Tigard, OR 97223 Dear Mr. Lawhead: This letter is in response to your request for Minor Modification (MMD2005-00016) approval to expand the existing sign at the Tigard Plaza Shopping Center on the corner of SW Pacific Highway and SW Hall Boulevard from 144 square feet to 270 square feet of sign area. The requested increase is to provide adequate space for the amount of tenants within the shopping center. The applicant has addressed both the applicable sign requirements and the minor modification requirement of the Tigard Development Code. The subject site is located at 11945 SW Pacific Highway; WCTM 1S135DD, Tax Lot 03301. In the C-G and CBD zones. No sign shall be permitted in the C-G and CBD zones except for the following: The maximum square footage of signs shall be 70 square feet per face or a total of 140 square feet for all sign faces. No part of any freestanding sign shall extend over a property line into public right-of-way space; The applicant has indicated that the sign has a total of 72 square feet of sign area per face for a total of 144 square feet. The following standard allows an increase of one foot for each lineal foot the sign in moved back to the property line. The proposed sign is approximately two feet from the existing property line. Therefore, the increase to the maximum square footage of 70 square feet per face is warranted. The sign area may be increased one square foot for each lineal foot the sign is moved back from the front property line to which the sign is adjacent. If the street is curbed and paved, the measurement may be taken from a point which is 15 feet from the pavement. This increase in sign area is limited to a maximum of 90 square feet per face or a total of 180 square feet for all faces; and According to the pictures submitted by the applicant, the existing sign and the proposed sign will be approximately two feet from the property line abutting SW Pacific Highway. Therefore, the 72 square feet per face of the existing sign is warranted. Additional requirements in commercial and industrial zones: (18.780.130.G) If it is determined under the site development review process that the sign's visual appeal and overall design quality would be served while maintaining the intent and purpose of this chapter, an additional 50% of the allowable sign area and 25% of sign height may be permitted. No copy will be permitted in the additional area or height. For purposes of this subsection the word "copy" includes symbols, logos and figures, as well as letters. The applicant has made the argument that the proposed increase will serve the overall design uality of the existing sign based on the MUTCD (Manual on Uniform Traffic Control Devices). Tie MUTCD states, Highway signs have two distinct advantages, which on- premise business signs do not have. They are usually directly facing traffic and/or are immediately adjacent to the roadway and they are allowed a much larger font then on- premise signs. The applicant is requesting the increase of the on-premise sign in order to 13125 SW Hall Blvd., Tigard, OR 97223 (503) 639-4171 TDD (503) 684-2772 • adequately advertise the uses within the Shopping Center. Staff however, does not agree with the applicant regarding the on-premises sign because the location of the sign in question is located on the corner of SW Pacific Highway and SW Hall Blvd, which, is immediately adjacent to the highway and is directly facing traffic in either direction along SW Pacific Highway. Staff does agree that due to the number of tenants located within the shopping center (14 tenants) an increase is warranted. The applicant has proposed to increase the square footage of the sign's area along SW Pacific Highway from 144 square feet to 270 square feet (135 sq. ft. per face). The above criterion only allows a 50% increase in sign area. Therefore, the applicant can only increase the total sign area to 216 square feet (108 sq. ft. per face) based on the criteria below. Each freestanding sign shall be surrounded by an area set aside to protect the sign from vehicles negotiating in the parking area of the business and the area set aside shall be landscaped: The existing sign is located within a landscaped island. The new sign will be installed in the same location as the existing sign. The applicant has provided a picture of the existing landscaped island, which shows what appear to be juniper bushes that are greater than three feet in height. According to Section 18.795.030.B Obstructions prohibited, "A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure or temporary or permanent obstruction (except for an occasional utility pole or tree), exceeding three feet in height, measured from the top of the curb, or where no curb exists, from the street center line grade, except that trees exceeding this height may be located in this area, provided all branches below eight feet are removed." Therefore, the applicant will be required to prune the existing shrubbery to a height that does not exceed three feet. CONDITION: The applicant is required to prune the existing shrubbery to a height that does not exceed three feet. No freestanding sign, nor any portion of any freestanding sign, shall be located or project over any portion of a street, sidewalk or other public right-of-way or property unless an exception has been granted; The applicant's plan shows the existing and proposed sign to be fully contained within the property lines of the subject property. Therefore, this criterion is satisfied. When a premises contains more than a single tenant but is not defined as a shopping center, the provisions of a freestanding sign shall take into consideration the need for providing a signing system which is harmonious in appearance and legible: The subject property is considered a shopping center. Therefore, this standard does not apply. Shopping centers or industrial parks shall establish a single signing format: Up to an additional 50% of sign area may be permitted under the development review process to adequately identify the complex when it can be determined that the increased sign area will not be inconsistent