MMD2006 00003 HOME DEPOT HOT DOG VENDOR RELOCATION 4 May 16,2006 CITY OF TIGARD OREGON Thomas Ko 4932 Parkhill Street Lake Oswego,OR 97035 RE: Minor Modification MMD2006-00003 Dear Mr. Ko: This letter is in response to your request for a Minor Modification (MlvID2006-00003) at 14800 SW Sequoia Parkway, WCTM 2S112AD, Tax Lot 00900. You have requested to replace and relocate a mobile food vending unit within the Home Depot parking lot. The proposed use is permitted in an Industrial Park (I-P) zone. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed modification would not require additional parking. While the relocation of the mobile unit would cause 3-4 parking spaces to be unusable, there will be no need to replace these spaces. Currently, 510 parking spaces exist,which is 26 spaces above the minimum parking requirement. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change of use is proposed and the applicant proposes to replace the existing vending unit with a unit of the same type. Therefore, the proposed modification does not cause a change in the type of commercial or industrial structure on the site. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the mobile food vending unit. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. No increase in vehicular traffic is expected from this proposed modification. The mobile food-vending unit is not a drive-thru business. Customers patronize the business by foot. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The applicant roposes to decrease the floor area by 8 square feet, from 168 square feet to 160 square feet. Therefore , there would be no increase in floor area. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing landscaping. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The proposed modification is not in conflict with the conditions imposed at the time of Site Development Review approval for the Home Depot store (SDR93-00001). Finding: The proposed modification complies with all applicable requirements of this title and is not a major modification. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DIVISION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an approved site development plan. The Director's designee has determined that the proposed minor modification of this existing plan will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws.
