS BUSINESS CENTER SOLID ROCK—BUILDING T MINOR MODIFICATION Dear Ms. Eng, Pursuant to our conversation today, attached is the narrative to 18.360.060(B)(2) required as part of a Minor Modification. 1. An increase in dwelling unit density, or lot coverage for residential development. RESPONSE: Not applicable because this is a commercial building. 2. A change in the ratio or number of different types of dwelling units. RESPONSE: This is part of a commercial project and building will not be modified. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. RESPONSE: Parking requirements per Table 18.765.2 for Religious Institutions requirement of 1.0/3 seats in the main assembly. The assembly area will have 750 seats—requiring 188 parking stalls. Currently at the Scholls Business Center, we have a total of 1,267 parking stalls which are not assigned to specific tenants or buildings and are considered available(please see site plan that shows all of Scholls Business Center). Also per section 18.765.030-C.—Joint Parking—the Religious Institutions will use off peak hours, their hours of operation do not overlay with the remainder of uses within the Business Park. Solid Rock Fellowship hours of operation are Wednesday and Friday night from 7 pm to 10 pm, and Sunday morning service. Therefore on top of the 139 parking stalls around Building `T' and utilization of the remainder of the Business Park parking provided to all tenants, the parking requirement is met. (Please note that we included a site development plan that shows the existing parking stalls located around Building T and Building R at the Scholls Business Center for your review, but all of the parking within the Scholls Business Center is available for use by all of our tenants on a first-come, first-serve basis.) 4. A change in the type of commercial or industrial structures as defined by Uniform Business Code. An increase in height of the building by more than 20%. RESPONSE: The building height is not being modified. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. RESPONSE: None of the accessways and/or parking areas are being modified from what exists today. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. RESPONSE: Please see attached email from Carissa Collins with the City of Tigard whereby trips will be reduced from 406 trips to 390 trips. 8. An increase in floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet. RESPONSE: Floor area is not being modified. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space below the minimum required by this code or reduces the open space area by more than 10%. RESPONSE: The open space and/or common area is not being modified. 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan. RESPONSE: The amenities throughout the Scholls Business Center will not be modified. 11. A modification to the conditions imposed at the time of site development review approval which are not subject of B1 through 10 above of this subsection.