with the purposes of this chapter; The purposes of 18.780 Signs are: 1. To protect the health, safety, property and welfare of the public; 2. To promote the neat, clean, orderly and attractive appearance of the community; 3. To accommodate the need of sign users while avoiding nuisances to nearby properties; 4. To insure for safe construction, location, erection and maintenance of signs; 5. To prevent proliferation of signs and sign clutter; and 6. To minimize distractions for motorists on public highways and streets. Page 2 of 5 7. To regulate solely on the basis of time, place and manner of a sign, not on its content. The applicant is proposing to replace the sign on the corner of SW Pacific Highway. Due to the age of the shopping center and the sign, the replacement and the proposed increase will promote a more attractive appearance to the area. It is the intent of the applicant to increase awareness of the tenants of the shopping center. The proposed sign will be placed in the area of the existing sign, therefore, it is not anticipated to distract motorists along the highway any more than the existing sign. Based on the analysis within this decision and conditions of approval, staff is satisfied that the purpose of 18.780 Signs has been met. This increase should be judged according to unique identification needs and circumstances which necessitate additional area to make the sign sufficiently legible; The applicant makes the argument that because of the speed of traffic along Pacific Highway and the amount of lanes, it is essential that the motorist has enough reading time to make a decision to turn into the site. This criterion has been met. When a shopping center or industrial park has more than one main entrance on separate frontages, a second freestanding sign may be allowed under the site development review process. The two allowable signs shall face separate frontages and are not intended to be viewed simultaneously; The subject site has frontage on SW Hall Blvd., SW Pacific Highway and SW Center Street, all of which have an existing pole sign. Each sign faces a separate frontage and cannot be viewed simultaneously. Therefore, this standard is satisfied. Legal owners or occupants of properties or buildings which are in shopping plazas and which are directly located or are proposed to be located on a commercially- and industrially-zoned corner property(ies) (one or more contiguous tax lots located at the intersection of two or more public streets), shall be allowed to have one freestanding sign along each street frontage when all of the following are met: According to 18.780.015 Definitions the definition of a "Shopping plaza" is, "development of between two and seven business units." The subject site has 14 tenants. Therefore, the site is considered a "Shopping center" which is defined as a development of not less than eight business units. Therefore, shopping plaza standards do not apply. FINDING: Based on the analysis above, the Sign Code Standards have not been met. If the applicant satisfies the following condition, the standards will be met. CONDITIONS: The applicant can only increase the total sign area to 216 square feet (108 sq. ft. per face) based on the criteria below. The applicant is required to prune the existing shrubbery to a height that does not exceed three feet The Tigard Community Development Code, Site Development Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Site Development Review application." Section 18.360.030.B. states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: Page 3 of 5 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The requested modification is to the existing sign of SW pacific Highway and SW Hall Boulevard. Therefore, no change involving on-site parking is proposed. This standard does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed modification does not involve any change to existing structures. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 percent. The proposed modification does not involve any change to existing structures. Therefore, this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposed modification is to an existing sign located on the subject property. Therefore, no modifications to existing access ways or parking areas are proposed. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposal is for the expansion of an existing sign. Therefore, no increase to traffic is anticipated. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. Floor area refers to buildings. The proposed modification is to an existing sign. Therefore, this standard does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. Open space requirements are not applicable to this site. The proposal is for the expansion of an existing sign. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. No modification is proposed to project amenities. Therefore, this standard does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. Staff conducted a search of City records and found no original land-use approval associated with this property. Therefore, this standard does not apply. Sign"A" and Sign "B" 8'x10'x15' high combined do not exceed 150% of the normally allowed height. Sign "C" 8'x10'x15' high at the Center st. entrance would exceed the 150%. We are willing to remove either Sign "B" or Sign "C" to come within the 150% limit if required. c. Shopping centers in the C-G zoning district shall be entitled to freestanding signage according to the following optional standards: a. A maximum of two freestanding signs shall be permitted per roadway frontage provided they can meet both sign area and sign height requirements as set forth in this subsection; The sign has been designed to meet all of the area and height requirements in this subsection. b. The combined height of two signs shall not exceed 150% of the sign height normally allowed for one freestanding sign in the same zoning district; however, neither shall exceed the height normally allowed in the same zoning district; Sign "A" and one of the other signs, "B" & "C" will not exceed 150% of the sign height normally allowed. The third sign will be removed. c. Total combined sign area for both signs shall not exceed 150% of what is normally allowed for one freestanding sign in the same zoning district; however, neither shall exceed the area normally allowed in the same zoning district. This item does not apply because we are asking for an increase in the square footage to allow for proper tenant advertising. e. A sign permit shall be required prior to erection of any freestanding sign referred to in this subsection. A sign permit will be obtained after approval from the planning commission. C. In the C-G and CBD zones. No sign shall be permitted in the C-G and CBD zones except for the following. 