March 28, 2006 �� im it CITY OF TIGARD Chuck Day OREGON Tualatin Congregation of Jehovah's Witnesses 22503 SW Dewey Dr Sherwood, OR 97140 RE:Jehovah's Witnesses Classroom Addition, Case File No.MMD2006-00002 Dear Mr. Day: This letter is in response to your request for a Minor Modification (MMD2006-00002) of the approved site development plan (CU 88-10) located at 9450 SW Durham Road,WCTM 2S 114AB, Tax Lot 00700. You have requested to modify the approved site plan by adding 1,492 square feet of classroom space along the rear of the building. The submitted site plan shows the proposed location. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Table 18.765.2 states that the required minimum number of motor vehicle parking spaces for a religious institution is 1.0 per 3 seats in the main assembly area. Because the proposal does not involve increasing the size of the main assembly area, additional on-site motor vehicle parking would not be necessary. However, the site plan shows the proposed additional classroom space extending through an area designated for bicycle parking (see original site plan in CU 88-10). Table 18.765.2 states that the required minimum number of bicycle parking spaces for a religious institution is 1.0 per 20 seats. While no additional bicycle parking would be necessary, the bicycle rack should be relocated in accordance with section 18.765.050. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The existing building already includes a classroom. Therefore, the proposed addition of a classroom would not change the structural occupancy type of the building. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. A 1,492 square foot classroom(in a private school) can be expected to generate a rough average of 13.5 vehicles trips per week day, or a range of 12.0 to 17.3 vehicle trips per week day.1 No information was available to calculate a rough estimate of vehicle trips generated on Saturday or Sunday. However, based on the available information and the assumption that students attending class would most likely arrive with church attendees, the proposed modification would not be expected to generate traffic exceeding 100 vehicles per day. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed classroom space addition is less than 5,000 square feet. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The site plan shows that no common open space will be affected by the proposed modification. Therefore,this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed modification would decrease the total landscape area by 7%, but landscape area would still compose 32% of the entire lot. While the code does not include specific landscaping requirements for religious institutions, the proposed change will not reduce or eliminate project amenities by more than 10 percent where specified in the site plan. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The conditional use approval for this site (CU 88-10) required the retention of all possible perimeter trees, even those smaller than 6 inches in diameter. The proposed modification includes the removal of 3 trees, but they are not perimeter trees. Therefore, the proposal will not affect compliance with any specific previous conditions of approval. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF THE SITE AND/OR BUILDING PERMITS: Submit to the Planning Department(Emily Eng,(503) 718-2712) for review and approval: 1. A site plan showing the relocation of the existing bicycle rack in accordance with section 18.765.050. This request is determined to be a minor modification to an approved site development plan.
