July 11,2006 CITY OF TIGARD OREGON Precision Construction Attn:Phil Young 8025 NE Killingsworth Portland, OR,97218 RE:Verizon Minor Modification MMD2006-00006 Dear Mr.Young: This letter is in response to your request for a Minor Modification (M D2006-00006) at 8840 SW Burnham Street, WCTM 2S102DB, Tax Lot 100. You have requested to modify the site to accommodate the storage of construction equipment and fleet vehicles with two outdoor storage areas and 7 parking spaces. The proposed use is permitted in the CBD zone. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The addition of 7 new parking spaces is for fleet vehicles and the proposed modification does not include an increase in office space. Therefore,the proposal would not require additional parking spaces. 4. A change in the type of commercial, or industrial structures as defined by the Uniform Building Code. The purpose of the proposed modification is to accommodate the existing use of the site and no structures are being altered. Therefore, there is no change in the type of commercial or industrial structures as defined by the Uniform Building Code. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. Therefore,this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. Because the 2,600 SF designated for a graveled storage area is already impervious,the proposed modification would increase impervious floor area by 2,100 SF at most. Therefore,this critenon does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to common or usable open space. Therefore,this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. Existing landscaping is approximately 18% of the site. The proposed changes would cause existing landscaping to be reduced by approximately 4 percent. The proposed modification would not cause existing landscaping to be reduced below 10% or below the minimum required by the code. However, the 700 SF storage area is not permitted in the vegetative screening. The applicant shall revise the site plan that indicates another location for the 700 SF storage area that meets the Development Code and submit the revised site plan to be approved. Otherwise, staff will revise the site plan to eliminate the storage area. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. There have not been any previous conditions of approval for the use of this site. Therefore,this criterion does not apply. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. Submit a revised site plan that indicates another location for the 700 SF storage area that meets the Development Code;otherwise,staff will revise the site plan to eliminate the 700 SF storage area. The Director's designee has determined that the proposed minor modification of this existing plan will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws.
