You have requested to add additional antenna array and associated equipment cabinets to the existing monopole. The submitted site and elevation plans reflect the current conditions and proposed additions. As proposed, additional equipment is to be located inside the existing equipment shelter building. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed wireless communication facility is not required to provide any parking, pursuant to the parking demand table in TDC 18.765. Therefore, no additional on-site parking is needed. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the structure is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has proposed to establish the new antennae at 44 feet and 84 feet (measured to the antennae tip) above ground level on the existing 80 foot pole. No increase to the pole height is proposed. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. No changes to the site layout or accesses are proposed, therefore this criterion is satisfied. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The existing and proposed conditional uses are similar in nature in terms of traffic generation, approximately 1 trip per month. Therefore, this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. There is no proposed increase in floor area as part of this proposal, since the additional equipment is to be located in the existing shelter structure. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There is no common open space required for this type of development, therefore this standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. There are no specific amenities provided by the existing development. The amount of landscaping exceeds the 15% minimum required in this zone, and no reduction of this landscaping or screening is proposed. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The site was developed prior to the present Wireless Communications Facility Ordinance (TDC 18.798) and was approved through a conditional use process, CUP 96-0009. There were no additional conditions of that approval. Since no conditions are adversely impacted, this criterion is satisfied. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an existing site. Please note: there is a pending approval for this site to locate antennae at 59 feet AGL by Cingular Wireless. From the information contained in this and the previous request, it appears that the two applications will not conflict. It is the applicant and ultimately the owner's responsibility to ensure that both proposals can be accommodated. The City assumes no liability for issuing an approval that cannot be implemented due to site specific requirements or prior private agreements. PROJECT DESCRIPTION Verizon Wireless (VZW) currently operates a "cell site" on Highway 99W near Walnut Street. (Exhibit A). The site was originally approved by the City of Tigard in 1996, Conditional Use Permit 96-0009 (Exhibit B). The VZW cell site consists of an 80-foot steel monopole with nine panel antennas and a 12-foot x 20-foot equipment building on the ground within a 40-foot by 40- foot lease area(Exhibit A). Verizon Wireless is expanding and upgrading its Pacific Northwest wireless services network in the Tigard area by adding high-speed mobile data service. In order to upgrade its data signal coverage along Highway 99W and surrounding areas, it is necessary for VZW to install three new panel antennas at the existing site (bringing the total number to twelve). The panel antennas will enable VZW to provide high-speed wireless signals to where they are needed the most, and direct them away from where they are not needed. This will improve signal quality and reliability. III. APPLICABLE STANDARDS 18.798 WIRELESS COMMUNICATION FACILITIES 18.798.040 Uses Permitted Outright A. Collocation of antenna(s) on existing towers in commercial and industrial zones. Installing an antenna(s) on an existing communication tower of any height is permitted outright, so long as the additional antenna(s) are no more than 20 feet higher than the existing tower, no more than three providers are collocating on the towers, and the color of the antenna(s) blends with the existing structure or surroundings; Verizon Wireless is proposing to add the three new antennas on its existing site at 12955 SW Pacific Highway. The height of the tower will not be increased. The property is zoned C-G General Commercial. Therefore, the co-location is a permitted use subject to a Type I Minor Modification. 18.360 SITE DEVELOPMENT REVIEW 18 360.050 Major Modification(s)to Approved Plans or Existing Development A. Determination request An applicant may request approval of a modification to an approved plan or existing development by: 1. Therefore, off- site traffic will not be affected. Therefore, no change is proposed. 7.
