Portland, OR 97223-8629 RE: Minor Modification Request, Case File No. MMD2005-00017 Dear Mr. Reid: This letter is in response to your request for a Minor Modification (MMD2005-00017) of the Raz Transportation site located at 11655 SW Pacific Hwy, WCTM 2S136CA, Tax Lot 01600. You have requested improvements to the parking access drive located o the north side of the facility's bus maintenance shop. The work would include grading the parking lot roadways and applying gravel roll ready for chip seal to 2 inches thick. In addition your propose future work including a concrete buss traffic apron on adjoining north side of maintenance shop and asphalt parking lot roadways. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. 2. A change in the ratio or number of different types of dwelling units. This request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed parking access improvements do not require additional on-site parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. Changes are not proposed to any commercial or industrial structures. 5. An increase in the height of the building(s) by more than 20 percent. No changes to buildings are proposed. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposed changes to the gravel access road would improve site conditions by reducing dust and frequency of cleaning the buses but would not affect off-site traffic. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. Improvements to the proposed gravel parking access road would not involve increased floor area of any buildings on-site. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. No reduction of open space is proposed or required for the proposed improvements of the existing parking lot access road. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed improvements would not reduce any existing screening or landscaping. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The site was developed prior to the current development code and therefore no site development review approval was obtained for the existing buildings. However, a Final Order by the Tigard City Council dated May 12, 1998 restricts an allowed non-conforming use from occurring within 200 feet of the parcel's northern boundary on land designated R-12. No modification to this condition is requested for the proposes development. Based on aerial photos of the site showing the existing parking access within 200 feet of the northern boundary, a site visit was made on August 30, 2005 to determine if the Order was being observed. The site visit, with Jeff Lee, RAZ Site Manager, found that the access drive extended into the 200-foot reserve. Yet Brian Reid, RAZ Maintenance Manager, certified in the supplemental application materials that the northern 200 feet of the subject site is not used for bus parking or parking access. To address this apparent discrepancy, Mr. Lee offered to landscape the boundary and Mr. Reid offered to install a small wood post fence to ensure no encroachment would occur into the future, consistent with the City Council Order. Therefore, a condition of approval will be imposed to implement these assurances. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental or injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws and the following condition of approval. CONDITION: Prior to the proposed parking access improvements, the applicant shall install a wood post fence at least 200 feet from the northern property line extending the full width oftheproperty. In addition, a landscape buffer shall be planted according to a landscape plan and schedule submitted to the City for review and approval. Staff has reviewed land use files for the subject property located at 11655 SW Pacific Highway (Tax Lot Map and#: 1 S 136CA-01600) and determined that the facility does not comply with all applicable Tigard land use requirements. I have enclosed a copy of the Notice and Final Order by the Tigard City Council dated May 12, 2005 that restricts an allowed non-conforming use from occurring within 200 feet of the parcel's northern boundary. A 2004 aerial photo shows that land within approximately 140 feet of the subject parcel's northern boundary is being used for gravel road access and parking. Therefore, the facility is not in compliance with the Order. Furthermore, the City is in receipt of Minor Modification Application for Parking Drive Improvements for the subject parcel that would partially occur within 200 feet of the northern boundary. The subject parcel is zoned R-12 on the northern half and CG on the southern half. Pursuant to Tigard Development Code 18.760.040.B.6, "No additional structure, building, or sign shall be constructed on the lot in connections with such nonconforming use of land." I recommend that the application be withdrawn and revised showing the 200 foot limit and the zoning on the site plan and including a narrative addressing the non-conforming use standards. Immediate Project Benefits The project benefits the environment by reducing the amount of suspended solids (dust/dirt) being introduced into the stormwater,reducing the amount of fugitive dust emissions generated by bus traffic on the parking drives, and by reducing the amount of spent/used bus maintenance fluids generated (as the dust and dirt tend to add ware and tear on the busses). Additionally, the project will result in a reduction in the amount of buss wash water generated from bus washing operations as there will be less dust/dirt generated in the bus parking yard. State of Oregon WHY IS A LUCS REQUIRED? Oregon law requires state agency activities that impact land use be consistent with local Department of comprehensive plans. Narrative - Project Description The Minor Modification Type I Application was submitted for approval to improve, as listed below, the surface quality of the parking access drive located on the north side of the facility's bus maintenance shop (as depicted in Figure 2, attached). Immediate Work To Be Performed • Grade parking lot roadways, rip and reshape for drainage and roll. • Apply and spread 3/4-0 crushed rock over parking lot roadways and roll ready for chip seal (binder/sealer) to between 1 1/5"to 2"thick. Future Work To Be Performed • Concrete bus traffic apron on adjoining north side of maintenance shop (between maintenance shop and bus wash area. • Asphalt parking lot roadways. The project conforms to Tigard Development Code 18.760.040.B.6 as no additional structure, building, or sign is to be constructed on the portion of the property zoned R-12. For that matter, no structure, building or sign is proposed in the project. Thank you for enclosing a copy of the Notice and Final Order by the Tigard City Council that is dated May 12, 1998, not 2005 as indicated in your letter. According to Brain Reid the northern 200 feet are not used for bus parking or parking access. Additional Mr. Reid has stated that the proposed improvement to the surface quality of the parking access drive will not result in encroachment onto the northern 200 feet and that the edge of the proposed improved parking access drive be greater than 200 feet from the northern property line. Immediate Project Benefits Again, this project benefits the environment by reducing the amount of suspended solids (dust/dirt) being introduced into the stormwater, reducing the amount of fugitive dust emissions generated by bus traffic on the parking drives, and by reducing the amount of spent/used bus maintenance fluids generated (as the dust and dirt tend to add wear and tear on the busses). Additionally, the project will result in a reduction in the amount of bus wash water generated from bus washing operations, as there will be less dust/dirt generated in the bus-parking yard.
