ANTHONY PARISH , , A,,,,, April 8, 2005 CITY OF TIGARD OREGON St. Anthony Parish c/o Robert Klas, Architect 13282 SW Scotts Bridge Drive Tigard, OR 97223 RE: Minor Modification Request of CUP2004-00002, Case File No. MMD2005-00004 Dear Mr. Klas: This letter is in response to your request for a Minor Modification (MMD2005-00004) of the approved conditional use permit located at 12630 SW Grant Avenue, WCTM 2S102BD, Tax Lot 00800. You have requested to modify a portion of the parking landscape required under the CUP permit by keeping two existing parking spaces instead of landscaping them and providing additional landscaping in front of the approved storage building. The submitted site plan reflects the current conditions and proposed additions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. This request does not involve a residential development. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed modification is the addition of two parking spaces. Therefore, this criterion does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the structure is proposed. The applicant has not proposed any changes to the buildings on the subject parcel. Therefore, this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This application will not affect driveways, accessways or parking aisles. The addition of two parking spaces from those allowed under the CUP permit (retention of two existing spaces) would not affect off-site traffic. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed additional parking would better accommodate existing demand based on existing uses already approved for the site. Any increase in vehicle trips per day for the use of the two spaces would not be expected to exceed 100 vehicles per day. Therefore, this criterion does not apply. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal will not increase floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal will not reduce the existing open space areas or usable open space, but does reduce the landscaped area for the subject parking lot approved under the CUP permit. Therefore, this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed modifications to the site are to reduce landscaping for the subject parking lot by 216 square feet and to add 160 square feet of additional landscaped area in front of the approved storage area. The net reduction is 56 square feet. The landscape standard is a minimum of 15 percent. The site, including all three Lots under common ownership and constituting the St. Anthony campus parish, consists of 290,778 square feet. The proposed reduction would be .00019 percent. This would leave approximately 47 percent of the site in landscape area. Therefore, this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria B1 through 10 above. All conditions that pertain to CUP2004-00002 and not subject to the above criteria are still relevant and in effect. This proposal does not appear to conflict with any of those requirements. However, should a conflict arise that cannot be satisfactorily resolved in compliance with those prior conditions of approval, this minor modification request will be invalidated. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. 1. Should a conflict between site plan proposals arise that cannot be satisfactorily resolved in compliance with the conditions of approval for CUP2004-00002, this minor modification request will be invalidated. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. These Lots are all under the same ownership, and all 3 Lots will always function as a single parish unit. This proposal is to delete parts of the proposed landscape areas on each side of the driveway on to Mackenzie Street. The existing landscaping on each side of this driveway will remain. We propose to add approximately 160 sq. ft. of new landscaping in front of the new building. The following addresses criteria in Section 18.360.050 (B): 1. N/A - This is not a residential Site. 2. N/A - This is not a residential Site. 3. This change will not require additional parking. 4. There will be no change to existing structures. 5. There will be no change to the building height. 6. I think we have a way around the % of landscape issue. Bob Klaus will be sending a letter requesting the minor mod to be considered relative to the entire St. Anthony's campus. I asked him to include the % of landscaping for the whole site including the St. V's parking lot.