1 . Freestanding signs shall have certain limitations and conditions when permitted on properties in commercial zones; a. One multi-faced, freestanding sign shall be permitted subject to conditions and limitations as stated herein; b. A reader-board assembly may be an integral part of the freestanding sign; There will be no reader-board on this sign. c. The maximum square footage of signs shall be 70 square feet per face or a total of 140 square feet for all sign faces. No part of any freestanding sign shall extend over a property line into public right-of-way space; The purpose of this application is to request a square footage enlargement of 50% as stipulated in section "G". This increase in sign area is limited to a maximum of 90 square feet per face or a total of 180 square feet for all faces. The sign will not be moved from it's original position. e. Freestanding signs located next to the public right-of-way shall not exceed 20 feet in height Height may be increased one foot in height for each 10 feet of setback from the property line or a point 15 feet from the edge of pavement, whichever is less, to a maximum of 22 feet in height. The owners of the Shopping Center have asked me to file for a Site Development Review to allow for a larger sign than is normally permitted. Section 18.780-22 of the City of Tigard Sign Code, Division "G" Additional requirements in commercial and industrial zones. If it is determined under the site development review process that the sign's visual appeal and overall design quality would be served white maintaining the intent and purpose of this chapter, an additional 50% of the allowable sign area and 25% of sign height may be permitted. No copy will be permitted in the additional area or height. For purposes of this subsection the word "copy' includes symbols, logos and figures, as well as letters. Please review the drawing of the new proposed pylon sign to replace the old outdated existing pylon sign. The sign was designed based on the principals outlined in "The Signage Sourcebook" and the "MUTCD" (Manual on Uniform Traffic Control Devices) written by the Federal Highway Administration (FHWA). On page 62 of The Signage Sourcebook, states, "Highway signs have two distinct advantages, which on-premise business signs do not have. They are usually directly facing traffic and/or are immediately adjacent to the roadway. In addition, they display letters and back- ground that optimally contrast, e.g. white lettering on a green or blue background. Motorists, familiar with the standardized style of lettering and the colors, immediately recognize that they are receiving directional information. For the on-premise business sign, the situation is usually quite different. Unless the business is part of a national chain backed up by extensive advertising in other forms of media, the sign itself is not standardized and, therefore, is not immediately recognizable as offering a certain type of information. For that reason, lower measures (less stringent demand) of visual acuity should be used when calculating the size of letters necessary for a visually safe and effective on-premise sign in other words, the lettering may need to be larger to communicate at the same level as highway signage. TIGARD,OR 97223 VOICE 503-620-8205 FAX. 503-624-3725 The Sourcebook (table 2) on page 69 "Standard letter height guidelines for On-Premise Signs states, at a speed of 35 mph a driver will need 280 ft. of distance just to read a tenant name, to safely make a decision to turn into the project. The minimum copy size should be 9" high. The tenant panels on the proposed pylon sign are16"x72". A simple name approx. 11" high for each tenant will fit nicely within each panel with visible space above and below. The eye reads the space above, below and between each word as well as the lettering. With the tenant signage established, and the number of tenants arranged on the sign 14 in all, and the anchor tenant (Joann) at the top, we are asking for an increase in the square footage of the sign as well as the height. If the size of the lettering is too small (as per the existing sign) traffic safety is compromised. It is essential for the driver to be able to read the sign within enough time to negotiate traffic and make the turn which is just past the sign a short distance to the West. The intersection of Hall & Hwy 99 is busy and any extra traffic caused by unreadable signage is a detriment to traffic safety. Studies have shown that the population in any given urban area will have a 20% move in move out per year. That means, even though a shopping center may have been at the site for 20 years, 20 % of the population per year will not know it's location until they drive by, and read the sign. The sign is designed to reflect the new architecture planned for the site. Colors, shapes & materials have been used to achieve this end. The new sign will be pleasing to the eye and enhance the property. It will communicate with the public and draw them into the site. The sign will be high enough to allow visibility underneath. The bushes will be removed to allow for more see through, and the sign will be positioned in the same area as the old sign outside the required visibility triangle, but within the planter area. For the above listed reasons, we are asking the Director of planning to approve the sign as designed. The owners are upgrading their property and a nicely designed sign will enhance the project.
