Dear Mr. Siemieniec:
This letter is in response to your request for Minor Modification (MMD2005-00024) approval to a
previous Tigard First Baptist Church Conditional Use (CUP2004-00005) to change the phasing of
the project and several site improvements.
Phase 1 will include changing several existing parking stalls to accommodate the required ADA
spaces. The decommissioning of the current septic field and capping off the septic tank for the
accessory building to the west of the main assembly will also occur during Phase 1. The final
proposed change is an outfall drain from the water quality swale to the creek bed. This will require
a Type I Sensitive Lands Review before being constructed.
Phase 2 will include the new church sanctuary building and vehicle turn-around. Changes to the
original approval will include shape and orientation. The location is primarily the same with the
exception of the building moving to the inside edge of the building setback.
Phase 3 will include the demolishing of the existing Bolt Hall and new parking will be added in its
place. The existing SW 110th Avenue entry/parking will be reconstructed to connect to the new
parking area including an upgraded access drive. The only difference in phase 3 is that the two
existing buildings will not be connected by an addition. The applicant has submitted plans with
this application that show the proposed changes. The subject property is located at 11075 SW
Gaarde Street (WCTM 2S103DC, Tax Lot 01100).
The Tigard Community Development Code, Conditional Use Section, states that any modification
which is not within the description of a major modification shall be considered a minor
modification.
Section 18.330.020.B. states that the Director shall determine that a major modification(s) has
resulted if one (1) or more of the changes listed below have been proposed:

1. A change in land use.
No change in land use is proposed. The site is currently developed as a church. After
the modification the site will still be a church.
2. A 10% increase in dwelling unit density. The subject site does not involve a
residential use. Therefore, this standard does not apply.
3. A change in the type and/or location of access ways and parking areas where off-
site traffic would be affected. The existing southernmost entry on SW 110th Avenue
will remain in its current location rather than the proposed shift. All other access drives
are located in the originally proposed locations.
4. An increase in the floor area proposed for non-residential use by more than 10%
where previously specified. The new footprint of the proposed building will not
increase the proposed floor area.
5. A reduction of more than 10% of the area reserved for common open space and/or
usable open space. The applicant is proposing 6,674 square feet of additional
impervious surface for parking. The amount of open space associated with this project
was approved at 82,418 square feet. A 10 percent increase to the approved open space
would equal 8,241 square feet. Therefore, the additional impervious surface is below ten
percent. This criterion is satisfied.
6. A reduction of specified setback requirements by more than 20%.
No setback reduction has been proposed. Therefore, this standard is satisfied.
7. An elimination of project amenities by more than 10% where previously specified
provided such as: 1. Recreational facilities 2. Screening; or 3. Landscaping
provisions. No project amenities have been proposed to be eliminated. The applicant
is adding an additional 6,674 square feet of impervious surface, which will not reduce
project amenities.
8. A 10% increase in the approved density.
The proposed modification is non-residential. Therefore, this standard does not apply.
THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE CONDITIONS BELOW:
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF THE
PHASE I SITE PERMIT:
Submit to the Engineering Department (Kim McMillan, 639-4171, ext. 2642) for review and
approval:
1. The applicant shall provide revised design plans and calculations for the proposed
private water quality facility to be submitted to the Engineering Department (Kim
McMillan) as a part of the Public Facility Improvement (PFI) permit plans. Included with
the plans shall be a proposed landscape plan and maintenance plan.
2. The applicant shall obtain approval from CWS for the proposed piped stormwater outfall.
3. The applicant's Sensitive Land Review application must be approved.

This request is determined to be a minor modification to an existing site. The Director's designee
has determined that the proposed minor modification of this existing site will continue to promote
the general welfare of the City and will not be significantly detrimental or injurious to surrounding
properties provided that, development which occurs after this decision complies with all applicable
local, state, and federal laws.

Revised Proposal Summary For Minor Modification November 23,

Tigard First Baptist Church (CUP 20047-00005) (Revised December
15, 2005)
The changes from the original Conditions of Approval 2004-00005 are as follows:
The changes from the original CUP involves the phasing of the project (mostly at Phases 2 &
3) and several site improvements. These changes are based on various CUP requirements
and the Phasing Changes which were allowed based on the Hearing Officer for the City of
Tigard Final Order for CUP 2004-00005 C.Discussion item 6. The current church project
phasing is now as follows:
Phase 1 - A new 168 space parking lot in the east and south portions of the site,
including a new access to SW 110' Avenue and SW Guaarde street will be built.
Differences from the original Phase 1 include:
• The northeast portion of the site has more parking than the original Phase 1 due to the
Occupancy requirements that will come into effect at Phase 2.
• Other changes include the conversion of several existing parking spaces to
accommodate the required ADAAG spaces.
• The Septic field will be decommissioned and the tank will be capped off at Bolt hall to
accommodate the new parking. The temporary line shown in the original CUP will not
be used.
Please refer to Drawings A1.1 and Exhibit A.
• Also during Phase 1,an outfall drain from the water quality swale to the creek bed will
be constructed(the original CUP submittal only shows sheet flow). Clean Water
Services is also being updated.
Refer to Drawing C-1
Phase 2 - A new 2-Story Church Sanctuary building and vehicle turn-around will be
built. The building shape is preliminary and can change at the time the building
permit application is submitted. The original 12,918 s.f. footprint approved in the CUP
for the size of the building will not be exceeded and may actually be reduced. The
height of the building will not exceed the original submitted in the CUP either.
Differences from the original Phase 2 include (this is taking the assumption that the
phases are rearranged as approved by the CUP 2004-2005 C Discussion item 6):
• Shape and orientation differ from the original building proposed.
• The location is primarily the same with the exception of the building moving to the
inside edge of the building setback.
• Part of the existing southeastern SW 110'entry/parking will remain and a drop-off turn-
around will be constructed(we created a smoother,full circle versus the original shape
submitted in the CUP). A few new parking spaces will be added and several will be
converted to Accessible parking spaces.

Phase 3 - The existing Bolt Hall will be demolished and new parking will be added in
it's place. The existing southeastern SW 110'^ entry/parking will be reconstructed to
connect to the new parking including an upgraded drive. The difference from the
original Phase 3 includes:

The existing Southernmost entry on SW 110`h Ave will remain in its current existing
location (rather than slightly shifting it South as indicated in the original CUP drawings).
It is therefore not a change in location but a re-use of an existing location. All other
drives are located in the original proposed CUP locations.
d. An increase in the floor area proposed for non-residential use by more than 10% where
previously specified;
The new footprint of the building did not increase the proposed floor area

There is not a 10% or greater reduction in open space:
